Comment:
Introduction:
The Council is asked to release a developer's agreement for the Burmahi land proposed
for donation to the City.
The City Council is also being advised of a potential additional development cost relating
to this property.
Background:
Since November, the City has been working with Burmahi Corparation, regarding the
possible donation of 3.25 acres of land which comprises three parcels of land located on
First Avenue, west of Valley Haven Mobile Home Park.
The Council has previously given direction for closing work to take place. As part of that,
it was discovered that there is a developer's agreement which was signed Sept. 29, 1980,
between Burmahi, Halo Development Inc., and other parties. It describes obligations
relating to normal development—utility installation schedules, payment of fees, etc.
As that development didn't transpire, the City Attorney advises that the developer's
agreement may now be released.
However, the discovery of the agreement did generate other discussions with Shakopee
Public Utilities. In 1981, there was a memo sent from then-SPUC manager Lou Van
Hout, to the City Clerk, asking that the developer's agreement not be released by the City
until a"looping" of the water main could take place. That connection would run across
the back of the lots from the water line's terminus just east of Marschall Road near Bluff
Avenue, to extend south and east to First Avenue.
While the transfer of title by a donation or any other means would not trigger the need for
the looping, the City and any future developer should be aware that SPUC will likely
require that that connection be made at that time.
No engineering studies have taken place, but rough estimates indicate that approximately
$100,000 to $200,000 might be needed to complete this looping. However, if no use
necessitating water is contemplated for the lots, the looping would not be required. An
example might be that of the original discussion of a trail head for snowmobiles, or a
park site.

It has been intended that the 3.25 acres would be used as an economic development
incentive. That could still take place; however, again, any prospective developer would
need to be aware of the water looping requirement, which may reduce the attractiveness
of this for economic development.
Fiscal Impact:
There is no direct cost as a result of releasing the developer's agreement.
In late February, the Council was notified that these parcels generated $17,088 in
property taxes for the 2011 tax year. After the donation is made, the City will be
responsible for the remaining pro-rated share of property taxes--$1424 per month, until
such time as the land becomes tax exempt. Assuming the land transfer is completed by
June 30, 2012, the property will become tax-exempt on January 1, 2013.
Recommendation:
I recommend that the Council approve the release of the developer's agreement.
Relationship to Visioning:
This supports Goal B—Positively manage the challenges and opportunities presented by
growth, development and change.
Action Required:
If the Council concurs, it should, by motion, authorize the release of the developer's
agreement dated September 29, 1980, by and between the City of Shakopee, and Halo
Development, Inc; Burmahi, Inc.; Halo Investment; and Shakopee Countryside
Recreation Center Associates, relating to 3.25 acres of land currently owned by the
Burmahi Corporation.
