INTRODUCTION
Ryan Companies has made application for vacation of easement located within Dean Lakes
4th Addition. Please see Exhibit A for location. The easement vacation is requested in
connection with a request for approval of a Registered Land Survey (RLS). The City
Council recently approved the RLS subject to conditions. The RLS and vacation are being
sought in order to reconfigure lot lines for the construction of a new facility within the
proj ect area.
DISCUSSION
The Planning Commission has reviewed this request and has recommended approval of the
vacation by a 7-0 vote. Attached for your information is a copy of the Planning
Commission report from the September 21, 2006, Planning Commission meeting.
ALTERNATIVES
1. Approve Resolution No. 6502, a resolution of the City of Shakopee approving
the vacation of easement in Dean Lakes 4th Addition.
2. Deny the proposed vacation.
3. Continue the public hearing.
4. Close the public hearing and table the requestto allow staff or the applicant time
to provide additional information.
ACTION REQUESTED
Offer a motion to approve Resolution No. 6502, and move its adoption.

RESOLUTION NO. 6502
A RESOLUTION OF THE CITY OF SHAKOPEE VACATING
EASEMENT WITHIN DEAN LAKES 4TH ADDITION
WHEREAS, it has been made to appear to the Shakopee City Council that easements
located within Dean Lakes 4th Addition serves no public use or interest; and
WHEREAS, the easement to be vacated is legally described as:
The drainage and utility easements lying 5 feet on both sides of the common lot lines of
Lots 2 and 3, and Lots 3 and 4, Block 1, as dedicated in Dean Lakes Fourth Addition according to
the recorded plat thereof, Scott County, Minnesota, EXCEPTING the northern 60 feet and the
southern 10 feet; and
WHEREAS, a public hearing to consider the action to vacate was held in the Council
Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the 3rd day of October, 2006;
and
WHEREAS, two weeks published notice was given in the SHAKOPEE V ALLEY NEWS
and posted notice was given by posting such notice on the bulletin board on the main floor of the
Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the
Shakopee Public Library, and the bulletin board in the Shakopee City Hall; and
WHEREAS, all persons desiring to be heard on the matter were given an opportunity to be
heard at the public hearing in the Council Chambers in the City of Shakopee.
NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
That it finds and determines that the vacation hereinafter described is in the public interest;
That the easement described above serves no further public purpose;
That the easement described above is hereby vacated subject to the following conditions:
1. Approval shall be contingent upon the applicant of the concurrent RLS
application dedicating drainage and utility easements as requested by the City of
Shakopee.
2. All other easements are to be retained by their respective entities.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with
the County Auditor and County Recorder of Scott County.

SITE INFORMATION:
Applicant: Ryan Companies
Location: Dean Lakes 4th Addition (south of Highway 169 and east ofCSAH 83 (see
Exhibit A)
INTRODUCTION
Ryan Companies has made application for a vacation of easement located in Dean Lakes 4th
Addition. The easement was recorded at the time of recording of the plat of Dean Lakes 4th. The
vacation is requested in connection with an application for a Registered Land Survey (RLS) to
relocate some lot lines within Dean Lakes 4th Addition. The easements requested for vacation are
currently located on lot lines that are proposed to be relocated with the RLS. The RLS proposes to
dedicate new easements along the relocated lot lines. Please see Exhibit A for general location and
Exhibit B for easements proposed for vacation.
Other departments and agencies have had an opportunity to review and comment on the proposed
vacation. Please fmd attached as Exhibit C, a copy of the comments provided by the Engineering
Department.
CONSIDERATIONS
The City Council will hold a public hearing on Tuesday, October 3, 2006 to consider this vacation
request. A recommendation from the Planning Commission is required for the vacation process.
Staffhas received no adverse comments relative to the vacation request.
ALTERNATIVES
1. Recommend to the City Council the approval of the vacation, as presented.
2. Recommend to the City Council the approval of the vacation subject to conditions.
3. Recommend to the City Council denial of the request.
4. Table the decision to allow staff or the applicant time to provide additional information.
STAFF RECOMMENDATION
Staff recommends Alternative No. 1 recommend to the City Council approval of the vacation of
easement, as presented and subject to the followipg conditions:

DATE: September 8, 2006
The application indicates a request to vacate drainage and utility easements within the Dean
Lakes 4th Addition along the conunon lot lines between Lots 2 and 3 of Block 1 and between
Lots 3 and 4 of Block 1. The proposal coincides with a Registered Land Survey (RLS)
application (case number 06080) to acconunodate a specific user.
After reviewing the above referenced application, the engineering department has the following
conunents for the applicant and the planning department: '
1. Approval shall be contingent upon the applicant of the concurrent RLS application
referenced above dedicating drainage and utility easements as requested by the City of
Shakopee.
2. All other easements are to be retained by their respective entities.
Recommendation
Engineering staff recommends approval of the vacation of easement request subject to the
conditions above being addressed by the applicant.
