by the Shakopee Mdewakanton Sioux Community

INTRODUCTION:
The Shakopee Mdewakanton Sioux Community applied for a grading permit on Friday,
September 29, 2006 to excavate portions of the Blue Lake Channel within the City of
Shakopee. The Blue Lake Channel flows from County Road 83 (Canterbury Road), just
South of Valley View Road, to the Prior Lake Outlet Channel. This agenda item is to
discuss their grading permit application and what conditions should be placed on the
grading permit.
BACKGROUND:
A grading permit has been applied for by the Shakopee Mdewakanton Sioux Community
(SMSC) for portions of the Blue Lake Channel that is in fee status between County Road
83 and McKenna Road within the City of Shakopee (see the attached drawings). The
SMSC is proposing to gra~e the channel to provide a more defined conveyance system
and to grade two storm water basins to provide treatment of storm water flowing on to
their property from the South and West of County Road 83. Thus, a grading permit is
required under Chapter 11, of the City Code. A grading permit with proposed plans has
been given to staffto review.
After review of the grading permit, it is anticipated the SMSC would want to maintain
these ponds on their land and not grant an easement to the City of Shakopee for pond
maintenance. The question for Council, is this an acceptable policy and arrangement.
Staff believes that the SMSC, who has their own Public Works Department, C~
adequately maintain these ponds and does not see the need for requiring easements on
ponds in this area. However, it should be acknowledged by the SMSC that they will want
to maintain the ponds in this area.
Staff has prepared a grading permit approval with conditions, which are attached to this
memorandum. Council may wish to discuss the various issues and provide direction to
staff for more information or provide additional conditions to the permit.
ALTERNATIVES:
1. Approve a motion approving a grading permit for the SMSC, with conditions as
outlined by staff.
2. Approve a motion approving a grading permit for the SMSC, with conditions as
outlined by staff and as modified by the City Council.
3. Do not approve this grading permit at this time.
4. Table for additional information.
RECOMMENDATION:
The recommendation would be either to approve a permit with conditions, or table for
additional information, or additional meetings with City staff/City representatives with
the SMSC prior to issuing the permit.
ACTION REQUESTED:
Move to approve a. motion to approve a grading permit for the Shakopee Mdewakanton
Sioux Community, with conditions.

On September 29, 2006, the City of Shakopee received a grading permit application proposing to
excavate portions of the Blue Lake Channel within the City of Shakopee. The Blue Lake Channel
flows from County Road 83 (Canterbury Road), just South of Valley View Road, to the Prior Lake
Outlet Channel, just East of Pike Lake Road.
In October 2004, the City of Shakopee approved a grading permit for the East Village Subdivision
located East of McKenna Road. One component of this grading proposal included the improvement
of the Blue Lake Channel within the site. The more recent plan proposes channel improvements
West of this site to County Road 83 (Canterbury Road).
Although there still remain issues to be resolved, the City, the Shakopee Mdewakanton Sioux
Community, the Prior Lake - Spring Lake Watershed District and the County is working towards
resolving them.
On October 17, 2006, the City Council may choose to approve this grading permit application. If
this permit is approved, I suggest the following supplemental conditions be attached to the permit:
. The applicant shall agree to hold the City of Shakopee harmless for any claims arising out of
the City issuing the grading permit without approval of a preliminary plat or a final plat.
. The applicant shall assume all maintenance responsibilities associated with the proposed
channel improvements.
. In the future, should the Shakopee Mdewakanton Sioux Community submit a grading plan
for development of any property tributary to the Blue Lake Channel, the applicant shall be
required to meet the City's storm water management plan rate restriction of 0.1 cfs per acre
or obtain approval from the Prior Lake - Spring Lake Watershed District for flow rates
above the City's requirements or provide the City with information identifying areas where
flow reduction in Mdewakanton Sioux Community property within the Blue Lake Watershed
can be accomplished to meet the intent of the City's overall storm water management plan.
. The applicant shall obtain all necessary Prior Lake - Spring Lake Watershed District permits
and/or approvals.
. The applicant shall provide a copy of the site's NPDES permit.

. All work done within the City of Shakopee right-of-way or the Scott County right-of-way
shall require a right-of-way permit. Please contact the City/County engineering departments
for details.
. The applicant shall provide a wetland delineation report, a wetland replacement plan (if
applicable) and a certificate of no loss/exemption.
. All erosion control items shall be furnished and installed by the applicant and accepted by
the City of Shakopee prior to construction. The applicant shall contact the City of Shakopee
engineering department to arrange an inspection.
. All erosion control measures shall be routinely inspected by the applicant and replaced as
necessary or as directed by the City of Shakopee.
. County Road 83 (Canterbury Road) and McKenna Road shall be kept free of any offsite
sediments tracking. The installation of a rock construction entrance shall be required.
. The applicant shall maintain dust control operations onsite for the haul roads throughout the
grading permit process until final completion.
. The applicant shall place six (6) inches of topsoil over all land disturbed. Exposed soil shall
be seeded and mulched in accordance with NPDES requirements.
. The applicant shall contact the City of Shakopee engineering department twenty-four (24)
hours in advance of all proposed land disturbing activity.
. The applicant shall address all outstanding engineering/planning/natural resource issues.

Grading Permit Application
Based on a review of the application materials provided, staff has the following
conditions for approval:
1. The applicant seed the disturbed areas with a native seed mixture.
2. The applicant install erosion control on the upstream side of the sediment trapping
forebay at station 21 +00 to prevent erosion of the spillway.
3. The applicant shall provide six inches of topsoil for the establishment of turf and
plantings. The soil composition should be similar to the MnDOT topsoil borrow
req uirements.
4. Compliance with the Woodland and Tree Management Ordinance and plant
replacement tree species consistent with the 2006 City of Shakopee TreePlanting
Guidelines.
5. The applicant contact the Natural Resource Specialist at 952-233-9510 to discuss
options for natural resource corridor connections through the project area. The area
is identified on the Shakopee Natural Resource Corridor map as a potential
connection and the creation of buffers adjacent to the channel may provide the
naturally vegetated connection from County Road 83 to McKenna Road.
