No. 7189 l..1/ : CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Public Hearing for the Valley View Road Improvements Project, Project No. 2012-7. DATE: April 17, 2012 INTRODUCTION: As per Resolution No. 7078, a resolution receiving a report and calling for a public hearing on the Valley View Road Improvements Project, Project No. 2012-7, a public hearing is scheduled for April 17� This agenda item is to conduct the public hearing for the proposed improvements associated with the Valley View Road Improvements Project. This is a Council initiated project that requires a supermajority vote to move forward. BACKGROUND: On October 4, 2011, the City Council ordered the preparation of a preliminary engineering report for the Valley View Road Improvements Project. The report was completed and accepted by City Council on March 20, 2012. This proposed project includes constructing Valley View Road improvements from Evergeen Lane to Sarazin Street. The Valley View Road extension from Evergreen Lane to Sarazin Street has been contemplated since 2000. On October, 2000 a traffic study was done by WSB & Associates, Inc. to determine a future alignment of Valley View Road from CR 79 to CSAH 83. Neighborhood meetings were held with affected property owners and from these meetings, a preferred alternative was selected and is attached. From this alternative selection, the City and County entered into the attached memo of understanding (MOU). This MOU outlined the understanding of the future of Valley View Road construction with CSAH 17 and when that construction would be done. Also, the future construction of CSAH 17 with St. Francis Avenue was discussed as well. This MOU was approved on April 3, 2001. Also, as part of this study and City/County ageement, an agreement with St. Francis Regional Medical Center (SFRMC) and Betaseed was entered into for the alignment of Valley View Road from CSAH 17 to Sarazin Street. This agreement was essentially to have an equal land contribution and land swap between the two properties after Valley View Road is built. Attached is a drawing showing this concept for their agreement labeled "Concept Plan for Betaseed". In 2008, the County initiated a CH 17/TH13 Corridor Study from TH 169 to TH19. This study reviewed the growth of Scott County and its effect on CH 17 and what is the future road classification of CH 17. From this study, CH 17 is projected to be a principal arterial which is the highest classification of roadways per MnDOT. For instance, TH 169 is a principle arterial serving much of southeast Minnesota. This study was approved by the City Council by the attached Resolution No. 6891 on April 7, 2009. During the preparation of this study, a traffic issue surfaced with the residents east of Sarazin Street and with the construction of Valley View Road to Mooers Avenue. Many of the residents were not at the 2000 neighborhood meetings when this preferred alternative was selected. The concern of the neighborhood was the increase traffic into a relatively quiet street when Valley View Road is constructed. A traffic study was done by WSB & Associates, Inc. on alternatives to the Valley View Road connection to Sarazin Street and input to traffic to the neighborhood. The conclusion was to have a one way street westbound on Mooers Avenue from Sarazin Street to Hazen Street. Council approved the recommendation on October 21, 2008, and the action will be incorporated into the final design of the Valley View Road project. In 2011, Scott County made the decision to move ahead with the four laning of CSAH 17 from St. Francis Avenue to '/ mile south of CH 78. With the project moving into design and a projected construction in 2013, Council approved a preliminary report for Valley View Road from Evergreen Lane to Sarazin Street. Staff will make a presentation of the report at the public hearing meeting the project and associated costs. The report discusses Valley View Road in two segments as the west leg from CSAH 17 and the east leg from CSAH 17. Reason for this separating as it was unclear on whether Betaseed would support the west leg at the time of writing the report. Since the acceptance of the report, Betaseed has met with staff and county staff to discuss options of their access and is now accepting of the project with certain conditions. ISSUES: East LeQ f�'om CH 17 to Sarazin St. 1) The alignment and design of Valley View Road should be such to balance the right of way from each property owner as much as possible. Staff will work with Betaseed and the Hospital on a balanced alignment during final design. 2) Road construction from St. Francis Avenue to Valley View Rd. needs to be done to restare the new connection to the Hospital. The County has indicated that they will build this connection with the closing of St. Francis Avenue from CH 17. This road connection should be a private road per staff similar to road entrances into St. Francis's complex now. Attached is a letter of support from Mike Baumgartner, President of St. Francis Regional Hospital with conditions on the proj ect. 3) City Participation of this leg is for the oversizing of the road, storm sewer and SPUC trunk water oversizing. 4) It is proposed that the right of way for this roadway will be dedicated to the City by the hospital and Betaseed. West LeQ from CH 17 to EverQreen Lane 1) High assessments to Betaseed, Hayostak & Thomson parcels. The Betaseed parcel could see the benefit of Valley View Road, when and if they develop. Betaseed as first was not for the road project, however, they do want their business connection to Valley View Road and ultimately to CH 17 and a traffic control signal. A letter from Kurt Wickstrom, President of Betaseed, Inc. is attached in which Betaseed is willing to support the improvement with conditions. The Hayosteck & Thomson parcels have high assessments and staff has concern on whether the assessments could be sustained in court. Staff would recommend a benefit appraisal be done for these parcels to determine the value to the properties. A benefit appraisal per parcel is estimated to be $5,000-$6,000. Staff would also recommend an assessment agreement be considered for these parcels depending on the benefit appraisal results. 2) Betaseed's future street layout to Valley View Road is one of the conditions of support for Betaseed. Staff will discuss the conditions further at the public hearing. The main concern is whether to give approval of street connections without going through the platting process of approval. 3) Relocation of driveways far CH 17 to Valley View Road is being proposed as part of the CH 17 project. The County is willing to relocate driveways from CH 17 to Valley View Road as part of the access management plan for the CH 17 project and corridor. Final driveway locations will be determined during design. PROJECT COSTS: The total estimated project cost for the Valley View Road Improvement Project is $1,830,297.10. A summary of the estimated construction costs plus a 5% contingency, engineering and administration costs for the project are as follows: East side of CSAH 17 West side of CSAH 17 Street Improvements $ 515,983.00 $ 351,432.75 Storm Sewer Improvements $ 216,625.50 $ 141,550.50 Sanitary Sewer Improvements $ 49,959.00 $ 52,033.80 Watermain Improvements $ 144,007.50 $ ll2,162.05 TrailImprovements $ 38,220.00 $ 28,323.00 Right-of-way $ 0 $ 180,000.00 TOTAL PROJECT COST $ 964,795.00 $ 865,502.10 The Project is proposed to be funded as follows: East side of CSAH 17 West side of CSAH 17 Assessments $ 541,099.00 $ 559,653.60 State Aid $ 260,988.00 $ 195,829.50 Storm Sewer Fund $ 122,440.50 $ 78,214.50 Shakopee Public Utilities $ 40,267.50 $ 31,804.50 TOTAL PROJECT COST $ 964,795.00 $ 865,502.10 The city's cost total is for $456,817.50 from the State Aid Funds and $200,655.00 from the Surface Water Drainage fund. ALTERNATIVES: 1. Adopt Resolution No. 7189, a resolution ordering the improvement and the preparation of plans and specifications for the Valley View Road Improvements Project, Project No. 2012-7. 2. Deny Resolution No. 7189. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Authorize staff to obtain benefit appraisals for the project. 4. Table Resolution No. 7189, to allow time far staff to prepare additional information. RECOMMENDATION: If sufficient support is received from the property owners and due to the pending CSAH 17 project in 2013, staff would recommend proceeding with the project. Alternative No. 1 and Alternative No. 3 is recommended, to proceed with the project and benefit appraisals. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: Valley View Road Improvement Project and all appurtenant wark. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2012-7 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution. WHEREAS, the City has prepared a traffic st�.idy for the Valley View Road area between CR 79 and CSAH 83, dated October 5, 2000; and WH�REAS, the traffic study reviewed several alternatives for access to CSAH 17 from the new east-west collector road; and WHEREAS, the City and County have had public meetings with the residents and businesses adjacent to GSAH 17 and Vatley View Road; and WHEREAS, the City and County have ab eed that the alignment extending the new east-west collector road along the Betaseed/hospita] property line wouid provide the hest operational characteristics for CS�1H 17 and the new colleetor road; and WHEREAS, the City and County have ab eed that the construction of this east-west collector will be completed in two phases. The first phase to include the extension of existing Valley View Rcad curv:ng north along the Sarazin Street alib ment as currentty being developed by the City. The second phase would be the e�tension of the east-west coilector road along the Betaseed/hospital property line to a point approximately 500 feet south of St. Francis Avenue; as shown on the attached drawings, and �VHEREAS, the City and County desire to document their respective understandings regarding certain aspects of the proposed alignment, and the timing of the access to CS:AH 17. NOW, THEREFORE, IT IS HERBY UNDERSTOOD THAT: • 1. East-West Collector Street The East-West Collector Street from Sarazin Street to CSAI-I 17 will be constructed at such time that one or more of the foIlowing occur: A. Development of the Betaseed property or the St. Francis Hospital property east of CSAH I7. B. Development of property in the area on the west side of CSAH 17 requires additional access to CSAH 17, or requires a change in the exis2ing access serving Betaseed. C. The City and County agree that traffic cdnditions indicate a safety problem exists or is imminent at the CSAH 17 and St. Francis intersection, or they agree on the need for possible changes in traffic control at St. Francis Avenue. Such problems may be apparent tl excessive delays to Si. Francis Avenue tratfc at CSAH 17 or . through crash problems at the intersection. 2. St. Francis at CSAH 17: The St. Francis Avenue at CSAH 17 intersection will be studied in detail once the new intersection of the east-west collector sireet and CSAH 17 is planned for construction. This will potentially include restricting this interseetion to 3 /a access or to a right-in/right-out only. CSAH 17 at Existin�y View Road: The existing intersection of Valley View Road and CSAH 17 will be cIosed as part of the consfizction of the new east-west collector street, and traffic will be redirected to the collector street. This wilI be 100% City cost to close this access. Such work shall be included in the access permit application requested by the City of the County as part of the new coliector street connection (See #6). 4. Jurisdiction The City and County aeknowledge that, as the jurisdictional authority for CSAH 17, the County retains the right to make any and aIl determinations on traffic controls along the CSAH 17 corridor. 5. Development of Plans and Specifications The City will be responsible for development of all pians and specificaiions for the east-west collector road extension to CSAH 17. The County will review and approve such pians. 6. Permits The Ciry will request a County access permit for a street connection to CSAH 17. The County will be responsible for review and approval of the permit application. Mr. Lon y discussed the Memorandum of Understanding (MOi� between the City of Shakopee and Sco County. The MOU essentially agreed to relocate the existing Valley View Road connecti n to CSAH 17 to a location further north and would line up with Mooers Avenue street connecti n at Sarazin Street. The alignment configuration was also agreed upon by Betaseed and St. ancis Regional Medical Center who would be affected by this connection. Mr. Lon y stated that at an open house on the C.R. 17 Corridor Study several residents raised a concern f the increased traffic to Mooers Avenue. Staff had WSB & Associates perform a traffic s dy to analyze the traffic impacts to the neighborhoods. Chuck Richart of WSB presente Council with the results of the study. Mr. Lon y said that based on the study various alternatives were suggested. One alternative is to close M oers Ave., connecting Mooers Avenue to a one-way westbound realignment of Valley View R ad as an offset so direct connection was not made at Mooers Ave. Mr. Loney said after present' g the altematives to area residence, staff is recommending the one-way alternative as a westbo d one-way. John He ke1, 1863 Mooers Avenue, who is the spokes person for the Mooers Avenue residence. Mr. Hec el wanted to thank City staff and the County for listening to the neighborhood concern . Joos/Le an moved to accept the Mooers Avenue Updated Traffic Study and its recomm ndations, noting the Mooers Avenue one-way alternative is a westbound one-way. Discussi n followed. Cncl. Le an asked if Hazen Street was part of the alternative. Mr. Loney said that the recomm ndation for the one-way is from Sarizan St. to Hazen St. on Mooers Avenue. Mayor S hmitt asked for a vote on the motion. Motion carried 5-0. Mr. Lon y presented Council with the Authorization of Additional Traffic Control Signage for 10�' Ave ue from Spencer Street to Fuller Street. Mr. Lon y stated that he met with Chris Lindholm, Principal at the Sha.kopee Jr. High, Mike Burlage of the School District and Sgt. Lynn Lipinski and Officer Chris Christy of the Shakopee Police D pariment to discuss safe pedestrian crossings and vehicle movements into the Jr. High. Mr. Lon y said it was concluded from the meeting that the following procedures be put in place: • school speed zone be established at l O Avenue, from Spencer Street to Fuller Street d installed by the City. • hree portable In Street Pedestrian Crossing Signs be purchased by the School District d placed in the middle of the street in the morning and removed after the students are �smissed in the afternoon for Sommerville St., Lewis Street and Holmes Street rosswallcs. RESOLUTION NO. 6891 A l�esolution of the City of Shakopee Approving the Study of County Highway 17 and Trunk Highway 13 Corridors Whieh Inctudes a Long Term Vision for the Corridor to be a Principal Arterial from U.S.169 to the Southern Boundary of Scott County WHEREAS, Scott County Association for Leadership and Eff ciency (SCALE) has made a county wide effort to educate communities on the importance of a transportation system to support and sustain economic development in the county; and WHEREAS, SCALE has focused its community outreach efforts to address the importance of balancing the interface between land use and transportation along highways in the County and has emphasized the need for both mobility corridors and Iand access corridors in the county to sustain the future growth; and WHEREAS, the City as a member of SCALE wishes to support north south mobility in the county and the need to have principal arterial spacing, generally every 3 miles, to properly support the development of the urbanizing areas in the City and County; and WHEREAS, the County had originally identified the County Highway 21 Corridar as the north south principal arterial in this area in the Scott County Transportation Plan 2000 — 2020; and WHEREAS, when the County and Cities reviewed the 2030 Scott County Transportation Plan, they evaluated the connectivity of County Highway 21, it became apparent that the corridor would not serve the mobility function needed for the regional Highway System in this area due to the lack af a supporting road system and the existing development patterns of the communities of Shakopee and Prior Lake; and WHEREAS, the Cities of Shakopee and Prior Lake, Townships of Cedar Lake and Spring Lake, and the Minnesota Department of Transportation have jointly participated in this multi jurisdictional corridor study of County Highway 17 and State Trunk Highway 13 to develop a long term vision for the corridor, identified the local raadway system components necessary to support the corridor vision and developed preliminary recommendations to serve as guidance for fizture project development; and WHEI�EEAS, among other things the conidor study recommends that County Highway 17 from TH169 to the south and State TH 13 from State TH 19 to State TH 282 serve as the north south principal arterial corridor in this area; and WHEREAS, in the 2030 Transportation Plan the County has identified Cotzrzty Highway 17 from TH 169 to the south as a future principal arterial roadway and recommended County Highway 17 narth of State Trunk Highway 169 remain as a minor arterial roadway; and WHEREAS, the City acknowledges tha� vision and commits ta working with the County in supporting that vision in its development and redevelopment activities adjacent to the County Highway 17 corridor; and WHEREAS, the City and County wish to work toge#her to preserve the mobility function of County Highway 17 south of TH 1b9; and WHEREAS, the City and County understand the importance the supporting road network and access spacing plays in supporting the operations and function of a principai arterial roadway; and WHEREAS, the County recognizes that the City does not have complete jurisdiction over properties needed to develop the supporting road neri��ork for the Couiaty Highway 17 vision; and WHEREAS, the City and County recognize further, more detailed, s�udy will be needed during the detailed design process to address current access spacing deficiencies in the corridor which are inconsistent with the County Highway 17 principal arterial vision south of TH 169; and WHEREAS, this revised future funetional class system vision has required the County and City to jointly review the access spacing allowed on both Caunty Highway 17 and County Highway 2I; and WHEREA�, the City acknowledges the County's authority to permit, modify or clos� access to a County Highway in the future. NOW, TH�REFORE, BE IT RESOLVED BY THE CIT�' COtiNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The City and County agree that the long term function of County Highway 17 south of TH169 is a principal arterial where the primary focus on the road is to support mobility with appropriate access to the local roadway system and land uses. 2. The City and County agree that preserving the County Highway 17 corridor south of TH 169 as a principal arterial enables the County High��ay 21 corridor to be managed as a minor arterial corridor with access spacinD consistent with that function. 3. The County and City accept the design concept contained in the Study for the segment of County Highway 17 between St. Francis Ave to County Highway 42, recognizing there are a number of issues (e.g. access and right-of-way configuration) that need to be resoived through the actual design process. The City and Caunty are committed to working together to resolve issues as the design process praceeds forward. 4. The County and City are committed to working together to develop an expansion project in 2414 involving a11 or a portion of this segment (Segment C) from St Francis to County Highway 42. 5. The County will apply for regiona� Federal funds on the Segment C project as part of the 2009 regional solicitation from the Transportation Advisory Board. 6. The County will proceed with appropriate project development and environmental review for the segment C �roject. 7. The City and County should work together to further study County Highway I7 at the intersections w7th County Highway 42, County Nighway 78 and Valley View Road to determine the appropriate full intersection control. 8. The City and County should continue to expiore opportunities for a park and ride on the west side of County Highway 17 in the vicinity of the Valley View intersection. 9. The City and Coun�y should continue to work on developing alternate routes of access to those neighborhoods that are currently served by only one outlet. 10. The City and County will continue to plan and work cooperatively to develop a supporting road system consistent with the vision of the corridor. 11. The City, when opportunities arise tbrough the development process, supports the re�noval of private accesses from County Highway 17. 12. The City and County will work together with property owners to find cost effective solutions for removing existi�g private accesses from County Highway 17. 13. The City and County will continue to work together on the segment of County Highway 17 north of State Hzghway 169 to examine solutions and find ways to improve operations and safety of the corridor to support its minor arterial function through additional detailed traffic analysis and examination of design aiternatives. Betaseed understands the need to develop Valley View Road. We sincerely appreciate the efforts of you, leffrey Weyandt and others representing the City of Shakopee for being transparent, and providing us an opportunity to provide input on the impact of the developments to Betaseed. Since establishing our Shakopee facilities in 1980, Betaseed has worked co-operatively with the City of Shakopee to develop infrastructure necessary for the continued future growth of the City, while at the same time, continuing our significant research and development activities in the area. As you are aware, the land that is owned by Betaseed is extremely valuable to the entire sugar beet industry in the US and abroad. The past decades have been dedicated to developing research land that is very uniform, has highly desirable characteristics and generates scientifically reliable data for the development of sugar beet hybrids that are sold globally. The land is in fact, the most highly desirable research land for testing resistance to a soil-born sugar beet disease called Aphanomyces. Betaseed tests our hybrids, and hybrids for other sugar beet seed companies to confirm the hybrids are resistant to this disease and therefore eliminate the potential devastating yield losses for sugar beet farmers, estimated at more than $1.5 billion USD. While we have attempted to find other research land to develop the same characteristics for many years to test for resistance to Aphanomyces, neither Betaseed nor others in the sugar beet industry have been successful in doing so. Our facilities at 1788 Marschall Road are not only a key research and breeding station for Betaseed, but also our North American corporate office with more than 30 full and part-time employees. As our business continues to grow, and we hire additional people to meet the increased workload, it is our desire to continue our research operations and potentially maintain our corporate presence in the City of Shakopee as well. As a responsible corporate citizen, it is Betaseeds intent to support in principle the improvements identified in the March 2012 Preliminary Engineering Report, Valley View Road, Street Improvements and Appurtenant Work, east of CSAH 17 with the following condition: • Betaseed requires access to land owned and identified as Betaseed 27-9180093 in Drawing 1 in Appendix of March 2012 Preliminary Engineering Report, Valley View Road, Street Improvements and Appurtenant Work, and the access points are agreed upon by both City of Shakopee and Betaseed, cleariy marked and identified in future engineered drawings and the cost of the access points are the responsibility of the City of Shakopee • Please confirm the plans for old Valley View Road (at the south end of Betaseed property 27- 9180093) and ensure that Betaseed will continue to have access to all research properties owned by Betaseed via new Valley View Road or old Valley View Road during the development of the project for our on-going field research activities • To ensure our research and breeding efforts are not disrupted due to lack of water for irrigating, we would like commitment from the City of Shakopee that the replacement of the Irrigation water line currently under CSAH 17 from Betaseed corporate office to research land south of St. Francis Regional Medical Center be done so expediently and at a mutually agreed upon time between the City of Shakopee and Betaseed • Final engineered drawings for the improvements west of CSAH-17 will incorporate the Betaseed Concept Plan from 2000 by James R Hill Inc. to align sanitary sewer and other improvements with the lot layout from the aforementioned Concept Plan Betaseed also supports improvements west of CSAH 17 as identified in the March 2012 Preliminary Engineering Report, Valley View Road, Street Improvements and Appurtenant Work, with the same accessibility condition as listed above for the east improvement, and at the time the City of Shakopee determines the development is necessary. Holmes Street Shakopee, MN 55379 Dear Mayar Tabke and City Commissioners: St. Francis Regional Medical Center is pleased to support the improvements that are being considered for Valley View Road west of CSAH 17 that are occurring as part of the 2013 proj ect. St. Francis does have certain requests that go along with our support. 1. Support and recommendation to SPUC to place underground the overhead power lines on the both the east and west side CSAH 17. This would improve public and patient safety for our helipad. 2. A right-turn lane off north-bound CSAH 17 to allow emergency vehicles easy and safe access to our Level III trauma center. 3. A stop light at the intersection of Valley View Road and CSAH 17. 4. The renaming of a portion Valley View to St. Francis Avenue. 5. City of Shakopee to maintain the current St. Francis Avenue until such time as it is vacated. 6. Maintaining access during construction for our patients, visitors and employees. 7.
