2006 Shade Tree Disease Control and Prevention Removals

INTRODUCTION:
Attached is Resolution No. 6530, a resolution which adopts the assessment for the above
referenced work.
BACKGROUND:
The Shade Tree Disease Control and Prevention Ordinance, Section 10.70, was utilized
to require the removal of over 100 diseased trees on private property in 2006. Property
owners were notified of the diseased tree is on their property and provided four options to
have the diseased tree(s) removed:
1. Remove the tree themselves.
2. Hire and pay their own contractor.
3. Hire the City's contractor and pay for the removal within 30 days.
4. Use the City's contractor and request that the cost of the tree removal be
assessed against their property tax.
In the 2006 growing season two (2) properly owners chose the fourth option. The work
has been completed with prior approval from the affected residents. The costs to be
assessed for the Shade Tree Disease Control and Prevention Removals completed during
the 2006 growing season is $2619.10:

Attached are the forms completed and signed by the residents notifying the City to have
the costs of the removals assessed to their property.
ALTERNATIVES:
1. Adopt Resolution No. 6530.
2. Deny Resolution No. 6530.
3. Table Resolution No. 6530 for specific reasons.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer Resolution No. 6530, A Resolution Adopting Assessments for the 2006 Shade Tree
Disease Control and Prevention Removals, and move its adoption.

For The 2006 Shade Tree Disease Control and Prevention Removals
WHEREAS, pursuant to proper notice duly given as required by law, the City Council of
the City of Shakopee met and heard and passed upon all objections to the proposed assessments of:
The 2006 Shade Tree Disease Control and Prevention Removals
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA:
1. That such proposed assessment together with any amendments thereof, a copy of which is
attached hereto and made a part hereof, is hereby accepted and shall constitute the special
assessment against the lands named herein and each tract therein included is hereby found to be
benefitted by the proposed improvements in the amount of the assessments levied against it.
2. Such assessments shall be payable over a period of one year, the first installment to be
payable on or before the first Monday in January, 2007, and shall bear interest at the rate of 5.75
percent per annum from the date of the adoption of this assessment resolution. To the first
installment shall be added the interest on the entire assessment from the date of this resolution until
December 31, 2007.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the' assessment on such property, with interest
accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may
thereafter pay to the County Treasurer the installment and interest in process of collection on the
current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and
shall certify annually to the County Auditor on or before November 30th of each year the total
amount of installments and interest on assessments on each parcel of land which are to become due
in the following year.
