CITY OF SHAKOPEE MEMORANDUM �� � � Ta Mayor and City Council � ���� Mark McNeill, City Administrator From: Jamie Polley, Parks, Recreation & Natural Resources Director Meeting Date: February 8, 2012 Subject: Surplus Playground Equipment INTRODUCTION The Park Maintenance Division is seeking council approval to declare unused playground equipment as surplus property. BACKGROUND AND DISCUSSION The Park Maintenance Division is currently storing unused playground equipment in the public works yard. fn 2004 Valleyfair donated two playgrounds to the City. One playground met all current playground safety standards and was installed at the Central Family Center in 2004. The second playground is in very good condition but has not been instailed at this time and requires a number of modifications to make it compliant with current playground safety standards if installed for public use. Due to the installafiion of a number of new playgrounds throughout the City and the cost to make the modifications the City does not intend to install the playground. The playground equipment that can now be disposed of is an Iron Mountain Forge playground structure manufactured in approximately 1993 with an estimated value of approximately $3000. Per City Code Chapter 2, Sec. 2.70 the City Administrator can sell surplus property. The City has had interest for the equipment from a local church for private use. If the City is to sell the equipment the City Attorney has informed staff that the recipient would be required to execute an agreement transferring all liability to the recipient. The City would require the recipient to defend, indemnify, and hold the City harmless. At this time we are seeking Council approval to dispose of the equipment by sale. Note that while there is an interested user, the availability of the equipment would be advertised and sold to the highest bidder. VlSIONING RELATIONSHIP Goal F: Housekeeping REQUESTED ACTION If the Council concurs, it should, by motion, declare the unused playground equipment surplus property and authorize staff to appropriately dispose of these items.
