Shakopee City Council July 12, 2022 FROM: Mark Noble, Senior Planner TO: Mayor and Council Members Subject: Set Public Hearing Date for a Vacation of Easements in Hentges Industrial Park 2nd Addition Policy/Action Requested: Adopt Resolution R2022-084 setting the public hearing date for vacation of public drainage and utility easements in Hentges Industrial Park 2nd Addition. Recommendation: Approve the action requested. Discussion: Hentges Development, LLC has proposed development of their Hentges Industrial Park 3rd Addition, and with CT Realty proposing a CNG (compressed natural gas) facility on the proposed Lot 2 of that 3rd Addition. Since there was a realignment of the common line between Lots 1 & 2, new easements were required with the old easements required to be vacated. Should this Vacation be approved, the developer of the property will provide new easements in the Hentges Industrial Park 3rd Addition Final Plat consistent with City Engineering and SPU requirements. The attached Resolution R2022-084 sets a public hearing date of Tuesday, July 19, 2022, to consider the vacation of the public drainage and utility easements. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission considered the request at its July 7, 2022 meeting. The parcel in question (Outlot A, Windermere South 5th Addition) has a blanket easement over the entire parcel. To develop this parcel, Vacation of that public drainage & utility easement is necessary. Should this Vacation be approved, the developer of the property will provide new easements in the Windermere South 6th Addition Final Plat consistent with City Engineering and SPU requirements. Shakopee City Council July 12, 2022 FROM: William H. Reynolds, City Administrator TO: Mayor and City Council Members Subject: Brief Review of the City/County Partnership Policy/Action Requested: None. Recommendation: None. This is an informational memo. Discussion: The City and the County have a broad range of activities and projects that they collaborate on. For decades, they have cooperated on mutually beneficial programs to be more efficient and save money. In addition to the "joint crown jewels" of countywide fiber optic connection, and the Scott Joint Prosecution Association, there are a host of other mutually beneficial collaborations between our organizations that help taxpayers. These include efforts in public works and engineering such as: fleet asset management software; County use of City fuel island, car and truck wash; equipment sharing; road improvements; trail sealcoat; City mowing of County ROW in the City; regional traffic management system; County inspection of City bridges; County data used for City GIS; City removal of graffiti from County bridges; and multiple grants/partnerships from the County including Clean-up Day, chloride reduction, sumps and baffles near River Bluff and BMP study for the West End. In addition, major partnerships/collaborative efforts have occurred in the area of economic development including joint efforts with the CDA and River City Center; Cultural Corridor Planning and Implementation; private development coordination on county highways; coordination with the First Stop Shop with project submissions to the State, City EDA sponsorship of the Fast Track Challenge, and County work on the seminal Housing Study and Commercial/Industrial Study. Page 13 of 15 But it is more than just projects and boots on the ground. The County has always been very helpful in information exchange especially in the areas of taxes and assessments. However, not every project is a success and not every action has its intended consequences. Even with good friendships, excellent partnerships, and great marriages — disagreements occur. Sometimes, this is just because our missions are often different. For example, Scott County is the human service delivery arm of the state. They employee and partner with hundreds of people to help with this effort. Shakopee in contrast, has no human service delivery mission and employs no one in such a capacity. Another example is the County wanting traffic to move swiftly along county roads with minimal disruption/access, and the city wanting more access to local roads. It is natural for disagreements to occur. And when they occur, they rise up to various levels of our governments as solutions are sought. As it stands, we have one real issue before us and a couple that City and County Administration have agreed to discuss. These include the use of the city -owned and county - managed library, the future of LETG (Law Enforcement Technology Group) software, and a discussion of construction on CH 83. LETG and CH 83 will be discussed first with a more in-depth recitation of facts on the library to follow. LETG — Almost from the beginning, LETG has been a major disappointment and unworkable in many instances. It doesn't provide what was promised and soon after it was installed, a competing company bought it out with the intentions to let it die on the vine. It is frustrating for both users and those seeking to access data. Scott County city administrators and managers have been trying for at least 5 years to find a solution to these issues. Our last attempt earlier this year included a request from the managers of Prior Lake, Savage, Jordan and Shakopee to once again sit down and discuss. The response was clear. The County would be willing to discuss, but there was going to be no changes to the plans for the future of LETG. The issue is essentially moot at this point as it is clear that we all need to start to discuss the end of the LETG contract in the next several years and what will take its place when the contract is up. CH 83 — The construction of CH 83 is complex and difficult to manage with the traffic from Canterbury and Mystic, and the intersection of 169. It was bumpy in the beginning, but the City recognizes the complexity of this project and thank the County for the partnership in rebuilding. The escalation of the City's portion from @ 1.4 M initial estimate to $3.5 M has caused some concern in the past. City Library Building — The City -owned building was designed and built to be a library. Page 14 of 15 The original agreement executed in 1977 wasn't fully clear and frankly the parties probably never suspected that the building would be used for anything other than delivering library services. The City essentially views this relationship as a tenant/owner relationship and to clarify that requested the city attorney draft an agreement to reflect it. There are also concerns of having non -profits using the facility to supplement the County human services delivery, as cities are restricted in their ability to provide support to non-profit entities — unlike counties. The city council passed the licensing agreement drafted by the city attorney to reflect their concerns. The County at this point has "declined to participate" in that agreement. The Future — As we continue to jointly work on those few areas of disagreement, we have several things on the horizon that offer an opportunity to partner and achieve even greater success. Some of the most important are in the realm of police services. These include the prospect of imbedding social workers with police to help address the significant mental health and social issues that arise during police calls. In addition, both the County and the City will receive opioid settlement funds in the future and coordinating the use of those funds is critical. Finally, the Regional Training Facility is in the process of looking to the future and both our Fire Chief and Police Chief are on the committee reviewing what it looks like in its next phase.
