INTRODUCTION
Opus Design Build LLC has submitted an application for vacation of an easement on a �
portion of its property located south of 4�' Avenue and west of CSAH 83. Please see ,
� E�ibit A for general loeation. The attached Resolution No. 7159 sets a public hearing date
to consider the vacation of the easement. �,

DISCUSSION I
�� The attached resolution sets a public hearing far Tuesday, February 21, 2012. On that date,
comments from staff inembers and utilities, as well as a recommendation from the Planning I
Commission, will be presented to the City Council for consideration. The Planning ,
Commission will consider the request at its February 9, 2012 meeting. I

RESOLUTION NO. 7159
A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE
VACATION OF EASEMENT
�
� WHEREAS, it has been made to appear to the Shakopee City Council that an
I easement located south of 4 Avenue and west of CSAH 83 is no longer of public use or
interest; and
�I WHEREAS, a public hearing must be held before an action to vacate can be taken
and two weeks published and posted notice thereof must be given.
�
WHEREAS two weeks ublished notice will be 'ven in the SHAKOPEE
� P �
VALLE� NEWS and posted notice will be b ven by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post
Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the
Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council
Chambers on the 21 st day of February, 2012, at 7:00 P.M. or thereafter, on the matter of
' vacating an easement south of 4' Avenue and west of CSAH 83.
Adopted in session of the City Council of the City of Shakopee,
