SUBJECT: Premises Permit - Creative Learning Ideas for Mind and Body (CLIMB)

INTRODUCTION AND BACKGROUND:
Creative Learning Ideas for Mind and Body (CLIMB) is making application to obtain a premises
permit in order to conduct lawful gambling activities at Saba's Sports Bar and Grill, 911 East 1 st
Avenue. The activities identified include pull-tabs, paddlewheel, and bar bingo. They plan to
utilize a pull-tab machine versus having a booth that is staffed. Pull-tab dispensing devices are
allowable in on-sale intoxicating liquor license establishments according to the city code.
The applicant is an acting education company that has been in existence for 30 years and focuses
on children. They put on plays and skits in individual classrooms to give students of all ages and
abilities an interactive and memorable learning experience, including such topics as: violence
prevention, acceptance of differences, refusal skills, resiliency, decision making and respect.
The premises permit will ultimately be issued by the State Gambling Control Board. When
application is made, the Board requires that the local unit of government pass a resolution
specifically approving or denying the application.
The applicant has been advised of the City's requirement that each licensed organization
conducting lawful gambling within the City shall expend 75% of its. expenditures for lawful
purposes on lawful purposes conducted or located within the city's trade area. Al1licensed
organizations are required to submit monthly reports to the City so this requirement can be
monitored. The trade area for the City of Shakopee includes the municipalities that are
contiguous to the City of Shakopee.

RECOMMENDED ACTION:
Offer Resolution No. 6528, A Resolution of the City of Shakopee, Minnesota, Approving
Premises Permit for CLIMB, and move its adoption.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,
APPROVING PREMISES PERMIT FOR CLIMB
WHEREAS, the 1990 legislature adopted a law which requires municipal.approval in
order for the Gambling Control Board to issue or renew premises permits; and
WHEREAS, CLIMB (Creative Learning Ideas for Mind and Body) is seeking a Premises
Permit for the site at Saba's Sports Bar and Grill,911 East 1 st Avenue, Shakopee, Minnesota.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
That the Premises Permit for CLIMB at Saba's Sports Bar and Grill, 911 East 1 st Avenue,
Shakopee,Minnesota, be approved.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota held
this 8th day of November, 2006.
