No. 6517 s. {3. ~I CITY OF SHAKOPEE Memorandum CONSENT TO: Mayor & City Council Mark McNeill, City Administrator Bruce Loney, Public Works Director , FROM: SUBJECT: Approval of the Wetland Conservation Act Application for the Prior Lake Outlet Channel Project (Segment 5C) DATE: October 17, 2006 INTRODUCTION: The City of Shakopee received a joint application form for water/wetland projects for the proposed restoration/improvement of Segment 5C of the Prior Lake Outlet Channel. The site is located on City park land North of County Road 16 (Eagle Creek Boulevard), between the future extension of Pike Lake Road and Dean Lake. The City of Shakopee received the joint application from the Prior Lake - Spring Lake Watershed District (PLSLWD). Staff along with a Technical Evaluation Panel (TEP) has reviewed the application. Staff has determined the requirements of the Wetland Conservation Act(WCA) have been met by this plan. Attached for Council consideration is Resolution No. 6517, a resolution approving the Wetland Conservation Act Application for the Prior Lake Outlet Channel Project (Segment 5C). I BACKGROUND: The Wetland Conservation Act Application for the Prior Lake Outlet Channel Project (Segment 5C), as proposed by the applicant, would excavate approximately 1.02 acres of wetland within and adjacent to the existing Prior Lake Outlet Channel in the area. The proposed channel restoration/improvement involves modification of the existing alignment in order to provide additional meanders, re-grading of side-slopes to address several erosion concerns, utilization of bioengineering techniques to permanently Btabilize the \/hanncl bottom, excavation of an open water area to improve water quality and wildlife habitat and the replacement of several culvert crossings. The proposed project would result in a net increase in channel surface area of approximately 6,050 square feet due to added meanders. Please see the attached letter and drawings from Shannon Lotthammer from the PLSL WD. The City performed a site visit and requested a review of the plan by the following entities: a representative from the Soil and Water Conservation District (SWCD), a representative from the Board of Soil and Water Resources (BWSR), a representative from the Minnesota Pollution Control Agency (MPCA), a representative from the Lower Minnesota River Watershed District (LMRWD), a representative from the Department of Natural Resources (DNR) and a representative from the U.S. Army Corps of Engineers (USACOE). A seventeen (17) day comment period ending on Friday, October 13, 2006 was allowed. The minimum allowable comment period, per the WCA, is fifteen (15) days. No written comments were received from the aforementioned entities. However, two verbal approvals from the SWCD and the LMRWD were received. City staff considers the WCA application complete. Staff has thoroughly reviewed the proposal and is recommending approval. AL TERNATIVES: 1. Adopt Resolution No. 6517. 2. Deny Resolution No. 6517. 3. Table for additional information from staff. RECOMMENDATION: Staff recommends Alternative No.1. Rule 8420.0230 have been mailed notice of the proposed Wetland Conservation Act Application; and WHEREAS, the City of Shakopee, acting in their role as the Local Governing Unit, has reviewed the proposed Wetland Conservation Act Application and considered the public values, location, size and type of wetland being altered and recommended approval of the Wetland Conservation Act Application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. Based on the replacement standards in Minn. Rules Parts 8420.0630, and on the recommendation of City staff and Technical Evaluation Panel Members, the Wetland Conservation Act Application is hereby approved. 2. Approval of the Wetland Conservation Act Application shall become effective upon its adoption. 3. A copy of this decision shall be mailed to all interested parties and to the applicant. This project involves: 1) modifying the channel to create stream meanders; 2) creating a riffle/pool stream structure; and 3) excavating an open water area on the east end of the site to break up the monotypic reed canary grass vegetation, improve wildlife habitat and enhance water quality. The only new fill being proposed is the placement of rock to create 12 riffles along the stream. In addition, material excavated from the open water area will be used to fill in the "old" channel once the meanders are created. The end result of the project will be decreased erosion potential along the channel banks, increased streambank and in-stream habitat, improved wetland plant diversity, and increased water quality protection.
