SUBJECT: Declaring a Cost to be Assessed and Establish a
Public hearing for the 2006 Street Reconstruction and
Tahpah Park Redevelopment, Project No. 2006-2

INTRODUCTION:
Attached is Resolution No. 6505, a resolution declaring the costs to be assessed, ordering
the preparation of proposed assessments and setting a public hearing date for the 2006
Street Reconstruction and Tahpah Park Redevelopment, Project No. 2006-2.
BACKGROUND:
On March 21, 2006, City Council adopted Resolution No. 6386, approving the plans and
specifications and ordering the advertisement for bids for the 2006 Street Reconstruction
and Tahpah Park Redevelopment, Project No. 2006-2. On May 2, 2006, City Council
adopted Resolution No. 6413, a resolution which accepts the bids and awards a contract
for the project. The improvements associated with the 2006 Street Reconstruction have
essentially been completed with the final costs for construction at $2,266,212.18,
The total costs associated with administration, financing and engineering for the street
reconstruction portion ofthe project is $277,157.98.
The attached resolution shows how the costs are being paid and the total cost to be
assessed. Project funding sources include the City of Shakopee, Shakopee Public
Utilities Commission (SPUC) and assessments to the benefiting properties. Using the
proposed method of assessments, six (6) residential lots have assessments over
$6,000.00. Based on benefit assessments performed in other communities, staff
recommends capping residential lot assessments at. $6,000.00. Capping the assessment
will result in the City picking up an additional $7,206.01 in project costs. If we do not
cap the assessments, we run the risk of losing assessment appeals. The number contained
in the attached resolution was calculated with capped assessments of $6,000.00 per lot. If
Council does not wish to cap the assessments at $6,000.00, then the amount in Resolution
No. 6505 to be assessed should be changed to $582,972.65. From the feasibility report to
the project completion, the funding summary associated with the street reconstruction
portion of the project is as follows:

1. Adopt Resolution No. 6505.

RECOMMENDATION:
Staff recommends Alternative No.1, to adopt Resolution No. 6505, declaring the cost to
be assessed and ordering the preparation of proposed assessments for the 2006 Street
Reconstruction and Tahpah Park Improvements, Project No. 2006-2, with a public
hearing to be held on November 8, 2006, if Resolution No. 6505 is approved.
ACTION REQUESTED:
Offer Resolution No. 6505, A Resolution Declaring the Costs to be Assessed and
Ordering the Preparation of Proposed Assessments for the 2006 Street Reconstruction
and Tahpah Park Improvements, Project No. 2006-2, and move its adoption.

A Resolution
Declaring The Costs To Be Assessed
And Ordering the Preparation Of Proposed Assessments
For The 2006 Street Reconstruction
And Tahpah Park Redevelopment
Project No. 2006-2
WHEREAS, a contract has been let for the construction of the 2006 Street
Reconstruction and Tahpah Park Redevleopment, as described in the feasibility report,
and the contract price for such improvements was $3,611,611.15, and the final contract
price for the improvements associated with the street reconstruction portion of the project
is $2,266,212.18, and the expenses incurred or to be incurred in the making of such
improvement amounts to $277,157.98, so that the total cost of the improvements for the
improvements associated with the street reconstruction portion of the project will be
$2,543,370.16. Of this cost the City of Shakopee will pay $1,609,109.08 and Shakopee
Public Utilities Commission will pay $358,494.44.
NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF
THE CITY OF SHAKO PEE, MINNESOTA:
1. The cost of such improvement to be specially assessed is hereby declared to
be $575,766.64.
2. The City Clerk, with the assistance of the City Engineer, shall forthwith
calculate the proper amount to be specially assessed for such improvement against every
assessable lot, piece, or parcel of land within the district affected, without regard to cash
valuation, as provided by law, and keep a copy of such proposed assessment in her office
for public inspection.
3. That the City Clerk shall, upon the completion of such proposed assessment,
notify the City Council thereof.
BE IT FURTHER RESOLVED:
1. That a hearing shall be held on the 8th day of November, 2006, in the Council
Chambers of City Hall at 7:00 P.M. or thereafter, to pass upon such proposed
assessments and at such time and place all persons owning property affected by such
improvements and proposed assessments will be given an opportunity to be heard with
reference to such assessment.
2. That the City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper of the City of
Shakopee at least two weeks prior to the hearing and she shall state in the notice the. total
cost ofthe improvements. She also shall cause mailed notice of such hearing to be given

to the owner of each parcel described in the assessment roll not less than two weeks prior
to the hearing.
