CITY OF SHAKOPEE � �, � �, � Memorandum � � � � � i;����� TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Request of Chard Tiling and Excavating Inc. for Extending Work Hours on C.R. 69 Project DATE: April 17, 2012 INTRODUCTION: Chard Tiling and Excavating Inc., the contractor for the C.R. 69 Reconstruction Project, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. BACKGROUND: The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Chard Tiling and Excavating, Inc. is requesting a suspension on the hours to allow for work on Saturdays, to start at 7:00 A.M. from 8:00 A.M., for the project duration in 2012; and to allow the Contractor from April 20 to May 2" to work 24 hours a day to rehabilitate the Railroad Bridge over CSAH 69. This request is being made to help expedite the work and meet the schedule for the C.R. 69 Project and to restore service to Rahr Malting as soon as possible. Staff would recommend that if the suspension of hours is ganted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. RECOMMENDATION: Staff recommends Alternative No. 1. As you now this project has some time constrains attached to it that we feel may need extended hours to complete, therefore 1 would like to ask for a couple differing working hour estensions. o The first addresses the reconditioning of the rail road bridges that cross CSAH 69. Rahr Malting has hired Edward Kreamer and Sons to complete the upper portion of the bridge which Rahr actually owns. And at the same time they are doing that we will have a subcontractor doing the reconditioning of the steel structure itself. Needless to say this will take a lot of time for both contractors and will need to happen within the constraints of the road closure which is scheduled to happen from the 20` of Apr to the 2" of May. Attached you will find a letter from our subcontractor spelling out the specifics of their schedule, but I would request that we have the ability to run 24 hours a day during the road closure, so if the weather comes into play we still have the ability to continue working around the clock. o The second request is that we would have the ability to start work at 7:OOam on the Saturdays that fall outside the road closure. I would appreciate it if you could present this to council and that they would indicate which if not all the above items are acceptable to them. Rainbow will be working in eonjunction with the railroads contractor to complete abrasive blasting and painting of the entire Bridge #6885. Rainbow will ha�e a schedule as faliows, Aprii 20`�', 21st and 2�" we wilf be working single shifts with working hours of 7:�0 arn to 7:00 pm. Beginning on Monday the 23 of April we will be running two 12 hour shifts round the ciock until Thursday the 26 Friday ihe 27`" of April we will run a single 12 hour shift and turn the bridge o�er to the railroads contractor to complete the remainder of the bridge rehab items. In �losing working this type of schedule will allow Rainbaw, the railroads contractor and Scott County to compfete this rehat�ilitation in a timely, safe and quality conscious rnanner. The extended hours are being requested as a contingency if work items take longer than anticipated or if inclement weather delays our progress. Our priority is to complete bridge wark in conjunction with the painting contractor in the time allotted by Rahr Malting. Please feel free to give me a call with any questions/comments.
