SUBJECT: Burmahi Land Donation Tax
DATE: June 5, 2012
Introduction:
The Council is asked to authorize payment of base -level property taxes payable for the year 2012 for a
3.25 acre parcel of land set for donation by Burmahi, Inc.
Background:
For the past several months, the Council has been kept apprised of a potential of 3.25 acres of land,
comprised of three parcels north of First Avenue and east of the motel on Bluff Avenue. The donation is
being made by Burmahi, Inc.
The Council has previously authorized closing work to take place. A Donation Agreement has been
negotiated, and the closing on the parcel is set for the later part of the week of June 4 In discussing
the Donation Agreement, the donors have asked for consideration by the City to pay all of property
taxes for taxes payable 2012. Typically, when a land sale takes place, the seller is responsible for the
prorated part of the taxes up to the date of sale, and the sales price reflects that cost; the buyer accepts
the tax payment for the time after that. In this case, as a donation, there is no exchange of money. In
consideration of this and the overall value of the donation, the donor has asked that that the City pay all
of the taxes payable for 2012.
Note that this would be for the taxes payable for 2012 only. The donor would be responsible for any
delinquent taxes or interest owed.
Budget Impact:
Taxes payable for the three parcels combined were $18,320, or $1,527 per month. Under the typical
scenario, the donor would have been responsible for approximately $7,633, the City approximately
$10,687. If agreeable to the Council, the City would pay the additional $7,633, although the City will
receive back its normal prorated 30% share of the property taxes of what is paid.
If acceptable to the Council, the recommended source of funding for all property taxes would be from
the General Find unallocated line item. There is approximately $50,000 available in that.
Assuming the land transfer is completed by June 30, 2012, the property will become tax exempt on
January 1, 2013.
Recommendation:
In consideration of the donation of the parcel to the City, I recommend that the City Council authorize
payment of the 2012 base taxes levied on the 3.25 acre parcel being donated by Burmahi, Inc.
Relationship to Visioning:
This supports Goal D.
Action Required:
If the Council concurs, it should, by motion, authorize payment of the base level property taxes payable
in 2012 for Lots 2, 3 and 4, Block 1, Halo 2 Addition, Shakopee, Minnesota, at the time of closing of the
donation of said land to the City.
