No. 7073TO: Mayor and Council Mark McNeill, City Administrator CITY OF SHAKOPEE Memorandum FROM: Gregg Voxland, Finance Director SUBJ: Street Reconstruction Plan Public Hearing DATE: December 18, 2010 Introduction In order to fund certain projects by issuing bonds, Statutes require that a public hearing be held. The approval of the plan satisfies the conditions to be able to issue bonds but does not commit the Council to issuing the bonds or proceeding with any project on the list. Background Generally, projects that are not for recreation facilities, are not special assessments projects under MSA 429, but are for other public buildings and street reconstruction can be funded by issuing bonds without an election but require a public hearing on a Capital Improvement Plan or a Street Reconstruction Plan. The Plan and preliminary issuance of bonds has to be approved by all Council members present. Projects eligible to be funded by reconstruction bonds includes some traffic safety enhancements and the city share of projects by the county and state in addition to actual street reconstruction. MSA 475.58 provides that; "If a petition requesting a vote on the issuance is signed by voters equal to five percent of the votes cast in the last municipal general election and is filed with the municipal clerk within 30 days of the public hearing, the municipality may issue the bonds only after obtaining the approval of a majority of the voters voting on the question of the issuance of the obligations." It is planned to have one bond issue in 2011 to fund the special assessment share of the TH 300 reconstruction project, the 2011 street recon project and the city share of the county project for reconstruction of HWY 101 Fillmore to Marschall. Based on the CIP, there are no plans to issue bonds in 2012. Attached is the 5 year street reconstruction plan for which bonds would be issued under MSA 475.58. Council needs to hold a public hearing and adopt the plan in order to issue bonds for those projects. Items to be covered in the hearing are; 1. The streets to be reconstructed. 7 2. The estimated cost. 3. The planned reconstruction of streets over the next 5 years. The action gives preliminary approval to issue bonds for the street reconstruction projects listed. The normal approval process for each project still has to be followed as does final approval to actually issue bonds. The Plan should be updated annually as needed. Action 1. Gregg Voxland Finance Director Budgetil /cipil /recon RESOLUTION NO. 7073 A RESOLUTION ADOPTING A FIVE YEAR STREET RECONSTRUCTION PLAN WHEREAS, MSA 475.58 requires adoption of a five year Street Reconstruction Plan in order to issue bonds to fund eligible projects, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the attached five year Street Reconstruction Plan is hereby adopted and preliminary approval is given for the issuance of General Obligation bonds in the amount of $4,185,000 to pay for projects included in the Plan. Adopted in session of the City Council of the City of Shakopee, Minnesota held this Fourth day of January, 2011.
