DISCUSSION
Ry�an Companies has submitted an application for fnal plat approval ofDean Lakes
Eighth Addition. The plat proposes the combination of four lots into one lot. In addition,
an outlot is proposed to cover that area which has been designated as a conservation
easement area. The subject property is located south of Highway 169 and north and east
of Dcan Lakes Blvd. Please see E�ibit A for location. The subject property is
approximately 28 acres in size.
The applicant is proposing that tbese parcels be combined to accommodate the
construction of a corporate headquarters and manufacturing facility. The faeility is
proposed to be approximately 120,000 square feet in size.
The parcel involved in this plat has been previously platted in other phases of the Dean
Lakes Development. Because of these previous platting activities, many of the typical
actions associated with platting have already been addressed. For instance, park
dedication fees have been satisfied and the majority of public improvements have been
installed.
There are existin� special assessments for the subject site. The drafr conditions of
approval allow the applieant the option of either paying the outstanding balance of these
assessments with the recording of the final plat or requesting that the asscssments be
reapportioned to the proposed lot to be created with this new plat.
Scott County Environmental Health has commented that a hazardous waste license may
be necessary far the proposed use. The applicant should consult with Scott Counry
Environmental Health on this issue.

A RESOLUTIOl� OF THE CITY OF SHAKOPEE, NIIN'_VESOTA APPROVING
THE F1NAL PLAT OF DEAN LAl�ES EIGHTH ADDTI'ION
WHEREAS, Bndvewater LLC, applicant and Ryan Companies, property owner,
have made application for final plat approval of Dean Iakes Eighth Addition; and
WfiEREAS, the subject property is legally deseribed as:
Lots 4, i, 6, and ?, Dean Lakes 5` Addition, Scott County, Minnesota; and
WHEItEAS, the City Council reviewed the final plat on February 21, 2012.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the final plat of Dean Lalces Ei�hth Addirion is hereby
approved subject to the following conditions:
1) The following procedural acfions must be completed priar to the recording of
the Final Plat:
a) Approval of title by the City AttomeS�.
b) The applicant needs to provide a minimmn of fifty (50) feet of drainage and utiliiy
easement and/or access easement alons the west property Iine.
c) All public watermain shall be within a 20 foot minimum width eascment.
d) Execution of a Developer's A�eement, which needs to inelude provisions for
secunty for public improvements within the Final Plan and the engineering
raview fees.
e) Payments of Trunk Storm Water Charges need to be made, as required by the
most current City of 5hakopee Fee Schedule.
fl Provide electronic files (.Auto CAD and Adobe Acrobat formats of the Fina1 Plat
to be recorded with datum on the Scott County coordinate system_
g) If the applieant wishes to reapportion the existing special assessments, such
request shall be provided in writin; to the City along with payment of the fee
associated with the reapportionment. If the applicant does not submit said
request, the payment of the special assessmenYs in full sha11 be made prior to the
recording of the final plat.
2) The foIIowing items need to be addressed/completed prior to approval of a
gradinn permit and/or a street and utilitp p[an:
a) No public improvements (site �; ading and s�eet and utility) will be construeted
until the City Engineer and the Shakopee Public Utilities Commission (SPLJC)
approves the requir�d Final Construction Plans and Specifications.
b) The applicant needs to obtain a NPDES permit prior to any land disturbina
activity. A copy of this permit will be provided to the City.
c) The applicant needs to extend the existing sidewalk along Dean Lakes Blvd to the
east around the cul-de-sac and matcl� in to the existing bituminous trail fo the
south.
d) The applieant will provide class IV fieldstone riprap from all flared end sections
to the bottom of the storm water basin.
e) The applicant will need to investieate the feasibility of desi«ning the proposed
storm sewer so it can serve the poriion of the subdivision set aside for fuhzre
development.
fl The applicant needs to obtain the necessary CenterPoint Ener�y permiU'approvals
prior to any land distur6in_ activity within their easement.
g) The applicant needs to obtain the nccessary �icel Energy permits/approcal prior to
any land disturbine activity within their easement.
h) The applicant must comply with City Code Chapter 11, Section 11.60, Subd. 9.
i) Applieant must submit a landscaping plan for the site for staff review.
Replacement trees are required to be two (2) inch balled and burlapped for
deciduous trees and six (6) feet or greater for conifers and planted as follows:
i) A minimum of four feet from impen�ious surfaces.
ii) A minimum of ten feet from property lines.
iii) Not in easements containin� utilities.
iv) Not in Conservation Easement.

j) The applicant is to plant a diversity of tree species on site consistent with flie
existing woodlands to prevent impacts from future disease.
k) Compliance with th� Woodland and Tree Mana�ement Ordinance. Tree
Manxaement Plan Tree Replacement escrow due in the amount of �3�0 per
replacement tree X 1 �0°ib.
I) The applicant must meet the City's Woodland and Tree Manaeement Ordinance
reauirements. The applicant shall contact City Staff pnor to any land disturbing
acrivities for an inspection of the tree protecrionisilt fence installed at the drip Iine
of trees to be preserved.
m) Silt fence and/or tree protection fence shall not be installed within delineated
wetland.
n) Silt fence and/or tree protection fence shall be installed along the existin,
conservation easement. The consen�ation easement is not be disturbed in any way.
3) The followinb procedural ac6ons must be completed prior to the issuance of a
buiidinp permit:
a) Record plans need to be provided per the City of Shakopee Design Cntena,
Section 2S and Section 11? (A-L). The record plans need to be submitted to the
ena neering deparhnent.
4) Followinh approval and recording of the �ual plat, the faliowing condifions shall
appl��:
a) All eonditions from Resolution No. 5986 (Dean Lakes PUD) shall be complied
with.
b) The applicant shall provide six incnes of topsoil for the establishment of turf and
plantin=s. The soi] composition should be similaz to the MnDOT topsoil bomow
requirements.
c) Imgation systems require rain sansors.
d) The appiicant is responsible for preserving all trees indicated as saved on the
plans. If, as a result of mass �rading, any of these trees are detern�ined to be
wounded sufficiently to be eonsidered dead or dyino by the Natural Resources
Coordinator, the developer will be required to rep}ace the tree(s) according to the
Woodland and IYee Manavement Ordinance.
e) Tree protection fence for mass �;adin� is to remain in place the duration of the
land disturbing activities. Removal of the silt fence and tree protection fence for
mass �adin� will be the responsibilify of the developer.

The application indicates a request for Final Plat approval of a business park (BP) development.
The properties under consideration are Lots 4, 5, 6 and 7, Block 2 of the Dean Lakes S Addition
and are south of US-169 and east of County Road 83 (Canterbury Road).
This review is preliminary, as more comments are to follow with additional pian submittals.
However, I offer the following comments at this time for the applicant and for the planning
department:
General Comments
The following items need to be addressed/completed prror to release of the Fina/ Plat for
recording:
1. Execution of a Developer's Agreement, which needs to include provisions for security
for public improvements within the Final Plat and the engineering review fees.
2. Payments of Trunk Storm Water Charges need to 6e made, as required by the most
current City of Shakopee Fee Schedule.
3. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Piat to be
recorded with datum on the Scott County coordinate system.
The followrng items need to be addressed/comp/eted prior to approva/ of a grading permit
and/or a street and utility plan:

City Engineer and the Shakopee Public Utilities Commission (SPUC) approves the
required Final Construction Plans and Specifications.

land disturbing activity within their easement.
The foUowrng items need to be oddressed/completed prior to issuance of a building permrt:
1. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5
and Section 11.z (A-L). The record plans need to be submitted to the engineering
department.
Final Plat
The following items need to be addressed/completed prior to release of the Fina/ Plat for
recording:
1. The applicant needs to provide a minimum of fifty (50) feet of drainage and utility
easement and/or access easement along the west property line.
Recommendation
Engineering staff recommends approval of the Final Plat application subject to the conditions
listed above being addressed by the applicant.

Based on a review of the application materials provided to staff, staff has the following
conditions of approval:

wounded suffciently to be considered dead or dying by the Natural Resources
Coordinator, the developer will be required to replace the tree(s) according to the
Woodland and Tree Management Ordinance.
4, Tree protection fence for mass grading is to remain in place the duration of the
land disturbing activities, including the building of residential homes. Removal of
the silt fence and tree protection fence for mass grading will be the responsibility
of the developer.
