INTRODUCTION:
BACKGROUND:

Lametti & Sons, Inc., the contractor for the MCES Interceptor Lining Project on the
Chaska Interceptor, has requested that City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for
certain work hours.
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Lametti & Sons, Inc. is requesting a suspension on the hours to allow for work 24 hours a
day, 7 days a week for a period starting May 2, 2011 and ending September 2, 2011. (See
attached letter)
This request is for the location of the CIPP lining along T.H. 169 right -of -way beginning
1 /2 mile west of Marschall Road to Eagle Creek Boulevard. A second request for
extending work hours will be done later from C.R. 15 to '/2 mile west of Marschall Road.
Attached is a 2011 project map showing the MCES lining project limits.
This request is being made because the lining process requires an over -night cure time so
the crew will install the liner during normal working hours and the line will cure out at
night and for bypass pumping. Due to the high flows, bypass pumping will be required
for 24 hours a day and for a number of days to complete the lining Some minor digging
will also take place after normal working hours when traffic is lower. The cleaning
process will require some weekend hours to allow for cleaning during lower flows. Staff
is requesting that Council grant the appropriate City officials the authority to process
additional working hour requests.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure.
2. If property owner complaints are received by the City, the suspension can be revoked
at the discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Grant the Public Works Director the authority to process additional working hour
requests for this project, if necessary.
3. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice of the suspension terms.
4. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
5. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative's No. 1 and No. 2. The Contractor has indicated that they
need to meet local City Noise Ordinance.
ACTION REQUESTED:
1. Offer a motion approving a suspension of City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, D, to allow work 24 hours a day, 7 days a week for a period starting
May 2, 2011 and ending September 2, 2011 for the MCES Interceptor Lining
Project (CIPP) along the T.H. 169 right -of -way from 1/2 mile west of C.R. 17 to
Eagle Creek Boulevard. Said suspension is conditioned upon minimizing noise
exposure, if property owner complaints are received by the City, the suspension
can be revoked at the discretion of the City Engineer, and that the appropriate
public notice be placed in the Shakopee Valley News.
2. Grant the Public Works Director the authority to process additional working hour
requests for this project, if necessary.

Gentlemen:
As requested in our meeting with the City of Shakopee on November 30, 2010, we are providing the
following information regarding work on this project:
• Temporary Conveyance Piping Crossing at Eagle Creek Blvd.
Installation of the temporary conveyance system crossing under Eagle Creek Blvd. will not
occur until Spring 2011, so snow removal will not be a concern.
• Working Hours beyond City Standard Hours
Normal working hours for maintenance structure replacement / rehabilitation will conform to
current city standards (7:00 AM to 7:00 PM, Monday through Friday and 9:00 AM to 5:00 PM
Saturdays).
Working hours for CIPP installation cannot conform to the current city standards. We are
requesting a permit based on allowing hours as follows for CIPP installation:
7:00 AM Monday — Start CIPP Operations
7:00 PM Friday — Terminate CIPP Operations
- No restrictions on working hours during this time period
Based on current schedule, we anticipate commencing CIPP operations May 02, 2011 and
completing them September 02, 2011
The primary location of the CIPP lining on the project is located in the MNDOT TH 169
R.O.W. beginning % mile west of Marschall Road and extending east to Eagle Creek Blvd.
There is limited residential impact in this area.
The diversion pumping equipment will be installed and operated in such a manner as to limit
noise disturbances. The actual noise abatment steps will be determined during installation
and testing of the diversion system. Examples of noise abatment procedures could include
constructing berms to deflect noise, constructing curtains as noise mufflers, or installation of
commercially produced noise abating devices.
Overnight operations during CIPP installations are typically monitoring operations on the
diversion equipment and the CIPP liner as it cures.

Emergency Spill Response
This plan details specific actions that are to be taken in the event of any uncontrolled release of
wastewater to the environment.
For the duration of this project, an Emergency Spill Response Team (ESRT) has been
designated. The ESRT consists of the following members:

All members of the ESRT can respond to the site within 60 minutes of an alert on the project.
The project site shall be continuously monitored by a designated person during wastewater
conveyance activities. This designated person shall be referred to as the attendant.
The attendant shall monitor the conveyance system at all times. He or she will have no other
duties on the project. The attendant shall be knowledgeable in the operation of the wastewater
conveyance system. The goal of the attendant is to monitor the wastewater conveyance and
notify the project superintendent of unusual conditions to avoid potential wastewater spills.
In the event of a spill, the attendant shall immediately take the following measures:
1. Asses the nature of the spill and take measures to stop the spill.
2. Notify the Team Lead. The Team Lead shall respond to the project site within 60
minutes to ensure spill has been stopped and begin clean -up measures for the spill.
The Team Lead will determine if additional personnel or equipment is necessary to
abate the situation.
3. The Team Lead will contact MCES Dispatch @ 651 - 602 -4511 and provide the following
information:
a. Time of the spill
b. Estimated spill quantity
c. Cause of the spill
d. Clean -up and corrective measures underway

4. The Team Lead will contact the CAR and other members of the Emergency Spill
Response Team. If any property owners have been affected, the Team Lead will notify
them. If the spill involves vandalism, the police will be contacted and a report filed.
5. MCES will contact the appropriate municipalities (MNDOT, Scott County, City of
Shakopee).
6. Clean -up measures will be to the satisfaction of the CAR.
Within three days of a spill incident, the ESRT will issue a report to the Council. The report will
contain the following information at a minimum:
a. Date and time of the incident
b. Estimated spill quantity
c. Cause of the spill
d. Corrective actions taken
e. Clean up activities
Copies of any supporting information, such as police reports, will be attached to the report.
The City of Shakopee will receive a copy of the report as well.
Spare Parts
The following spare parts will be onsite to expedite repairs to the discharge pipe if necessary:
• 3 EA - Repair couplings for each size of discharge line.
