Consider Petition for Storm Drainage Improvements on the Residents on Block 9 of Westchester Estates /3. f3. :L ~ CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Consider Petition for Storm Drainage hnprovements on the Residents on Block 9 of Westchester Estates DATE: October 17, 2006 INTRODUCTION: Attached to this memo is a petition from 20 homeowners, who reside in Block 9 of Westchester Estates, petitioning the City of Shakopee to resolve a storm drainage problem in the back yards oftheir homes. BACKGROUND: The Westchester Estates development was essentially built in 2003 and 2004 with residents moving in 2004 and 2005. In 2005 staff was notified of a complaint by residents on their back yards drainage swale not performing to their expectations. Staff did investigate this complaint and notified the developer, Tollefson Development, Inc., to review the storm drainage design and actual grading of the drainage swale. The developer and the residents have not been able to reach a resolution on this situation. Included with this item are the following items on this issue of the proposed drainage problem of Block 9, Westchester Estates; 1. An as built grading plan showing the drainage swale grades and storm sewer in Block 9. 2. A cost estimate on a preliminary design for an infiltration storm sewer drainage pIpe. 3. Correspondence letter and pictures from Howard Bazinet. In 2006, staff has been corresponding with residents in this area on this issue and has made several visits to the site. In the more easterly portion of the drainage swale, some of the residents have excavated an additional drainage swale to improve the drainage. The approved grading plan for this subdivision and this area for drainage included two storm sewer catch basins with a 1% drainage swale towards these catch basins in the back yards. A 1 % minimum slope was the requirement of our Design Criteria at the time of . ' plat approval for this subdivision. The residents have noted on their petition form that the City has changed their requirements to a 2% grading minimum slope for grading, which was done after the subdivision was approved. In the grading of the development, staff does require an as built grading plan before building permits can be issued. The developer and his contractor did grade the swales to the 1 % grades before builders obtained permits. After the building and restoration of all lots, the drainage swale grades were altered slightly resulting in some flat areas. This alteration could have been done by the builders or homeowners restoring their yards. Another observation staff would note is that it appears that almost every resident does have a sprinkling system in this area and the sprinkling of the lawns on a regular basis is contributing to part of the problem of the back yard swale becoming saturated. Staff has recently revisited the area recently and with reduced rainfall and sprinkling, the back yard swale has dried up considerably from what it was earlier this summer. The attached petition is requesting the City of Shakopee to resolve) a proper storm drainage in the back yards of the homes of Westchester Estates in Block 9. It appears that the back yard swale was graded to the approved plan initially before building permits were allowed and the drainage swale grades have been altered through the building process. The drainage swale area is also being saturated by rainfalls and sprinkling of lawns, thus keeping this area over saturated for a long period of time. In review of the drainage, the drainage swale is performing the drainage function as the water is conveyed into the storm system and to the storm drainage ponds in Westchester Estates. The problem is that the grade has been altered in some areas creating flat areas and the soil is saturated in the swale. Staff would like to point out that even if a 2% grade was done in this area, the residents could still experience problems with over saturation of soil in the drainage swale from excessive rainfall and sprinkling of lawns. Current City policy, in regard to this matter, has been that new storm sewer construction to improve storm drainage would be paid at 100% to the benefiting property owners. If this was a stonn drainage improvement project to correct a situation, such as an erosion problem due to a failure of the stonn drainage system, this would be paid out of the Storm Drainage Fund. The storm drainage utility, which is charged to every resident, is to pay for the operation and maintenance of the storm drainage system, as well as future replacement of these facilities and correction necessary for the overall operation of the system. Staff will present the petition and describe the problem, as staff sees it, as well as there will be residents in attendance to address the City Council in this matter. Staff has had other projects with residents in the past, such as the Prairie Village subdivision, in which the residents did pay a dollar amount per lot to have a drainage improvement done. In summary, staff believes that the storm drainage is working to the extent that buildings are being protected for Block 9 of Westchester Estates. However, the drainage swale area is being saturated at times through the year due to heavy rains and sprinkling of lawns and in some areas due to altered grades of the swale. Current City policy, which is in the Assessment Policy, would indicate that the initial storm drainage improvement would be assessed to benefiting properties unless it is deemed a correction or repair of the storm drainage system. The request of the residents is for the City of Shakopee to resolve the improper storm drainage in their back yards on Block 9 of Westchester Estates. The City Council can direct staff to begin a 429 Assessment Project for the storm drainage improvement in this area, or direct staff to begin a project and payout of the Storm Drainage Fund or work with the development for a solution or not do any improvement at this time. Staff would review further to see if the developer or their engineer has any responsibility in this matter. This subdivision has been accepted and is in the warranty period for the street and utilities work. At this time, the developer does not believe he has any responsibility. Staff would recommend pursuing this option first before proceeding with a public improvement project. The residents are in favor in the city working with Tollefson to correct the drainage problem and do not feel they should incur any costs in this matter. Staff would need council direction on how to proceed with resolving this drainage issue. ALTERNATIVES: 1. Discuss the petition and provide staff direction on proceeding with this issue. 2. Table for additional information. RECOMMENDATION: Staff would recommend that Council discuss the petition and the issue and provide staff direction on whether to proceed with a 429 project, or a storm drainage utility project or pursue a solution with the developer of Westchester Estates or not to proceed at all. We believe the current design does not meet the actual requirements for sufficient drainage which results in standing water in our backyards. 'R$CORD Westchester Estates Block 9 Drainage Issue Greetings Shakopee City Council Members! My name is Howard Bazinet and I am the unofficial spokesperson for my neighborhood block. I am writing to give you some background on the issue to be heard at the October 17th council meeting regarding poor drainage on block 9 of Westchester Estates. Attached you will find a printed copy of the e~maillsent a few weeks ago outlining the problems we are experiencing. I will not go into great de~ail regarding the history on this cover letter. Steve Menden had a meeting with my neighbors and myself on September 27th. He listened to our concerns and witnessed first hand the pooling of water around the storm drains, and the pooling of waterthe entire distance of the block from end to end. He agreed that it appeared there was not sufficient grading at 1 % and that corrective action should be taken. I am including pictures of the property during a moderate rainfall to help illustrate just how bad the problem is. You can see by these pictures the standing water and lack of flow toward the storm drains. My neighbors and I have been informed that there is a solution to the drainage problem, albeit at a significant cost. We are reluctant to incur any costs on our part as we feel the issue is a design flaw, and not aTesult ofany negligence on our part. We are also concerned that the drainage code was changed literally at the same time our homes were being built. However, the developer did not take this into account when grading this particular block. Indeed, they were under no obligation to do so since the code was only I % at the time they submitted their plan. It is our contention to enlist the city's help, along with Tollefson Development, to correct the drainage problem. We hope that th,e city's relationship with Tollefson Development could be utilized to our benefit. It was mentioned at one point during our meeting with Councilman Menden that perhaps the City could "persuade" Tollefson Development to correct the problem out of good faith in order to continue a highly profitable development business in the city. Councilman Menden mentioned that Tollefson Development is indeed the dominant developer in :the city and some builders have actually requested that the city consider allowing other developers the opportunity to compete with Tollefson Development to help curb skyrocketing lot prices. " ,- ' I would like your help in resolving an issue regarding improper rain drainage in the back yards on my block. A detailed description of the problem is as follows; The property I own is Block 9, Lot 20 of Westchester Estates. (For your reference) It is part of a "kidney bean" shaped parcel that has around 25 lots that all back up to each other, forming a very nice, large open area for kids to play, etc. This is the reason we purchased this lot, and paid a premium price for a larger, open lot. The problem is that, every since we moved in, the back yards all flood with standing water every time it rains. There are 2 storm drains in my neighbors' back yards to the south. The grading is a gradual drop from north to south. The development was completed in Spring of2004 and we movedin April 301\ 2004. At first, we called our builder and complained ofthe pooling water after a rainfall, and we were told to wait until all of the homes were completed and sod was laid down, as this could cause too much run-off to flood the backyards as I described, , ' , Later that summer, even after most of the yards were landscaped, the problem of standing water remained. I put a call into our builder and was referred to the developer, Tollefson Development. After a conversation with Gary at Tollefson, he agreed to send a survey crew out to the site to determine if the grading was done properly, The survey crew reported back that the back comers of each lot were indeed at the designed elevations, Tollefson Development eventually told me that they are not liable for the drainage issue, since the grading was done according to the plan submitted to the city, and the city approved the plan, and the final grading. That led me to conversations with your planning department and inspectors. I was told that the issue was not the responsibility of the city and I should take it up with the developer. ] felt as if I were caught ,between two entities that were pointing fingers at each other. Iwas unable to get either to accept responsibility for the resolution of the problem. Everyone agrees that the back yards flood, but nobody seemed to be able to say whose fault it was. ] was told the homeowners would hiwe to pay an independent contractor to tear up the back yards and lay drain tile, and re-Iandscape the damaged areas. One of my neighbors had a bid submitted from a contractor for roughly $5,000.00 per household!!! After a visit with one of your city engineers, in my back yard this summer, I learned an interesting piece of information. It seems that at the time our land was being developed, the city code for drainage was established at a 1% grade. The developer designed and graded to this specification. Apparently, the code has since been revised. The new code calls for a 2% grade for proper drainage. When asked, your engineer stated it was changed to help eliminate problems such as ours. However, he stated that he doubted the city could do anything since the code was not that at the time out homes were built. ] found hat statement to be very frustrating, considering the amount we paid, the short time we've been here, and the.fact that the problem has been here since day one. ;<' ~ At this point, my neighbors and I agree that we should not be responsible for the enormous undertaking that would need to be done to resolve the situation. There are roadblocks in doing so. First, the last ten feet of our back yards are easements owned by the city, as far as I know. Therefore, we cannot legally alter them without the city's consent. I believe they are called "utility easements". Secondly, not all residents would necessarily agree to pay $5,000 each for the needed work. To do the job properly would requirethe cooperation of all of the neighbors on the block, as heavy equipment would be need to do the job properly, and the entire path of the drainage would need to be corrected. I am askingfor your help, on behalf of myself and the other 25 or so neighbors on my block, in resolving this issue amicably. We have consulted with attorneys to discuss the legal aspect of our case, and would rather not have to bring this issue into a courtroom for resolution. I invite you to give me a call to set up a time that you could come outto our block and see first-hand the flooding I am talking about. After all this rain lately, it is atrocious. We would like to have this issue resolved before winter comes, as springtime is when the problem is at its worst.
