Street Reconstruction, Project No. 2004-1

INTRODUCTION:
As per Resolution No. 6023, a resolution receiving a report and calling for a public
hearing on the Weinandt Acres 1st Addition Street Reconstruction, Project No. 2004-1, a
public hearing is scheduled for April 6, 2004. This agenda item is to conduct the public
hearing for the proposed improvement to the streets located in Weinandt Acres .1 st
Addition.
BACKGROUND:
On December 16, 2003, City Council ordered the preparation of a feasibility report for
the Weinandt Acres 1st Addition Street Reconstruction Project. The report was
completed and accepted by City Council on March 1, 2004. This proposed project
includes reconstructing the following streets:
. 29th A venue, from Marcia Lane to CSAH 17
. Marcia Lane, from 29th Avenue to the Plat Line
. Maxine Circle
On March 30, 2004, staff conducted an infonnational meeting for the property owners
being affected by the proposed project. A total of nine residents attended the meeting.
The residents in. attendance at the informational meeting seemed in favor of the project
and had some general questions regarding the design, construction schedule and
assessment payments.
PROJECT COSTS:
The total estimated project cost for this project is $322,797.00
25% of the street improvements ($80,699.00) will be assessed to the benefiting
properties. The remaining costs ($242,098.00) associated with the street improvements
will be paid from General Tax Levy Funds.
ALTERNATIVES:
1. Adopt Resolution No. 6032, a resolution ordering the improvement and the
preparation of plans and specifications for the Weinandt Acres 1 stAddition Street
Reconstruction, Project No. 2004-1.
2. Deny Resolution No. 6032. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6032, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Modify Resolution No. 6032, to reduce the scope of the project area, as
determined by City Council.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6032
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications. If City Council does not wish to pursue this project, then the
appropriate action would be to move the approval of Resolution No. 6032 and vote
against the motion. If City Council wants more information on the project and/or to
amend the feasibility report, then Alternative No.3 is recommended.
ACTION REQUESTED:
Offer Resolution No. 6032, A Resolution Ordering an Improvement and Preparation of
Plans and Specifications for Weinandt Acres 1 st Addition Street Reconstruction, Project
No. 2004-1, and move its adoption.

A Resolution
Ordering An Improvement And Preparation Of
Plans And Specifications For
Weinandt Acres 1st Addition Street Reconstruction
Project No. 2004-1
WHEREAS, Resolution No. 6023 adopted on March 1, 2004, fixed a date for Council
hearing on the proposed improvement of Weinandt Acres 1 st Addition Street Reconstruction
Project and all appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of April, 2004, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
Weinandt Acres 1st Addition Street Reconstruction Project and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2004-1 Public hnprovement
Program.
4. The City Council shall let the contract for all or part ofthe improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption ofthis
resolution.
