I 5.13.3 , CITY OF SHAKOPEE Memorandum TO: Mayor & City Council CONSE~Jr Mark McNeill, City Administrator FROM: Joe Swentek, Project Engineer SUBJECT: Encroachment into a Deed Restricted Easement (Lot 68, Block I - Riverside Fields 4th Addition - 1773 Switchgrass Circle) DATE: April18,2006 INTRODUCTION: The property owner at the above referenced address has requested permission from the City of Shakopee to place a fence within drainage and utility easements adjacent to the side lot lines, easements upon which deed restrictions have been recorded. Please see the attached letter form Brent Obert dated April 6, 2006. As per advice from the City's attorney, this is permissible since the deed restriction runs in favor of the City of Shakopee, and could be accomplished by entering into a consent to encroach agreement that would be recorded against the property and approved by the City of Shakopee. Attached for Council consideration is Resolution No. 6408, a resolution authorizing City staff to enter into a consent to encroach agreement. BACKGROUND: Deed restrictions were established in an attempt to eliminate the encroachment of fences and structures into drainage and utility easements. These encroachments often times led to the obstruction of access for maintenance purposes and occasionally the alteration of drainage patterns. fuitiaIly, the restrictions were placed upon all drainage and utility easements of a lot if adjacent to a public utility, which is the case here. However, as the process evolved, specific easements containing these public utilities were described and restrictions placed upon just them so as to eliminate unnecessary encumbrances. Research of this property shows only a public storm sewer lateral aligned along the rear property line. Please see the attached drawing. Under the new process, deed restrictions would not have been required on the drainage and utility easements adjacent to the side lot lines. VISIONING RELATIONSHIP This action supports Goal F: "Housekeeping Item". ALTERNATIVES: 1. Adopt Resolution No. 6408. 2. Deny Resolution No. 6408. 3. Table for additional information from staff. RECOMMENDATION: Staff recommends Alternative No.1. Dear Joe Swentek, My name is Brent Obert. I have entered into a purchase agreement along with my wife Lisa Obert to purchase the property located at 1773 Switchgrass Circle from Centex Homes. By means of this letter, I am requesting approval for the encroachment into utility easements located adjacent to my side lot lines for the purpose of constructing a fence along my side property lines in my backyard. I understand that there are utilities installed in the utility easement at the rear of my property; so my proposed fence will not encroach into this 10' rear easement Based on my research, there are no utilities currently located or planned for the future in the area where I'm proposing to build a fence. RESOLUTION 6408 A Resolution Approving City staff to Enter into a Consent to Encroach Agreement with 1773 Switchgrass Circle (Lot 68, Block 1 of Riverside Fields 4th Addition) WHEREAS, the City has received a request by the property owner at 1773 Switchgrass Circle to encroach into the drainage and utility easements adjacent to the side lot lines, easements upon which deed restrictions have been recorded; and WHEREAS, the City of Shakopee has determined that the proposed encroachments will not adversely affect access for maintenance or alter drainage patterns; and WHEREAS, the City of Shakopee, under a new policy for requiring deed restrictions, would not have required they be placed upon drainage and utility easements adjacent to the side lot lines ofthis property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. Based on the recommendation of City of Shakopee staff, the authorization is hereby approved. 2. Approval of the authorization shall become effective upon its adoption. 3. A copy of this decision shall be mailed to all interested parties.
