CITY OF SHAKO PEE Memorandum TO: Mayor & City Council CONSENT Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Recognition of Prior Lake -Spring Lake Watershed District as the RGU for an Environmental Assessment Worksheet for the Outlet and Channel Improvement Project, from Prior Lake to the Minnesota River DATE: April 6, 2004 INTRODUCTION: Attached is a letter from Shannon Lotthammer, District Administrator with the Prior Lake-Spring Lake Watershed District (PLSLWD), requesting that the City of Shakopee formally recognizes the PLSL WD as the Responsible Government Unit (RGU) for an Environmental Assessment Worksheet (EA W) for the Prior Lake Outlet and Channel Improvement Project, from Prior Lake to the Minnesota River. BACKGROUND: The City of Shakopee and the PLSL WD have been meeting for over three years to revise the Joint Powers Agreement for the improvement and upgrading of the Prior Lake outlet channel, from Prior Lake to the Minnesota River. Part of this channel does transverse to the City of Shakopee, from approximately Pike Lake Trail to the Minnesota River. Previously, the City of Shakopee did conduct an EA W for the Blue Lake Watershed channel, which includes much of the City of Shakopee to the Minnesota River. The City Council, on March 6, 2002, adopted Resolution No. 5656, a resolution adopting findings and conclusions and making a negative declaration that there is no need for a environmental and impact statement for the Blue Lake Watershed drainage improvement project. The PLSL WD would like to prepare an EA W for channel improvements, from the Prior Lake outlet to the Minnesota River. In this EA W, which involves the PLSL WD, the City of Prior Lake and the City of Shakopee, the watershed district is requesting that the City of Shakopee formally recognize that the watershed district would be the RGU for this EAW. In review of this request from the watershed district, staff does not have any objections for the watershed district being the RGU for this EA W. Attached also is an e-mail from Jon Larson, of the EQB, stating that having PLSLWD as the RGU is a good approach in this project. Staff believes that the district will work closely with the City of Shakopee and the City of Prior Lake in development of this EA W, as they have currently shown in developing plans for the upgrading of this channel. Staff also recognizes that a revised Joint Powers Agreement will be needed for the ultimate construction of any channel improvements and cost sharing of these channel improvements and maintenance operations. Since the City of Shakopee has already conducted an EA W on the Blue Lake Watershed, which did encompass part of the Prior Lake outlet channel, the City of Shakopee will not have to contribute to a cost share of this outlet system EAW. The watershed district representative also has offered to update the City Council on the outlet and channel project when appropriate. Staff believes the appropriate time for this update would be when the EA W has been completed by the watershed district. This presentation can update the Council on the outlet channel project and where the revised Joint Powers Agreement is currently at. ALTERNATIVES: 1. Approve a motion, formally recognizing the PLSL WD as the RGU for the development of an EA W for the outlet and channel improvement project, from Prior Lake to the Minnesota River. 2. Do not approve a motion recognizing the PLSL WD at this time. 3. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1, for reasons stated in the memo. The watershed district seems to be well positioned to be the RGU under the circumstances, as having the greatest responsibility to permit or approve the project overall, and as sponsor of the project. It is within your authority and initiative to order an EAW to. be prepared. The other potential RGUs would have to object to your assignment as RGU (object directly to the EQB) for this to be an issue. Only one EAW is prepared for a project and is prepared by the RGU that takes the initiative or has the duty to prepare it. Soliciting agreement from other affected jurisdictions seems like a good idea. Your approach appears sound. Other jurisdictions could also be termed "cooperating" RGUs if they are also participating in the preparation of the EAW or could be "co- lead agencies" if necessary. Your approach sounds the simplest under the circumstances.
