No. 6516 /3. 8. / ~ CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Consider A warding a Contract for the Swamp Lake Wetland Mitigation, Project No. 2006-9 DATE: October 17, 2006 INTRODUCTION: Attached is Resolution 6516, which accepts the bids and awards a contract for the Swamp Lake Wetland Mitigation, Project No. 2006-9. BACKGROUND: On September 19,2006, City Council adopted Resolution No. 6491, which approved the plans and specifications and authorized staff to advertise for bids for the Swamp Lake Wetland Mitigation, Project No. 2006-9. The project is necessary due to the filling of wetlands for the construction of Pike Lake Road. On October 16, 2006, a bid opening was held for the Swamp Lake Wetland Mitigation Project, in which there were (13) bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Jay Bros., Inc. with a bid of $66,439.00. The Engineer's estimate for this project is $140,000.00. Staff is recommending that the bid from Jay Bros., Inc. be thrown out due to non compliance with the specifications, as it pertains to the pay item for mobilization. The specifications do not allow the lump sum bid for mobilization to exceed 5% of the total bid price. Jay Bros. bid for mobilization was 12.5% of the total bid. Staff recommends awarding the bid to Rud Excavation from Webster, MN for $66,828.00. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. ALTERNATIVES: 1. Accept the bid of Jay Bros., Inc. 2. Reject the low bidder, award to Rud Excavating and adopt Resolution No. 6516. 3. Reject all bids and rebid. 4. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 5. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.2 and No.4 in order for this project to commence. ACTION REQUESTED: 1. Offer Resolution No. 6516, A Resolution Accepting Bids on the Swamp Lake Wetland Mitigation, Project No. 2006-9 and move its adoption. 2. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. J edlicki, Inc, $172,489.00 WHEREAS, the bid submitted by the apparent low bidder, Jay Bros., Inc. is non responsive to the bidding documents because the mobilization costs contained in the bid exceed 5% of the total bid; and WHEREAS, it appears that Rud Excavation, 4280 Bagley Avenue, P.O. Box 85, Webster, MN 55088 is the lowest responsible bidder for the Swamp Lake Wetland Mitigation Improvements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Rud Excavation. in the name of the City of Shakopee for the Swamp Lake Wetland Mitigation Improvements Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed. . Mayor of the City of Shakopee ATTEST: City Clerk 1~.f3.L CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Consider Award of Contract for Swamp Lake Wetland Mitigation, Project No. 2006-9 DATE: October 17,2006 INTRODUCTION: The City will be having a bid opening on October 16, 2006 for the Swamp Lake Wetland Mitigation, Project No. 2006-9, which is also associated with the wetland fillings for Pike Lake Road, from Southbridge Parkway to CSAH 16. Recently, the City has obtained approval from the Army Corp of Engineers to complete the Pike Lake Road project and in order to do the wetland filling for Pike Lake Road, a wetland mitigation plan needs to be completed.
