No. 6031 CITY OF SHAKOPEE 9.13~ Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Public Hearing for Prairie View Additions Bituminous Overlay, Project No. 2004-2 DATE: April 6, 2004 INTRODUCTION: As per Resolution No. 6022, a resolution receiving a report and calling for a public hearing on the Prairie View Additions Bituminous Overlay, Project No. 2004-2, a public hearing is scheduled for April 6, 2004. This agenda item is to conduct the public hearing for the Prairie View Additions Bituminous Overlay. BACKGROUND: On December 16, 2003, City Council ordered the preparation of a feasibility report for the Prairie View Additions Bituminous Overlay. The report was completed and accepted by City Council on March 1,2004. This proposed project includes a bituminous overlay ofthe following streets: . Pierce Street, from 10th A venue to the Westwind Addition . Shumway Street, from 10th Avenue to McDevitt Street . Menke Circle . Menke Avenue . McDevitt Street . Hennes A venue, from Pierce Street to Apgar Street . Thomas Avenue, from Pierce Street to Apgar Street On March 30, 2004, staff conducted an informational meeting for the property owners being affected by the proposed project. A total of twelve residents attended the meeting. TheTesidents in attendance at the informational meeting seemed in favor of the project and had some general questions regarding the design, construction schedule and assessment payments. PROJECT COSTS: The total estimated project cost for this project are as follows: Street Improvements $209,618.75 Storm Sewer Improvements $ 32,243.75 Total Project Cost $241,862.50 ~ 25% of the street improvements ($52,404.54) will be assessed to the benefiting properties. The remaining costs ($157,214.21) associated with the street improvements will be paid from General Tax Levy Funds. The costs ($32,243.75) associated with the storm sewer improvements will be paid from the Storm Sewer Fund. AL TERNATIVES: 1. Adopt Resolution No. 6031, a resolution ordering the improvement and the preparation of plans and specifications for the Prairie View Additions Bituminous Overlay, Project No. 2004-2. 2. Deny Resolution No. 6031. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Table Resolution No. 6031, to allow time for staff to prepare additional information and/or revise the feasibility report as directed by City Council. 4. Modify Resolution No. 6031, to reduce the scope of the project area, as determined by City Council. RECOMMENDATION: If Council desires to proceed with this project, at this time, then Resolution No. 6031 needs to be adopted, a resolution ordering the improvement and the preparation of plans and specifications. If City Council does not wish to pursue this project, then the appropriate action would be to move the approval of Resolution No. 6031 and vote against the motion. If City Council wants more information on the project and/or to amend the feasibility report, then Alternative No.3 is recommended. ACTION REQUESTED: Offer Resolution No. 6031, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for Prairie View Additions Overlay, Project No. 2004-2, and move its adoption. CJ4f~ Jeff Weyandt Assistant City Engineer JWlpmp ENGRl2004PROJECTS120040VERLA YIPRAIRlEVIEWfWORDIMEM6031 RESOLUTION NO. 6031 A Resolution Ordering An Improvement And Preparation Of Plans And Specifications For Prairie View Additions Bituminous Overlay Project No. 2004-2 WHEREAS, Resolution No. 6022 adopted on March 1, 2004, fixed a date for Council hearing on the Prairie View Additions Bituminous Overlay and all appurtenant work; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 6th day of April, 2004, at which all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: Prairie View Additions Bituminous Overlay and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2004-2 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption ofthis resolution.
