DISCUSSIOn:
OPUS has submitted an application for vacation of easement on a portion of its property located
south of 4�' Avenue and west of CSAH 83. Please see E�ibit A for site location. Attached as
E�ibit B is a depiction of the easement proposed for vacation.
Staff is continuing to conduct research on the proposed easement vacation. The additional
infonnation being researched by staff is technical in nature relatina to the storm sewer service.
Because this item is scheduled as a public hearing, staff will have additional informarion on the
table for Couneil's consideration.

DISCUSSION & STAFF RECOMMENDATION
OPUS has submitted an application for vacation of easement on a portion of its property located
south of 4�` Avenue and west of CSAH 83. Please see E�ibit A for site location. Attached as
E�ibit B is a depiction of the easement proposed for vacation.
The submitted survey identifies the easement proposed for vacation as Document No. A521800
(attached as Ea�hibit C). Upon further review of said document, the easement was granted by OPUS
to OIRE. The City is not named as hauing been granted any rights as a part of the easement. The
storm sewer that exists on the site is a private service.
Because the City was not granted any rights as a part of the easement, there is no public interest
to vacate. Staff recommends that the public hearing be opened and closed and that no formal
action be taken.
ACTTON REOUESTED
Open and close the public hearing without taking no formal action on the vacation application.

THIS GRANT OF EASEMENT ("GranY') is made as of this i day of 7une, 2000, by
Opus Northwest, L.L.C., a Delawaze limited liability company (hereinafter referred to as
"Grantor") to and for the beneft of OIRE National Minnesota, L.L.C.,a Delaware limited
liabiliry company (herei�after referred to as "Grantee").
RECITALS AND PRELIMINARY STATEMENT OF FACTS:
1. Grantor is the owner of that certain parcel of real estate located in the City of
Shakopee, County of Scott, State of Minnesota, legally described as Lot 2, Block 1, OPUS MVW
("Lot 2"); and
Z. Grantee is the owner of certain propeny abutting Lot 2 legally described as Lot 1,
Block l, �PUS MVW ("Lot 1"); and
3. Grantor intends to create an easement for storm sewer purposes over and across that
portion of Lo[ 2 legally described on Exhibit "A" and depicted on Exhibit "B" for the benefit of Lot
1 (the "Easement Area").
NOW, THEREFORE, in consideration of the mutual covenants and agreements herein
contained, Grantor hereby agrees:
COVENANTS:
1. Easement
1.1 Grantor hereby creates and conveys to Grantee, as the owner of L,ot 1, a
permanent, non-exclusive easement (lhe "Easement") for storm sewer purposes over and
across the Eaeement Area.
2• General.
2.1 The terms, easement and provisions hereof shall inure to the benefit of and
be binding upon the heirs, lega[ representatives, successors and assigns of the parties hereto.
The Easement shall be appurtenant to Lot 1 and mn with the title to Lots I and 2.
2.2 This Grant may only be modified or amended, in whote or in part, with the
consent of each of the parties hereto, by declazation in writing, executed and acknowledged
by each of said pacties.

23 Nothing contained in this Grant shall be deemed or construed by ffie parties
hereto, or aoy of them, or any other person to create Ihe relationship of a principal and
agent, or partnership, or joint venture, or of any association between any of the parties
hereto.

Minnesota.

LEGAL DESCRIPTION
PROPOSED DRAINAGE AND UTILITY EASEMENT
A 20.00 foot easement over, under and across L.ot 2, Block 1, OPUS MV W, according to
the recorded plat thereof, 5cott County, Minnesota. Said 20.00 foot easement lies 20.00
feet northerly of and adjoining a line described as beginning at the southwest comer of
Lot 1, said Block 1; thence on an assumed bearing of South 89 degrees 49 minutes 19
seconds West, along the westerly extension of the south line of said Lot 1, a distance of
729.50 feet to a point hereinafter refened to as Point "A" and said Iine there terminating.
Together with an easement over, under and across said I,ot Z which lies 3D.00 feet
westerly of and adjoining a]ine described as commencing at Point "A" described above;
thence North 0 degrees 10 minutes 41 seconds West a distance of 578.06 feet to the north
line of said Lot 2 and the point of beginning of the line to be described; thence South 0
