SUBJECT: False alarm ordinance amendment

INTRODUCTION:
Council is asked to consider ORDINANCE NO. 773, FOURTH SERIES, AN
ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY
CODE CHAPTER 4, SECTION 4.41 RELATING TO ALARM SYSTEMS.
BACKGROUND:
At a council work session on October 24, 2006, Council appeared to reach a consensus
recommending changes to our current false alarm ordinance to reflect a billable event
after two false alarms instead of the current three.
When the ordinance was originally passed by council, the fees were listed in the
ordinance. The recommended changes incorporate false alarm fees into the City fee
schedule.
The amended ordinance should remove language marked with strike-through, and add
language marked with underline.

1.) Approve ordinance No. 773, Fourth Series.

3.) Table and give direction to staff.
RECOMMENDATION:
Staff recommends alternative number 1.
ACTION REQUESTED:
The City Council, if they concur, should by motion offer Ordinance No. 773, Fourth
Series, An Ordinance of the City of Shakopee, Minnesota, Amending City Code Chapter
4, Section 4.41, Relating to Alarm Systems, and move its adoption.

ORDINANCE NO. 773, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE CHAPTER 4,
SECTION 4.41 RELATING TO ALARM SYSTEMS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE MINNESOTA ORDAINS:
Section 1. City Code Chapter 4, Section 4.41, Subdivision 3 is amended to read as
follows:
Subd. 3 User Fees.
A. An alarm system which causes more than three (3) two (2) false alarms to
the City in a single calendar year and which has received notice of such
violations will cause the alarm user to be charged a user fee of $100.00
.as specified in the City of Shakopee's fee schedule. per false alarm in
excess of three (3) two (2) false alarms in a calendar year for false police
notifications and a user fee of $300.00 .as specified in the City of
Shakopee's fee schedule. per false alarm in excess of three (3) two (2)
false alarms in a calendar year for false fire notifications.
Section 2. This ordinance becomes effective on January 1, 2007.
