CITY OF SHAKOPEE Memorandum TO: Mayor& City Council Mark McNeill, City Administratar FROM: Bruce Loney, Public Works Director SUBJECT: Approval for Mn/DOT Cooperative Agreement Application for Vierling Drive from CR 69 to Taylor Street DATE: May 15, 2012 INTRODUCTION: Attached is a proposal with WSB & Associates to complete a Cooperative Ageement submittal for the Vierling Drive connection from CR 69 to Taylor Street. BACKGROUND: A portion of Vierling Drive on the west side of town from CR 69 to Taylor Street has not been completed as it is located in Mn/DOT excess right-of-way. Mn/DOT has held this right-of-way for possible interchange purposes of the Trunk Highway 41 interchange in this area. It has been determined that the future Trunk Highway 41 interchange will be further to the west, thus this right-of-way will no longer be needed for a future Trunk Highway 41 interchange. Also, recently Scott County has been successful in obtaining an Interchange Grant for the County Road 69 and 169 intersection and will be proceeding with construction in 2013 and 2014. Staff has reviewed this interchange and this possible Vierling Drive connection with Mn/DOT and they will be supportive in the City applying for a Cooperative Agreement submittal for funding to complete the Vierling Drive connection. The actual program is called "The Metro Municipal Agreement Program" and applications must be submitted by July 31, 2012 for consideration of fiscal year 2014. If the City is successful in receiving funding with this program, then the funds become available July 1, 2013 and the project must be authorized by June 30, 2014. In order to submit an application in a timely fashion, staff will need assistance from a Ciry consultant. Attached to this memorandum is a proposal from WSB to complete the work at a cost not to exceed $4,540. Also if necessary, WSB is available to assist the City with acquisition of right-of-way from Mn/DOT on parcel 43 to complete the roadway work. Finally, the program would allow a maximum award of up to $702,000. Estimates for the project indicate that the cost of the remaining roadway would be much less than $702,000. Thus, this project would be an excellent candidate for the Metro Municipal Agreement Program. ALTERNATIVES: 1. Approve a motion for staff to submit for a Mn/Dot Municipal Agreement Program for the Vierling Drive extension from CR 69 to Taylor Street. 2. Do not approve the staff to proceed with an application for a Metro Municipal Agreement with Mn/DOT. 3. Approve the proposal of WSB & Associates to prepare a Municipal Agreement Program submittal. 4. Do not approve a WSB & Associates proposal. 5. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No. 1 and No. 3., in order to make this collector street connection in conjunction with the Trunk Highway 169 and CR 69 interchange in 2014. The proposed budget for FY 2014 is 4 million dollars. The maximum award available for any individual project is $650,000 for construction plus 8% for construction engineering and inspection for a total of$702,000. This solicitation letter is also posted on the Metro State Aid website at: www.dot.state.mn.us/metro/stateaid/2014pro<,�.html The Municipal Agreement Program provides funding to construction projects that are developed and administered by local agencies and provide a benefit to both the local community and the trunk highway system. These funds are intended to pay for a portion of the construction costs of the project. Right of Way, Utility Relocation, Preliminary Design(including social, environmental and economic impact evaluation) and Final Design costs are not eligible for funding. Metro District's participation in the projects is based on eligibility as determined in MnDOT's Cost Participation Policy. The vision as expressed in Minnesota GO is work from a set of principles to better align the transportation system investments with what Minnesotans expect for their quality of life, economy and natural environment. As such, the Municipal Agreement Program will utilize the following principles to guide its investment decisions. The principles are listed in no particular order, as they are intended to be used collectively. • Leverage public investments to achieve multiple purposes • Ensure accessibility • Build to a maintainable scale • Ensure regional connections • Integrate safety • Emphasize reliable and predictable alternatives • Strategically fix the system • Use partnerships • A focus on lower-cost/high benefit solutions When preparing your submittal request letter please address these categories in describing the benefits of the project. Preliminary discussions with the appropriate MnDOT Area Manager and the Cooperative Agreements Engineer are an essential part of this planning. A timeline/flowchart of the project planning, submittal and selection process can be found on page 17 of the Municipal Agreement Program—Planning and Programming Guide(Red Book). The Guide also includes additional useful information regarding the Municipal Agreement process. It is posted on the Metro State Aid website, Municipal Agreement page: http://ww�v.dot.state.mn.us/metro/stateaicUcooperat.html Project proposals need to be submitted by July 31, 2012 to be considered for the FY 2014 program. Proposals are routed internally at MnDOT for comment and then returned to submitting agencies far modification as applicable prior to selection. It is anticipated that the actual project selection will occur in November of 2012 with the funds becoming available July 1, 2013. Please note that the review by MnDOT functional areas will be different than reviews you have typically experienced with State Aid plans. There will be more need for coardination and input from various MnDOT groups. Ultimately,plans will need to be developed to MnDOT standards which can be different than State Aid standards. Adequate discussion with MnDOT Area Managers or Cooperative Agreements staff will help to minimize surprises during the application and plan development stages. The following items need to be included in the submittal package, please submit 10 coAies of each item and either provide an electronic version of the packa�e or a link to an electronic version. Portable Document Format(.pd� is preferred. This number of copies and the electronic version allows a quicker review by MnDOT functional areas allowing more time for the submitting agency to prepare its final submittal. 1. Request letter from the local agency describing the project and requesting funding from the Municipal Agreement Program. The request letter should include: o Reasons for the project o Proposed costs and requested amount of MnDOT funding o The trunk highway and local roadway benefit(s) o Whether there is an opportunity to advance the work, if it is possible to leverage local and/or private funding, and other information as applicable This letter will be used as a"one page summary"and quick reference during the actual selection process. 2. A geometric layout or concept sketch of the proposed project. The more detailed and complete the layout or sketch is, the easier it will be for the review committee to understand the proposed project and related benefits when it comes to ranking proposals. A MnDOT"staff approved" layout may be required later as part of the project development depending on the type and complexity of project. Work types that require a Level 1 layout ultimately require a preliminary layout in MnDOT format. Layout criteria can be found at http://ciotapp7.dot.state.mn.us;edms/download?docId=636152 . Consideration should be given to starting the layout development and approval process prior to project selection due to the time required for review and approval. This should include the total project cost,the contribution from any partners, and the amount requested from the Municipal Agreement Program. 4. A signed Local Agency Resolution stating that the local agency is requesting funding from MnDOT through the Municipal Agreement Program and if funding is provided,the local agency will complete the project. This document must include the appropriate signatures, seals etc. 5. Supporting Documentation and Additional Materials, such as the following. While these materials are not required, they may help the selection committee understand your project better and increase the likelihood of project selection. a. Traffic Study(as applicable) b. Approved Intersection Control Evaluation(ICE) (if an all-way stop, signal or roundabout is proposed) c. Environmental studies or documentation available such as the following: i. Contaminated Properties/Regulated Waste Screening Checklist ii. Phase 1 and/ar 2 Environmental Site Assessment iii. Clearance Letters from pertinent Regulatory Agencies iv. Project Memo, EA, EIS, etc. as applicable or available at time of submittal d. Compliance with Metropolitan Council Transportation Policy Plan(TPP), MnDOT/Metro Highway Investment Plan(HIP) or Local Comprehensive Plans as applicable, indicating how the proposal supports community development. (WSB) is pleased to submit this proposal for professional engineering services to complete the Metro Municipal Agreement Program Application for Fiscal Year(FY) 2014 for the proposed extension of Vierling Drive approximately '/� mile to connect with CR 69. The City is planning on completing the last 800 feet of Vierling Drive to connect with CR 69. The project will be coordinated with the County's planned new interchange at CR 69 and TH 169 in 2014. MnDOT supports the application and MnDOT views this connection as a way to local trips on TH 169 by completing this local parallel route along TH 169. Based on the FY 2014 solicitation letter, the Municipal Agreement Program Application consists of: a letter describing the project and documenting the project's relationship to MnDOT's four investment categories (support community development, improve safety, improve mobility, and maintaining existing infrastructure), cost estimate, summary sheet, geometric layout, signed Local Agency Resolution stating that the local agency will complete the project if Municipal Agreement Program funding is provided, and a one-page summary of the project benefits and cost. The initial submittal information is due to the cooperative agreement office by July 31, 2012. The initial submittal will be reviewed by MnDOT's functional groups and cooperative agreement office. MnDOT will prepare a comment letter based their initial review. WSB will address each of the comments and prepare a response letter to each of the comments received. A revised submittal packet will then be prepared with the MnDOT comments' addressed. The revised submittal packet is usually due around the beginning of November. WSB will review the cost estimate to calculate the cost of the roadway section that would be eligible for the cooperative agreement funding.
