Subject: Archery Range Lease and Road Construction
INTRODUCTION
This agenda item requests review and authorization to execute a lease with the Minnesota
Department of Natural Resources for the Shakopee Archery Range and provides
additional information on the road and parking lot construction costs and options.
BACKGROUND
City Council reviewed a proposed development, maintenance, and operations plan for the
Shakopee Archery Range in earlier this year. At that time, the Council directed staff to
continue working with the DNR to develop a lease agreement based on this plan. In
addition, Stuart Krahn from Bonestroo has completed the roadway design and we have
solicited prices from K.A. Witt for construction of the roadway based on quantity costs ,in
the Huber Park bid.
DISCUSSION
Lease
The general terms of the proposed lease are standard terms for most DNR leases.
Specifics in the lease related to this project are based on the development, operations,
and maintenance plan. Four items that I need to note in the lease are:
1. Lease Fee: No fee.
2. Term: The version you are reviewing was written as a five-year lease, but the DNR
has agreed to a 1 O-year term as identified in the attached email. The final lease will be
revised to reflect a 1 O-year term. (According to the DNR, a 10-year lease is the
maximum term that the DNR is allowed to enter without a significantly more intensive
process that includes the Governor's office.)
3. Renewal: The DNR has a lease renewal process where lease renewals are issued
prior to the expiration of the current term. Paul Purman, DNR Regional Operations
Supervisor, Division of Lands and Minerals, indicated in a phone call on 10/13/06 that
the DNR would provide a letter indicating their intent to renew the lease at the
conclusion of the 1 O-year term.
4. Review by City Attorney: The City Attorney has not yet reviewed the lease and would
need to do so as a condition of approval.
Roadway/Parking Lot Construction
Following completion of the design, the cost for constructing a paved roadway and parking
lot based on Huber Park bid quantities from K.A. Witt is $125,000. Our project budget for
the roadway was $70,000. In order to keep the project within budget, we have identified
the following options:
1. Eliminate the paving and go back to a gravel road.
This would bring the cost down to approximately $70,000. I spoke with Michael Leek and
we don't believe that a gravel road and parking lot is allowed under the City's ordinance. It
would require variance from the City's Board of Adjustment and Appeals, which would
take a few weeks to process and present. I also discussed the maintenance impact from a
gravel road with Mike Hullander.
2. Construct the gravel road base now, and if funding is available in the Huber Park
contingency, pave the roadway next year.
Right now, our Huber Park contingency budget looks OK, but we still have much work to
do on the park that could impact the contingency. This option would require the same
review and approval by the Board of Adjustment and Appeals for the gravel road in the
event that funding is not available next year to pave.
3. Eliminate the concept of a roadway and parking lot all together and use the boat
launch parking lot with an access path to the range.
This option would significantly impact the ability to move ahead with the enhanced range
concept, but at least it would provide the base level shooting range. Archers would need
to walk from the boat launch parking lot to the archery range, so we would need to
construct some type of pedestrian trail. Also, there might be ADA issues with this
approach.
4. Secure additional funding.
None of the partners on this project were able to provide additional funding, so this is not
an option.
After speaking with the partners on the project, we are recommending Option #2. This
would construct a road quality base that could be paved next year if funding permits, or at
some point in the future. In addition, it would ensure that the site is ADA accessible. It
would require a variance from the City's Board of Adjustment and Appeals.
I met with Mike Hullander at the site to review potential maintenance concerns. He feels
that the limited use would not create major maintenance issues for them. A gate would be
installed to control access.

REQUESTED ACTION
If City Council concurs, move to authorize:
1. Appropriate City officials to enter into a1 O-year lease agreement with the Minnesota
Department of Natural Resources for development, operation, and maintenance of the
Shakopee Archery Range, conditioned on review and approval by the City Attorney.
2. Authorize a change order in favor of K. A. Witt in an amount not to exceed $70,000
for the construction of an access, road and parking area for the Shakopee Archery
Range, conditioned on issuance of a variance from the City's Board of Adjustment and
Appeals.

1. PREMISES: The LESSOR in consideration of the terms, conditions and agreements contained herein, and the
payment of the Lease Fee to be paid by the LESSEE, hereby leases to the LESSEE, sUbject at all times to sale,
lease and use for mi.neral or other purposes the following described premises to wit:

Commencing at the Northwest comer of said Section 1; thence on an assumed bearing of North 89~ 49' 04" East

2. TERMS: The terms LESSOR, LESSEE, LESSEE ADDRESS, LEASE FEE, FEE PAYMENT SCHEDULE, TERM,
EFF'ECTIVE DATE, TERMINATION DATE, PURPOSE OF LEASE AND STATUTORY AUTHORITY, use herein
shall be described above and are incorporated herein.
3. LEASE PERIOD: This lease shall be in effect for the TERM, beginning on the EFFECTIVE DATE and ending on
the TERMINATION DATE, unless terminated earlier under provisions of this lease.
4. USE OF PREMISES: LESSEE shall use the Premises only for PURPOSE OF LEASe.
5. LEGAL OBLIGATIONS: This lease is not to be construed to relieve the LESSEE of any obligations imposed by
law.
6. INCUMBRANCE: This lease is subject to all existing easements, right.of-ways, licenses, leases and other
incumbrance upon the Premises and LESSOR shall not be liable to LESSEE for any damages resulting from 'any
action taken by a holder of an interest pursuant to the rights of that holder thereunder.

7. MAINTENANCE: The LESSEE shall maintain the Premises in good repair, Keeping them safe and clean,
removing all refuses and debris that may accumulate: LESSEE shall comply with all laws affecting the Premises,
including local ordinances and state regulations. No timber shall be cut, used, removed or destroyed by the
LESSEE without first obtaining written permission from the LESSOR.
8. TERMINATION: This lease may be terminated at any time by mutual agreement. A lease entered pursuant to
Minn. Stat section 92.50 may be canceled for just cause at anytime by LESSOR upon six months written notice.
LESSEE shall, on the TERMINATION DATE, or earlier as provided for in this lease, p.eacefully and quietly
surrender the Premises to the LESSOR in as good condition and repair as on the EFFECTIVE DATE. If the
LESSEE fails to surrender the Premises on the termination of this lease, the LESSOR may eject or remove the
LESSEE from the Premises and LESSEE shall indemnify the LESSOR for all expenses incurred by the LESSOR.
In addition, LESSEE shall remove all LESSEE'S property from the Premises Upon termination and any property
remaining shall be considered abandoned and shall be disposed of by the LESSOR according to law. If this lease
is terminated prior to the TERMINATION DATE, the LESSEE shall not be relieved of any obligation incurred prior
to termination.
9. HOlDOVER: LESSEE shall pay to the LESSOR a sum equal to the monthly rent plus fifty (50) percent of the
monthly rent for each' month that LESSEE holds the Premises after termination of this lease without authorization
by LESSOR. This sum shall be liql.lidated damages for the wrongful holding over. LESSEE acquires no additional
rights by holding the Premises after termination and shall be subject to legal action for removal.
10. LEASE PAYMENTS: The LESSEE shall pay to the Minnesota State Treasurer through the LESSOR the LEASE
FEE, which is due and payable according to the FEE PAYMENT SCHEDULE. The LESSOR may assess
penalties and interest as provided for by law or in this lease On any payments over thirty (30) days past due.
11. UTILITIES: LESSEE shall pay for all utilities furnished on the Premises for the term of this lease, including
electric, gas, oil, water, sewer and telephone.
12. AL TERA TIONS: The LESSEE shall make no changes, alterations nor improvements to the Premises or to any
structure thereon without the prior written consent of the LESSOR. Any changes, alternations or improvements in
or to the Premises shall be at LESSEE sole expense. '
13. NO WAIVER: No delay on the part of the LESSOR in enforcing any conditions in this lease, including termination
for violation of the terms of this lease, shall operate as a waiver of any of the rights of the LESSOR.
14. TAXES: The LESSEE shall pay, when due, all taxes assessed against or levied upon the Premises or upon the
fixtures, improvements, furnishings, equipment and other personal property of the LESSEE located on the
Premises during the TERM of this lease.
15. LIABILITY: This lease shall not be construed as imposing any liability on the LESSOR for injury or damage to the
person or property ofthe LESSEE or to any other persons or property, arising out of any use of the Premises, or
under any other easement, right-of-way, license, lease or other incumbrance now in effect. The LESSEE shall
indemnify and hOld harmless the LESSOR from all claims arising out ofthe use of the Premises whether such
claims are assertadby civil action or otherwise.
16. NOTICES: Any notice given under this lease shall be in writing and served upon the other party either personally
or by depositing such notice in the United states mail with the proper first class postage and address. Service
shall be effective upon the depositing of the notice in the United States mails. The proper mailing address for the
purposes of serving notice on the LESSOR shall be the Commissioner, Department of Natural Resources, 500
Lafayette Road, St. Paul, Minnesota 55155-4045, and on the LESSEE it shall be as stated in the LESSEE'S
ADD~ESS.

17. TRANSFERS: This lease shall extend to, and bind the successors, heirs, legal representative and assigns of the
LESSOR and LESSEE. In addition, the LESSEE shall not without the LESSOR'S prior written consent: a) assign,
convey, mortgage, pledge, encumber or otherwise transfer this lease or any interest under it; b) allow any
transfer or any lien upon the LESSEE'S interest by operation of law; c) sublet the Premises or any part thereof:
d) permit the use or occupancy of the Premises or any part thereof by anyone other than the lESSEE.
18. PUBLIC RECREATION USE: The LESSEE agrees and understands that the public land leased herein shall be
open to public recreational uses, as defined by M.S. 604A.21 , not inconsistent with the purposes of this lease.

The LESSEE shall.not unreasonably refuse permission to any person to enter upon the lands leased herein for.
reasonable public recreational use without first obtaining the written permission of the LESSOR. If the L.ESSOR
authorizes the prohibition of any public recreational uses, the prohibition shall apply to all persons including the
LESSEE.
19. CONSTRUCTION OF LEASE: If any clause or provision of this lease is or becomes illegal. invalid or
unenforceable because of present or future laws or any rule or regulation of any governmental body. the
intentions of the lESSOR and LESSEE here is that the remaining parts of this lease shall not be affected thereby.
20. ADDITIONAL TERMS:
A. Exhibit A. which is made a part of t~is lease, is a development and operating plan that has been reviewed and
approved by the Lessor.
B. Safe operation of the range is the exclusive responsibility of the Lessee.
C. Lessee agrees that the use of the premises is limited to archery. Other usages of the premises may be
authorize by the Lessor upon written request from Lessee.
D. The range is located within the Minnesota River flood plain. Lessee understands that structures are
not permitted within the flood plain with the exception of open sided structures. such as a small shelter/
picnic pavilion as shown on Exhibit B-Concept Plan which is made a part of this lease. The shelter/picnic
pavilion may include a concrete base. Lessee may construct a portable restroom enclosure.
E. Lessee shall post signs to a maximum of 100 feet apart on the boundary of the leased area warning people of
the shooting range.
F. lessee shall have the right to construct a gate across the approach so as to control and or deny vehicular
traffic on the leased area.

Shakopee Archery Range Development, Opera~ion and
Maintenance Plan - July 2006
Overview
In 2002, the City removed an e?<isting archery range from Lions Park in Shako pee due to safety
concerns and potential conflicts with other park users. Since thattime, we have been working
with local archers to find an appropriate location to relocate the range. to identify funding for
development, and to determine ongoing operational responsibilities.
Range Location
After an analysis of available sites within Shakopee, the range is proposed to be developed on
the north side of the Minnesota River west of CSAH 101 in the location of the former baseball
stadium site. This land is owned by the'DNR's Division of Wildlife. The DNR is agreeable to the
site as a location.
Range Design
The range would be developed in two phases (see attached):
Phase 1 : Standard Range/Pilot Program
The standard range would qonsist of 5-10 traditional straight line static targets
located at varying distances. It is anticipated that the standard range would be
operational by September 2006 and would serve as a pilot program to fully
assess the use and needs and establish funding for Phase 2.
Phase 2: Enhanced Range
Phase 2 of this project would involve expansion of the range into an enhanced
range that would provide additional opportunities for youth, families, and adults.
In addition to the static targets, the enhanced range would provide three-
dimensional targets, separate youth and adult shooting areas. and support
facilities like picnic tables.
Access to the range would come from a new Minnesota River boat launch access road that the
City is constructing on the east side of CSAH 101. The boat launch is being constructed on
property owned by the U.S. Fish and Wildlife under an easement from the U.S. Fish and
Wildlife. According to U.S,. Fish and Wildlife. this easement will allow access to the archery
range (see attached).
Range Construction and Development
Construction of the range would consist of efforts by both the City and its Range Partners:
City: Design and construction of the access road.
Range Pa.rtners Site clearing. (Completed in Spring/Summer 2006)
Site preparation.
Construction of gravel access paths and shooting pads.
Target installation and construction of shooting platforms.
Construction of shelter and restroom enclosures.
Turf establishment and site restoration.

Funding for development would come from a combination of City funds, private donations, DNR
matching funds, and contributions from Arrow Sport.

From what I remember at our July 6th meeting a final decision wasn't made as to what Term the Division of
Wildlife would prefer (LAM is steering away from 10 year leases). Therefore, the term of the lease could be 1
year, 2 year, or 5 year.
Once I receive notice on the length of lease Wildlife prefers & final maps from Jason I will proceed forward in
finalizing the Lease Transaction Request and forward it onto Jean Zoch for processing.

Subject: Clarification on Agenda Item 5.004. Aquatic Park Improvements
I omitted some discussion on this agenda item in my staff report, and was wondering if you
could forward to the Council?

The additional project improvements proposed for the Aquatic Park and proposed to be funded
from the building fund. Mr. Voxland pointed out that Council may want to determine whether
these items should be considered part of the building project, or really are separate projects
that should be funded from some other source. The Mayor also questioned whether the fence
and diving board are really maintenance items and should be paid from the operating budget.
Proposed Building Project Budget Items:
Picnic Tables and Bike Racks
Concession Equipment
Fire/Security Alarm
Hazardous Material Removal
4" Water Line Stub
Optional Project Improvements
Fence Replacement: Building or? (some of the fence will be demo'd during construction)
Diving Board: ?
Shade Structures: ?
Sand Play Equipment: ?
Council isn't being requested to make a final decision on the "optional" improvements now.
However, if you do not desire these improvements, then there is no need to do any more work
on them.
