SUBJECT: Memorandum of Understanding with Public Works Union
Introduction
The Council is asked to authorize the appropriate individuals to sign the attached Memorandum of
Understanding with the Teamsters Local 320, representing employees in the Public Works Department.
Background
The established labor agreement with the Public Works union includes language on how overtime
opportunities are to be distributed amongst union members. The attached Memorandum of
Understanding was drafted to help ensure that the City's practice of calling -in employees from the
division under which the work falls will not draw a grievance from the union. For example, when there
is an issue in one of the City's parks that needs to be addressed, it has been the City's practice to call -in
the Parks Division employee who is lowest on the overtime list, even if there is a Street or Fleet Division
employee who is lower on the overtime list. This is a longstanding approach that both employees and
management support.

Requested Action
If the Council concurs, it should offer a motion to authorize the appropriate officials to enter into the
attached Memorandum of Understanding with the Teamsters Local 320, representing employees in the
Public Works Department.
This is an Agreement entered into between Minnesota Teamsters Public and Law Enforcement
Employees' Union, Local No. 320 (Union) and The City of Shakopee (Employer):
WHEREAS, Teamsters Local 320 is the certified exclusive representative for the Shakopee
Public Works Department employees;
WHEREAS, the parties have negotiated and agreed upon the following terms and conditions of
employment for the bargaining unit employees and wish to further specify the agreed upon
terms and conditions of employment in the agreement;
NOW, THEREFORE, it is mutually understood and agreed to as following:
1. Recognizing the long standing practice of how divisional overtime has been
applied, the Union and the Employer agree to continue the established practice.
2. Recognizing that this established practice may not be in strict accordance with
the contract, the Union will not support any grievance against the established
practice as long as said practice is followed.
IN WITNESS THEREOF, the parties acknowledge that they have read the foregoing Agreement
and, by signing, hereby affirm that they fully understand and agree to its terms and application
for the duration of the 2010 - 2011 contract.
