Establish a Public Hearing for the
17th Avenue Improvements, Project No. 2006-1

INTRODUCTION:
Attached is Resolution No. 6515, a resolution declaring the costs to be assessed, ordering
the preparation of proposed assessments and setting a public hearing date for the 1 ih
Avenue Improvements, Project No. 2006-1.
BACKGROUND:
On May 16, 2006, City Council adopted Resolution No. 6425, approving the plans and
specifications and ordering the advertisement for bids for the 1 ih A venue Improvements,
Project No. 2006-1. On June 20, 2006, City Council adopted Resolution No. 6444, a
resolution Which accepts the bids and awards the contract for the 1 ih Avenue
Improvements Project' The improvements have essentially been completed with the final
costs for construction at $1,515,415.80 and final costs for right-of-way estimated at
$651,555.09. The total costs associated with administration, financing and engineering
for the project is $273,787.79. The attached resolution shows how these costs are being
paid and the total cost to be assessed. Project financing sources include the City of
Shakopee, Scott County, Shakopee Public Utilities Commission and assessments to the
benefiting properties. From the feasibility report to the project completion, the funding
summary is as follows:

Lower project costs are a result of eliminating the trunk watermain and the turn lanes on
the north side of 17th Avenue. Prior to the project, Scott County signed a cooperative
agreement with the City agreeing to pay $1,300,000.00 for the project. If City and
County costs exceeded $1,300,000.00, the City would be responsible for picking up the
additional cost. The total project costs for the City and the County equal $1,101,419.61.
As a result, the City will receive $198,580.39 from the County to put in our State
Aid/Street account to be spent on future street projects.
ALTERNATIVES:
1. Adopt Resolution No. 6515.
2. Deny Resolution No. 6515.
3. Adopt Resolution No. 6515, with Council modifications.
4. Table for additional information.
RECOMMENDATION:
Staffrecornrnends Alternative No. 1, to adopt Resolution No. 6515, declaring the cost to
be assessed and ordering the preparation of proposed assessments for the 17th Avenue
Improvements, Project No. 2006-1, with a public hearing to be held on November 21,
2006, if Resolution No. 6515 is approved.
ACTION REQUESTED:
Offer Resolution No. 6515, A Resolution Declaring the Costs to be Assessed and
Ordering the Preparation of Proposed Assessments for the 1 ih A venue Improvements,
Project No. 2006-1 and move its adoption.

RESOLUTION NO. 6515
A Resolution
Declaring The Costs To Be Assessed
And Ordering the Preparation Of Proposed Assessments
For The 17TH Avenue Improvements
Project No. 2006-1
WHEREAS, a contract has been let for the construction of the 1 ih Avenue
Improvements, as described in the feasibility report, and the contract price for such
improvements was $1,521,526.85, and the final contract price for such improvement is
$1,515,415.80, and the expenses incurred or to be incurred in the making of such
improvement amounts to $925,342.88, so that the total cost of the improvements will be
$2,440,758.67. Of this cost the City of Shakopee will pay $-0-, Scott County will pay
$1,101,419.61 and Shakopee Public Utilities Commission will pay $6,659.59.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA:
1. The cost of such improvement to be specially assessed is hereby declared to
be $1,332,679.47.
2. The City Clerk, with the assistance of the City Engineer, shall forthwith
calculate the proper amount to be specially assessed for such improvement against every
assessable lot, piece, or parcel of land within the district affected, without regard to cash
valuation, as provided by law, and keep a copy of such proposed assessment in her office
for public inspection.
3. That the City Clerk shall, upon the completion of such proposed assessment,
notify the City Council thereof.
BE IT FURTHER RESOLVED:
1. That a hearing shall be held on the 21st day of November, 2006, in the
Council Chambers of City Hall at 7:00 P.M. or thereafter, to pass upon such proposed
assessments and at such time and place all persons owning property affected by such
improvements and proposed assessments will be given an opportunity to be heard with
reference to such assessment.
2. That the City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper of the City of
Shakopee at least two weeks prior to the hearing and she shall state in the notice the total
cost of the improvements. She also shall cause mailed notice of such hearing to be given
to the owner of each parcel described in the aS,sessment roll not less than two weeks prior
to the hearing.
