CITY OF SHAKOPEE �� M , ; , ,�<a Memorandum � � �� � � �.�, m �� � �" � �?�� � .F TO: Mayor& City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Consider Awarding a Contract for the Main Street Utility Improvements, Project No. 2012-5 DATE: May 15, 2012 INTRODUCTION: Attached is Resolution No. 7198, which accepts the bids and awards a contract for the Main Street Utility Improvements, Project No. 2012-5. BACKGROUND: On March 20, 2012, City Council adopted Resolution No. 7177, which approved the plans and specifications and authorized staff to advertise for bids for the Main Street Utility Improvements, Project No. 2012-5. On May 9, 2012, a bid opening was held for the Main Street Utility�Improvements, in which there were two bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Finnila Excavating with a bid of$124,304.65. After the bid opening the low bidder realized he made a mistake calculating his bid and has withdrawn his bid and has requested that his bid bond be returned. Staff believes it is in the best interest of all parties involved to return the bid bond to Finnila Excavating Inc. and award a contract to Chard Tiling & Excavating, Inc. in the amount of$153,835.31. Chard Tiling & Excavating Inc. has completed many successful projects in the City and is currently working on the C.R. 69 Improvements. The Engineer's estimate for this project was $150,000.00. Capital Improvement Plan included a project cost estimate of$250,000.00. Adding a 5% contingency to the actual low bid and 30% indirect costs, the projected project cost is approximately $210,000.00, which is below the budgeted project cost. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. ALTERNATIVES: 1. Accept the bid of Chard Tiling & Excavating, Inc. and adopt Resolution No. 7198. 2. Reject all bids and rebid. 3. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 4. Table far additional information. RECOMMENDATION: Staff recommends Alternative No. 1 and No. 3 in order for this project to commence. ACTION REQUESTED: 1. Offer Resolution No. 7198, A Resolution Accepting Bids on the Main Street Utility Improvements, Project No. 2012-5 and move its adoption. 2. WHEREAS, it appears that Chard Tiling & Excavating, Inc., 26239 State Hwy 25, Belle Plaine, MN 56011 is the lowest responsible bidder for the Main Street Utility Improvements Proj ect. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Chard Tiling & Excavating, Inc. in the name of the City of Shakopee for the Main Street Utility Improvements Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposit of the successful bidder shall be retained until a contract has been signed.
