SUBJECT: Memorandum of Understanding
INTRODUCTION
The Police Department is requesting that Council consider and authorize the appropriate
city officials to enter into a memorandum of understanding between the City of Shakopee
and Law Enforcement Labor Services, for compensation of an Acting Sergeant.
BACKGROUND
I have conferred with the City Administrator about the need for the opportunity to assign
acting sergeants, in the absence of a police chief, deputy chief or a sergeant. The
assignment by the employer to the acting sergeant position allows the city to designate
the leader during the absence of the police chief, deputy chief, or a sergeant. Since that
meeting the City and the union representing the police sergeants have reached an
agreement of one dollar and twenty-five cents ($1.25) an hour for this assignment.
The proposed memorandum of understanding was prepared by Cy Smythe of Labor
Relations Associates, to enable this assignment and compensation.
RECOMMENDATION
Staffrecornrnends the Council approve the attached memorandum of understanding
between the City of Shakopee and Law Enforcement Labor Services.
ACTION REQUESTED
If Council concurs, they should by motion, authorize the appropriate city officials to enter
into the memorandum of understanding between the City of Shakopee and Law
Enforcement Labor Services forthe acting sergeant position, assignment and
compensation.

SUBJECT: Acting Sergeant
I am writing to request the ability to assign acting sergeants in the absence of the police chief, deputy
chief, or a sergeant. The acting sergeant would have the same responsibility and authority as the
current sergeants. During this time period, the acting sergeant would be compensated at a rate to be
determined between the sergeant's union and the City.
As you know, the current labor agreement has the following article:
Article XXVII. Premium Pay
When no supervisor, such as the police chief, deputy chief or a sergeant is working, but two or
more officers are working for a period of two hours or more, the senior officer is in charge and
responsible for the maintenance ofthose standards and procedures necessary for the department
to function properly. Being in charge for two hours or more will then qualify the senior officer
for premium pay of one dollar and twenty cents per hour ($1.20).
There are many times where the senior officer is more than capable to act as an acting sergeant.
However, that is not always the case. The proposed acting sergeant assignment would allow the City to
select the leadership when the chief, deputy chief or a sergeant is unavailable.
Attached is a proposed memorandum of understanding that was prepared by Cy Smythe of Labor
Relations Associates, to enable this assignment and compensation to be negotiated. Sergeant Bob
Forberg appears to be in favor of the concept. However, the exact dollar amounthas not yet been
determined.
