Introduction
Council is requested to update the City Code for disposal of excess property.
Background
The purpose of this request is to update the City Code for the dollar levels and the methods of
disposal to reflect current commerce opportunities. Since the language of the code was written,
avenues for disposal that have become available include EBay, Craig's List, State auctions,
county auctions, private company auctions and donations to a worth y cause such as Scott
County Human Services. Donated property typically has been recovered stolen or abandoned
bicycles.
The dollar amount is set to match the level at which purchases require Council approval.
Requested changes are shown as follows;
Section 2.70 Sub 3. Disposal of Excess Property .

A. Declaration of Surplus and Authorizing Sale of Property. The City Administrator
may, from time to time, recommend to the Council that certain personal property
(chattels) owned by the City that is no longer needed for a municipal purpose and
should be sold. By action of the Council, said property shall be declared surplust-ie
value estimated and the City Administrator authorized to dispose of said property in
the manner stated herein. City Council may direct that surplus property be donated
to a worthy cause if the donation complies with state statutes for an eligible
recipient.
B. Surplus Property Worth an total Estimated Value of Less than $1,000 $15,000. The
City Administrator may sell surplus property of the City with an total estimated
value of less than $5,000 $15,000.
C. Surplus Property With an dal Estimated Value of X000 $15,000 or More.
1. The City Administrator shall offer for public sale to the highest bidder surplus
property with an total estimated value of $5,000 $15,000 or more. Not-lee-of
describing the property to be sold at least (10) days prior to the date of the sale
by publication once in the official newspa -per of the City. Such sale shall be to
the person submitting the highest bid.
2. Notwithstanding any of the above provision rcgrding publication and bidding
rcquircmcnt, the City Administrator is authorized to negotiate a direct sale of
surplus property with another government agency.
D. Repealed.
E. Receipts From Sales of Surplus Property. All receipts from sales of surplus property
under this Section shall be placed in the appropriate fund.

GENERAL GOVERNMENT, SECTION 2.70, DISPOSAL OF ABANDONED
MOTOR VEHICLES, UNCLAIMED PROPERTY AND
EXCESS PROPERTY, SUBD. 3. DISPOSAL OF EXCESS PROPERTY

THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, DOES ORDAIN:
Section 1. City Code Chapter 2, Administration and General Government, Section 2.70,
Disposal of Abandoned Motor Vehicles, Unclaimed Property and Excess Property, Subd. 3.
Disposal of Excess Property, is hereby amended to read as follows:
Subd. 3. Disposal of Excess Property.
A. Declaration of Surplus and Authorizing Sale of Property. The City Administrator may, from

the City that is no longer needed for a municipal purpose and should be sold. By action of
the Council, said property shall be declared surplus, the value estimated and the City

with an total estimated value of $3008 $15,000 or more. Notice of such sale shall be
given stating the time and place of sale and generally describing the property to be sold
newspaper of the City. Such sale shall be to the person submitting the highest bid.
2. Notwithstanding any of the above provision regrding publication and bidding
requirement, the City Administrator is authorized to negotiate a direct sale of surplus
property with another government agency.
D. Repealed.
E. Receipts From Sales of Surplus Property. All receipts from sales of surplus property under
this Section shall be placed in the appropriate fund.
Section 2. Effective Date. This ordinance becomes effective from and after its passage and
publication.
