DISCUSSION
Canterbury Park has made application for a Planned Unit Development(PUD) Amendment to
allow for a Recreation Vehicle (RV) Park on their property. The Canterbury Park PUD is
located north of Hwy 169 and west of CSAH 83 (Exhibit A).
The Canterbury Park PUD was most recently approved by the City Council in 1995 to allow a
variety of uses to occur on this property (see attached list of 24 uses). In 2001, Canterbury
proposed an amendment similar to the present request; however, that request was withdrawn.
The Canterbury Park PUD approval is a very detailed agreement that defines uses that are
permitted for this property how development would proceed. They were specifically allowed a
mix of uses for this complex, with the applicant specifically noting that horse racing/betting,
stabling of horses, housing for 480 track related people, card club, and special events such as
trade shows, car shows, and other outdoor events were approved uses.
As part of this request, Canterbury is requesting approval to allow RV housing from April
through October for horsemen, Canterbury Park employees and as a back-up location for when
the Shakopee Valley RV Park(along Hwy. 101 and Marschall Road, adjacent to the Minnesota
River) floods.
There are two specific areas proposed for the RV use. The first area is located in the northeast
corner of the property, and would provide for 12 sites. The second area is located just east of the
track and would include space for eight(8) sites (see Exhibit C which depicts the proposed
locations).
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed this request at its June 7th meeting. At that meeting, the
Planning Commission recommended approval of the PUD amendment to the City Council by a
4-0 vote, with recommended conditions. A copy of the staff report to the Planning Commission
is attached for the Council's information.

RESOLUTION NO. 7209
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,APPROVING AN
AMENDMENT TO THE PLANNED UNIT
DEVELOPMENT FOR CANTERBURY PARK TO ALLOW FOR A RECREATIONAL
VEHICLE PARK
WHEREAS, Canterbury Park Holding Corporation, applicant and owner of said
property,has made application for an amendment to the Plaimed Unit Development for
Canterbury Park; and
WHEREAS, the property upon which the request is being made is legally described as
follows:
See Exhibit# l, Legal Description(attached); and
WHEREAS, on May 16, 1995, the City Council of the City of Shakopee did approve
Ordinance No. 417, approving a rezoning of this property from Race Track District to Planned
Unit Development Overlay Zone No. 3; and
WHEREAS,the Planning Commission of the City of Shakopee did review the
amendment to the Planned Unit Development on June 7, 2012; and
WHEREAS, all required public notices regarding the public hearing for the Planned Unit
Development Amendment were duly sent and posted and all persons appearing at the hearing
have been given an opportunity to be heard thereon; and
WHEREAS, the City Council of the City of Shakopee did review the amendment to the
Planned Unit Development on June 19, 2012.
WHEREAS, Section 11.50, Subd. 6 of the City Code outlines the criteria for granting a
Planned Unit Development, with findings as follows:
Finding No.l: The Comprehensive Plan designates this area for entertainment
use/development. In addition,the underlying zoning and PUD approval specifies
development consistent with the Comprehensive Plan. The use of this property for

inclusion of 20 RV campsites is generally consistent with the Comprehensive Plan and
the existing PUD uses.
Finding No. 2: The use of the property for RV campsites should not impact the use of
the surrounding property. The land to the north of the proposed sites is industrial and is
screened by a dense tree/vegetation buffer, as well as substantial grade change. The area
to the east is also screened by a tree/vegetation buffer.
Finding No. 3: The intent of providing adequate open space, circulation, parking,
recreation, screening and landscaping is to ensure that the development of property, at a
minimum, does not have a negative impact on surrounding roadways, neighborhoods, or
recreational areas and at most, enhances and/or benefits these areas. The use of the
property for the described request should not negatively impact the surrounding areas in
that light.
Finding No. 4: The primary function of the Canterbury Park PUD is to provide
entertainment related activities, which could be construed to include RV camping for
employees and horsemen. There presently exist an extensive number of employees that
take up temporary residence within the complex.
Finding No. 5: The introduction of the requested use is generally compatible with the
adjoining land uses of industrial and commercial activities, in the present/proposed
configuration.
Finding No. 6: The introduction of RV campsites in this area does not afford a greater
general public benefit than is currently in place.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
That the Planned Unit Development for Canterbury Park is hereby amended to allow:
1. The RV sites shall be located and developed consistent with the submitted plans (Sheets
1.1 and 1.2, dated 02/15/12).
2. Use of the RV sites shall be limited to employees of Canterbury Park, horsemen
associated with Canterbury Park, and as a back-up location when the Shakopee Valley
RV Park floods.
3. Use of the RV sites shall be limited to the period from April 1 st thru October 31 st of each
year.
4. The RV sites shall comply with all applicable health regulations of the Minnesota
Department of Health.
5. The RV sites shall comply with all Building Code requirements, Public Works storm and
sanitary service requirements, and Shakopee Public Utilities (SPUC) water service
requirements. Canterbury shall contact SPUC to discuss whether a water connection
charge would apply, and what that cost may be.
6. Fire Department access shall be provided to the proposed sites. Access shall meet the
requirements of the MN State Fire Code.

7. The RV sites shall be kept in a well maintained condition, with no unregistered vehicles
stored on site and no exterior storage of any materials other than the RV's or RV related
materials.
8. All sewage and gray water is to be disposed of in the appropriate location.
9. If fifty (50) cubic yards or more of material needs to be moved in order to accommodate
the temporary RV housing, the applicant will need to obtain a grading permit.
10. The requirements of the previously approved PUD (PUD Overlay Zone No.3, Ordinance
No. 417), shall be met.
11. The applicant shall provide lighting, security patrolling and a security fence for the 12
RV's located in the northeast corner of property, with the fence installed a minimum of
five (5) feet beyond the most westerly and most southerly RV's.

Also attaclled is a nanative provided by Canterbury Parlc. In its i�an-ative, they ex�lain tl�at these

Park floods, and it will meet the licensing requirements of the Minnesota Depai-�ment of Health.
They would provide for all sanitary and waier seivice requirements of the City and Stafe, and the
operation of these spaces would be limited for use fiom April thi-u. Qctober.
The Building �fficial commented that should this reqnest he approved, that the water/sewer
services shall he inspected by the Building Depai-tnient prior to use as RV sites. The Fire
Marsl�all and Shakopee Public Utilities also provided comments, which have been incorporated
into the drait conditions. No other comments were received that wai-ranted additional conditions
or info�-�nation prior to offering a recommendation.

Canterbury Park RV Park
Canterbury Park is requesting a change in our Planned Unit Development to allow
an RV Park on site.
Occupancy and Season
The RV Park will be use by Horsemen, Canterbury Park employees and as a back-
up location when the Shakopee Valley RV Park floods. Canterbury Park owns the
Shakopee Valley RV Park.
Occupancy will be April to October.
Location
To better utilize existing utilities the RV Park is divided into two locations. The
north location is outside our perimeter fence across from the Vehicle Shop with
12 sites. See attached map.
The south location is inside our perimeter fence adjacent to the vehicle shop with
8 RV sites.
Canterbury Park is a large property-392 acre. The two RV locations are far from
any residential property. I estimate the RV. Park will be 3200 feet from the west
residential property. To the north is commercial property.
Neighborhood Meeting
In advance of any City meetings, we will hold a neighborhood rr�eeting to review
the project.

PUD Application
Question 21.
Please provide any additional information that would be helpful for the Board of
Adjustment and Appeals or Planning Commission when reviewing this request:
Canterbury Park is requesting a change in our property conditional use to allow an
RV Park on site.
The primary purpose of the RV Park is to be a back up location for the Shakopee
Valley RV Park when it floods. Canterbury Park owns the Shakopee Valley RV
Park.
RV Parks are regulated by the Minnesota Department of Health (MDH).
In the past, the MDH has allowed Canterbury to set up a temporary RV Park at
Canterbury Park due to the flooding of the Minnesota Rivero The MDH now
requests us to license the Canterbury Park RV Parke
The first step in the MDH license process is to obtain local approval.
The Canterbury RV Park will be divided into two areas (see the attached map)
The North Canterbury RV Park is outside our perimeter fence across from the
Vehicle Shop with up to 12 sites.
The South Canterbury RV Park is inside our perimeter fence adjacent to the
vehicle shop with 8 RV sites.
All RV's will be independent RV's with holding tanks and self contained bathroom
facilities.
Sewer system.
There is no direct sewer connection for the RV's
Sewer service is provided by a portable wagon.
A new RV Sewer dump station will be added.
Water system
The sites have potable water connection coming from the vehicle shop with a RPZ
backflow preventer which is tested yearly and rebuilt every five years.
The water supply lines have a 3/ riser with a hose bib and hose end backflow
preventer-watts 1051.
We will make sure tenants use potable water hoseo
The water supply comes from Shakopee Public Utilities
Minnesota Department of Health
We will follow all MDH regulations which include the following.
Minimum site size will be 2000 sq. ft. With a minimum of 10 feet of open space
between the sides of adjacent RCV and a minimum of 10 feet from the property
lines.
A 10 mph speed sign will be posted.
Garbage dumpster will be provided and emptied weekly.
Pets must be leashed ar kenneled.
The site will be mowed and kept clean.
The caretaker is the Facilities Mgre and Canterbury Park Stable Gate Security is
back up. Canterbury Park Security is 24/7 and their phone number will be posted.
Occupancy and Season
The park will be occupied mainly with Canterbury Park Independent horsemen,
Canterbury Park employees and their families.
Occupancy would be allowed from April through Octobera
Electrical
Electrical service will be 30amp and 50 amp outlets.
South location, 4 existing site light will be used.
4 additional lights will be added to the south location and 6 lights will be added to
the north location.

Conditional Use informational Handoute
1, The use will not be injurious to the use and enjoyment of other property in
the immediate vicinity for the purposes already permitted, nor substantially
diminish and impair property values within the immediate vicinity:
Canterbury Park is a large property-392 acre. The two RV locations are far
from any residential property. I estimate it is 3400 feet to the west
residential property. To the north is commercial property.
2. The establishment of the conditional use will not impede the normal and
orderly development and improvement of surrounding vacant property for
uses allowed in the area.
Canterbury Park owns most of the undeveloped property in the area. The
commercial property to the north is estimated 25 feet below the RV Park.
3. Adequate utilities, access roads, drainage and other necessary facilities
have been or will be provided.
We have used the area as a temporary RV park in the past.
There is drainage in the area.
We do plan on adding:
RV Park dump station.
Upgrading the electrical in the north site to 30 and 50 amp power.

Thank you for the Notice of Public Hearing and your time on the phone a few weeks back.

In reading your letter l do hav� some concerns initially from a sanitation obsenration and addifional garbage.
Flowever, I'm assuming that is Canterbury's responsibility and they hav� a proposed plan in place. My other
concems are that of safety for the surrounding citizens/homeowners. In the proposed months the Recreational
Vehicle Housing would be allowed, are also the months when more residents are; out of their homes, garage
doors are open and people are generally just out and about. There are quite a few of my neighbors who do li�
alone and fear that adding more people to the area, especially at that time of year, could create more
transgressions, if you will. As you know from recent break-ins inwlving teens and Shakopee students there are
residents who don't feel as safe in their neighborhoods as they once did. Seasonal living residents do not have a
vested interest in the community as a whole and therefore could create these and other problems.
With that said if the proposed location is on Canterbury's current property, which I believe it is, I do not want to
be that person to limit business growth or the opportunity for any business to make money! According to
Canterbury this particular location would be used a "back up" location for when the Shakopee Valley RV Park
floods. So my question pertaining to that is, will the RV's move to this location at the fime of flooding or potential
flooding, or is this location to rep(ace the Shakopee Valley RV Park location all together?
