INTRODUCTION:
By letter dated March 22, 2004, Ryan Companies US, Inc., the contractor and developer
of Dean Lakes development has requested that City Code Sec. 10.60, Noise Elimination
and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, be
suspended for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Ryan Companies US, Inc. is requesting a suspension on the hours as follows:
Saturday 8:00 A.M. to 7:00 P.M.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion ofthe City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News. Staff
would point out that this Proj ect is near T .H. 169 and Dean Lake. The earlier start time is
being requested in order to complete the work as quickly as possible and to meet the
developer's schedule. The City of Shakopee has allowed an earlier start on several
projects if resident complaints can be minimized, and in order to complete the work
earlier.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, HourlyRestrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice ofthe suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

Dear Mr. Loney,
Thank you for your letter dated March 17, 2004 in regards to Ryan Companies and our
subcontractors request for extension of working hours on Monday through Friday and on
Saturdays. BothArcon and Bolander will utilize the working hour extension from 7:00 PM to
sunSet on Monday through Friday as we near the turnover dates for both the 429 Public
Improvements and Ryland Home Development.
I would like to amend my March 12 letter and petition for an 8:00 AM start on Saturdays. Please
amend my request for petition to yourself and City Council and I look forward to' seeing you at
the City Council Meeting on April 6th.
