RFP for Aggregate Industries Quarry Concept Design IS. ~j ( CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Mark Themig, Facilities and Recreation Director Meeting Date: April 6, 2004 Subject: Aggregate Industries Quarry Concept Drawing Services INTRODUCTION City Council is asked to authorize staff to issue proposals for concept drawings for the proposed reuse of the Aggregate Industries Quarry, and enter into agreement with the successful firm if the proposal is under $10,000. BACKGROUND AND DISCUSSION In December, we presented a concept to Council that would redevelop a restored quarry owned by Aggregate Industries into some type of park or recreational facility (see Attachment A). At that time, Council directed staff to continue working with the potential partners to further define the concept. Since that time, we have been meeting approximately once per month to explore potential reuse options. Attachment B, the Quarry lake Program Document, is a summary of these di$cussions. As you will see from the document, there is consensus from the partners that City ownership of the property seems to be the best option. We have come to the point where we need to take our thoughts and transfer them visually to the site in a conceptual way to determine what is feasible. This will require professional assistance, most likely someone experienced in park planning or land reuse. Therefore, we are seeking authorization to issue proposals for this work. BUDGET IMPACT I am estimating that transferring elements of the program document to visual concepts will be in the $10,000 range. In the spirit of this project, the following partners have committed to assist with funding this: . Prior lake Water Ski Club: $2,500-3,000 . DNR Trails and Waterways: $2,500 . Excel Energy: $1,000 . OHEC: Will supply their artist renditions to be incorporated into the site. . City: $3,500-$4,000 I believe that an investment of under $5,000 by the City would be prudent to help further define the possibilities and challenges for this property. Funding would come from the professional services portion of the Natural Resources budget. With the City Council's recent increase in the per-item expenditure that can be authorized by staff, I would also ask that Council also permit appropriate officials to enter into agreement with the successful firm, provided the proposal is less than $10,000. This will allow us to keep this project moving forward in a timely manner. REQUESTED ACTION If City Council concurs, move to authorize appropriate City officials to develop and issue' a Request For Proposals (RFP) for the Quarry Reuse Project, and enter into agreement with the successful firm if the project is under $10,000. The quarry is located just north of Hwy 169 and south of Raceway Parkway. BACKGROUND Aggregate Industries has restored a former gravel quarry on the eastern side of Shakopee and is interested in donating the quarry to either the City or a non-profit. The site includes approximately 60 acres of water on an approximately BO-acre site. Although the quarry has been restored, there is some active use in both the northwest and northeaster portions that would continue under Aggregate's ownership. As some of you may recall, the Prior lake Water Ski Association approached the Parks and Recreation Advisory Board in 2001 about using lake O'Dowd Park for a practice location. The park would provide spectator seating and a staging area for their participants. The AdVisory Board recommended against this use, but encouraged the Association to approach some of the quarries in the area about use. Prior lake Water Ski Association made contacts with Aggregate Industries and entered into an agreement for use of this quarry in 2003. Their lease has been extended for 2004, and as such, they are the primary stakeholder. DISCUSSION The Prior lake Water Ski Association is looking for partners in developing the site since their long-term use will primarily only be the water area. (There may be occasional use of the land around the water for spectator seating.) There have been several meetings with other potential partners in this project. These include: . Excel Energy that operates a power generation facility between the site and Hwy 169 and has land that could be used for trails . Outdoor Heritage Education Center that is developing plans for an education center to the west of the site . The DNR that has funding for a fishery or possibly even off-road vehicle training. Prior lake Water Ski Association would like to present a proposal to Aggregate Industries on potential reuse of the site. One of the primary considerations in this proposal is related to ownership of the land. As I understand, the Prior lake Water Ski Association would like to own the site, but is open to an alternative relationship, should the City prefer to own the land. The Parks and Recreation Advisory Board toured the site this fall and considered the concept at their November 24th meeting. There seemed to be enthusiasm about the site, potential partnerships, and benefits for residents of the City. Board Member Hartmann is an employee of Bryan Rock and indicated that this seems like a great opportunity. The Advisory Board recol'Tlmended unanimously to Council that the City continue further research and work on the concept. At this point, there are likely more questions than answers, from access to ownership of the site. Therefore, this presentation will be an introduction to the site and potential uses. City Council is asked to provide direction to staff as to whether or not there interest in further involvement from the City. If so, we will continue working with the Association and other potential partners to develop a proposal. These include the City of Shakopee, who has planned a Greenway along the watershed just to the west of the property; the Watershed District; Xcel Energy; the Trails and Waterways and the Fisheries divisions of the Minnesota Department of Natural Resources; the Amateur Riders Motorcycle Association, (ARMCA). The City of Shakopee's Parks & Recreation Department sees potential for citizens to enjoy the site, including ski shows, special events, and fully accessible pier fishing for families and seniors. They see the public value of a natural and open space area. The Department of Natural 1 Resources' Fisheries unit is enthused about the potential for the site, including one of the premier sustainable trout fisheries in the state. DNR's Parks & Trails pointed out the possible connection to adjacent greenway trails that connect Quarry Lake and its nature areas to the MN Valley National Wildlife Refuge. Compelling Plan Representatives of these organizations have met over the past year for the purpose of creating, integrating, and articulating a compelling plan for multiple complementary usage of the Quarry Lake site, without causing disturbance to, or creating issues for, thf#:~:n~arby ollgoing industrial operations. The bleachers and grounds would generally be free and open to the public for viewing, except during special events, including Shows and Competitions, where PLWSA would charge an entrance fee or ask for a donation from spectators. Events would be scheduled in advance through the City of Shakopee Recreation department in order to avoid event conflict with other organizations using the. site. During the May - Octobe~i:i:m;Wame each year, Shakopee residents and the general public would have free and equa(~ccess to fish from piers to be constructed around the lake, subject to all Minnesota fishing rules and regulations. OHEC education sessions and special events would have equal access to the fishing piers. Fishing during the period November 1 - April 30 each year, as allowed by State Law, can be pursued from the piers, and during the appropriate season, from ice fish houses located on the lake. Only boats affiliated with the PLWSA would be allowed on the lake. The DNR would require the PLWSA to promise tha~ their members would not allow fishing from their boats, so that the "equal 4 access" rules of the DNR would be upheld, allowing the DNR to contribute funds toward development of the site. The PLWSA has agreed to this restriction. The DNR would provide the funds to stock and maintain stock in the lake, and for construction and maintenance of the several fishing piers around the lake. The fishing piers would be free and open to the public. In addition, the DNR would make minority contributions toward the public access road, bridge, and parking lot, which would also be free and open to the public. Xcel Energy t:~::::.. . Under this proPc>sal, ARMCA would fund liability insurance, would hold 5 Xcel Energy, PLWSA; and the City harmless for member and public use of the site, and would fund any temporary improvements necessary for their use of the site. Whether or not Xcel Energy approves this option, OHEC would arrange for ARMCA members to have access to training and education facilities located on part of the OHEC 7 - 8 acres on the northwest corner of the. lake. DNR Trails and waterways may contribute to these improvements as well. ARMCA would also fund minority contributions toward the public access improvements, including the road, bridge, and parking lot.
