INTRODUCTION:
At its March 16th meeting, the Council directed staff to prepare a resolution upholding the
appeal of G. Leonard West/Magnum Contracting ofthe method of calculating permit fees for
re-roofing oftownhouse buildings. The attached resolution is adopted for Council
consideration and action. The further direction to amend the fee schedule is addressed in City
Clerk Judy Cox's memo on fee schedule changes.
ALTERNATIVES:
1) Approve Res. No. 6042, a resolution of the City of Shako pee upholding the appeal ofG.
Leonard West/Magnum Contracting as presented.
2) Approve Res. No. 6042, a resolution of the City of Shakopee upholding the appeal of G.
Leonard West/Magnum Contracting with revisions.
3) Do not approve Res. No. 6042.
4) Table the matter for additional information.

RESOLUTION NO. 6042
A RESOLUTION OF THE CITY OF SHAKOPEE UPHOLDING THE APPEAL OF
G. LEONARD WEST/MAGNUM CONTRACTING OF THE CITY'S METHOD FOR
CALCULATING PERMIT FEES FOR RE-ROOFING OF RESIDENTIAL
TOWNHOME STRUCTURES
WHEREAS, G. Leonard West/Magnum contracting has appealed the City's method
for calculating permit fees for re-roofing townhome structures, i.e. charging a fee for each
living unit within the structure; and
WHEREAS, the City Council reviewed the appeal at its meeting of March 16,2004;
NOW THEREFORE BE IT RESOLVED BY the City Council that it hereby adopts
the following finding with respect to the appeal;
Finding 1. That permit fees for re-roofing of residential structures, including townhomes
and apartments, should be based solely on the value of the work to be undertaken, and not on the
basis of the number of residential units in a building to be re-roofed.
BE IT FURTHER RESOLVED that the appeal ofG. Leonard West/'Magnum
Contracting is hereby uphold, and that the appropriate city officials are directed to reimburse
the appellant the difference between the fees paid for re-roofing of the structures that are the
subject ofthis appeal, and the fees that would be due under the revised fee schedule.
