A local resident addressed the Council regarding beekeeping in Shakopee Councilmember Jay Whiting made a motion to direct staff to move forward with the Beekeepers in the backyard policy, and bring it back to Council, seconded by Councilmember Jody Brennan and the motion passed. 4-1 Nays: Lehman 6. Reynolds, City Administrator TO: Mayor and City Council Subject: A Resolution of the City of Shakopee Supporting Legislation Authorizing Infrastructure Development Fees Policy/Action Requested: Adoption of the resolution. Recommendation: Approval. Discussion: For years some cities have recovered the costs for infrastructure through infrastructure developmemt fees. The state legislature has passed laws allowing for cities to charge for sanitary sewer, storm sewer, water and parks fees and the expectation was that the same was true for street fees. But recently the Minnesota Supreme Court ruled in Harstad v City of Woodbury that local government entities do not have the authority under existing statute to charge infrastructure development fees. To some cities including our neighbors like Prior Lake, it is estimated that the city will experience as much as a $26 million shortfall if the infrastructure development fee continues to be prohibited. Under the Prior Lake's current ordinances, developers pay for the infrastructure required to serve the needs of their subdivisions. Sewer, water, storm water and even neighborhood roadways are installed to the city's specifications by the developer who recovers his costs through selling the land and building homes. What these fees do not reimburse is the indirect roadway costs caused collectively by Page 8 of 69 community development. That is what the infrastructure development fee is intended to do. Budget Impact: None to the City of Shakopee ATTACHMENTS: Resolution in Support Page 9 of 69 RESOLUTION R2019-031 A RESOLUTION OF THE CITY OF SHAKOPEE SUPPORTING LEGISLATION AUTHORIZING INFRASTRUCTURE DEVELPOMENT FEES WHEREAS, the City of Shakopee and its neighboring cities are growing; and WHEREAS, with growth comes not only the need to maintain existing street infrastructure to support current population requirements, but also the demands of increased population; and WHEREAS, developers, builders and new homeowners are driving the need for road improvements, street oversizing, street redesign and street reconstruction in some of our neighbors; and WHEREAS, municipal statutory authority appropriately exists for fees related to parks, sewer and water; and WHEREAS, this municipal statutory authority does not exist for infrastructure development fees; and WHEREAS, city streets are one of the four major types of infrastructure local government is responsible to provide to protect public safety and health; and WHEREAS, city streets represent a separate but integral piece of the network of roads supporting movement of people and goods; and WHEREAS, existing funding mechanisms, such as Municipal State Aid, property taxes and special assessments, have limited applications, leaving cites under -equipped to address growing needs; and WHEREAS, funding sources for larger streets and intersections to support new developments in neighboring cities can often come from infrastructure development fees; and WHEREAS, the infrastructure development fee mechanism is no longer allowed as a result of the Harstad vs. Woodbury case; and WHEREAS, some of our neighboring cities have found it difficult to develop adequate funding systems to support their needed street improvements related to growth; and WHEREAS, cities need flexible policies and greater resources in order to meet growing demands for street improvements. NOW THEREFORE BE IT RESOLVED that the City of Shakopee supports legislation that would authorize cities to levy infrastructure development fees to fund municipal street improvements as a necessary component of growth. Shakopee City Council March 5, 2019 FROM: Jay Tobin, Parks and Recreation Director TO: Mayor and Council Members Subject: Temporary Liquor License to City of Shakopee Parks and Recreation Department for special event. Policy/Action Requested: Approve temporary on -sale liquor license to City of Shakopee Parks and Recreation Department for NHL Alumni Event (Fundraiser for Parkinson's) held at Shakopee Ice Arena on April 13th, 2019. Recommendation: Approve the above motion. Discussion: The goal is to provide a high quality annual event that citizens enjoy as it attracts visitors and highlights Shakopee's fantastic facilities and people. This temporary on -sale liquor license enhances the experience for approximately 1,200 citizens and visitors attending the NHL Alumni Event (Fundraiser for Parkinson's) held at Shakopee Ice Arena from 2:30 pm to 7 pm on April 13th 2019. Participants will be carded and wrist -banded in order to purchase alcohol. O'Brien's Public House will sell alcohol for this event with all profits going to the Parkinson's Foundation. Shakopee Youth Hockey Association sell food and beverage at the concession stand (10% of sales to the City) and 2-3 food trucks will be selling food and beverage outside the Ice Arena to further enhance the customer experience. Shakopee service organizations are volunteering to staff bouncy -houses and games for younger participants. Before the game against local hockey coaches, the 18 NHL alumni players will skate with kids and sign autographs, as well as facilitating a skills competition. Local vendors will be selling hockey culture items (jersey's, prints, etc.) while sponsor donated items will be Page 12 of 69 auctioned to raise further funds to support the Parkinson's Foundation. This event as historically moved around the Twin Cities annually, and they are receptive to making Shakopee the permanent home for this high profile annual event. It will be advertised on multiple television and radio stations as well as in print media. Budget Impact: None. Page 13 of 69 *5.C.1. Shakopee City Council March 5, 2019 FROM: Michael Kerski, Planning and Development Director TO: Mayor and Council Members Subject: Applications to DNR Natural & Scenic Grant and Outdoor Recreation Grant. Policy/Action Requested: Approve resolutions authorizing the city to apply to DNR Natural & Scenic Grant and Outdoor Recreation Grant. Recommendation: Approve Resolutions R2019-22 and R2019-23. Discussion: Ridge Creek Park project has been approved in the city's 2019 - 2023 CIP (PR-19-001). The DNR Natural & Scenic Grant funds outdoor recreation use of natural and scenic areas which are primarily limited to passive outdoor recreation activities, such as nature observation, walking or hiking, bird watching, cross country skiing, snow shoeing, canoeing, photography and similar low impact activities. It also funds limited facilities to support these activities, such as trails, overlooks, interpretive displays, benches, informational and boundary signing, protective fencing and parking. The Ridge Creek Park project encompasses a majority of these allowable funded items. The Outdoor Recreation Grant funds projects primarily for development, redevelopment or rehabilitation of outdoor recreation facilities. Ridge Creek Park is a redevelopment project which will provide connectivity between parks and public open spaces and improve bicycle and pedestrian transportation network. The maximum grant award is $500,000 for the Natural & Scenic Grant and $250,000 for the Outdoor Recreation Grant. The city will be asking for the maximum grant amount for both grants. The Minnesota Department of Natural Resources requires an acknowledgement sign, supplied by grant program staff, to be displayed at the main Page 14 of 69 entrance to the park. Budget Impact: The City of Shakopee has budgeted $3,000,000, including design and construction, for the Ridge Creek Park project. Both the Natural & Scenic Grant and Outdoor Recreation Grant require at least a 50% match of the total project cost which is $1,500,000. This amount is already budgeted for in CIP. ATTACHMENTS: Resolution R2019-022 Resolution R2019-023 Page 15 of 69 RESOLUTION R2019-022 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AUTHORIZING THE CITY TO SUBMIT A NATURAL & SCENIC GRANT APPLICATION FOR RIDGE CREEK PARK BE IT RESOLVED that the City of Shakopee acts as legal sponsor for the project contained in the Natural & Scenic Areas grant application to be submitted on the 29th Day of March 2019 and that William Mars is hereby authorized to apply to the Department of Natural Resources for funding of this project on behalf of the City of Shakopee. BE IT FURTHER RESOLVED that the applicant has read the Conflict of Interest Policy contained in the Natural & Scenic Areas Grant Program Manual and certifies it will report any actual, potential, perceived or organizational conflicts of interest upon discovery to the state related to the application or a grant award. BE IT FURTHER RESOLVED that the City of Shakopee has the legal authority to apply for financial assistance, and financial capability to meet the match requirement (if any) and ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED that the City of Shakopee has not incurred any development costs and has not entered into a written purchase agreement to acquire the property described in the Cost Breakdown section on this application. BE IT FURTHER RESOLVED that the City of Shakopee has or will acquire fee title or permanent easement over the land described in the site plan included in the application. BE IT FURTHER RESOLVED that, upon approval of its application by the state, the City of Shakopee may enter into an agreement with the State of Minnesota for the above - referenced project, and that the City of Shakopee certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for uses consistent with the funding grant program into perpetuity. NOW, THEREFORE BE IT RESOLVED that the Mayor of the City of Shakopee is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant. Shakopee City Council March 5, 2019 FROM: Steve Lillehaug, City Engineer & Public Works Director TO: Mayor and Council Members Subject: Grant application for CSAH 16 Trail Extension Project CIF20-006. Policy/Action Requested: Approve Resolution R2019-021 authorizing the city to apply for a DNR Local Trail Connection grant for the CSAH 16 trail extension. Recommendation: Approve Resolution R2019-021. Discussion: The State of Minnesota has a grant program providing local units of government funding to connect trails where short gaps exist, especially in areas where the connection will enhance pedestrian activity and use. DNR Local Trail Connection grant applications are due on or before March 29, 2019. The City of Shakopee has a potential trail project which would benefit from this grant. The County State Highway (CSAH) 16 trail project is currently in the city's Capital Improvement Plan (CIP) and is planned to be constructed in 2020. The project proposes to construct two missing trail segments along CSAH between CSAH 18 and CSAH 21. Budget Impact: The project estimate for the CSAH 16 Trail Extension is $200,000 which is allocated in the 2019 CIP. $30,000 of the total cost is for easement acquisition which is not included in the grant application. The city will be asking for $100,000 in grant funding with a local match of $70,000 for a total of $170,000. ATTACHMENTS: Resolution No. R2019-021 Page 18 of 69 RESOLUTION R2019-021 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AUTHORIZING THE CITY TO SUBMIT A LOCAL TRAIL CONNECTION GRANT APPLICATION FOR THE CSAH 16 TRAIL CONNECTION WHEREAS, the City of Shakopee, Minnesota supports the grant application made to the Minnesota Department of Natural Resources for the Local Trail Connections Program. The application is to construct 0.35 miles of paved trail for the CSAH 16 Trail Connection. The trail system is located between CSAH 18 AND CSAH 21, and WHEREAS, the City of Shakopee recognizes that it has secured $70,000 in non -state cash matching funds for this project. NOW, THEREFORE, BE IT RESOLVED, if the City of Shakopee is awarded a grant by the Minnesota Department of Natural Resources, the City of Shakopee agrees to accept the grant award and may enter into an agreement with the State of Minnesota for the above referenced project. The City of Shakopee will comply with all applicable laws, environmental requirements and regulations as stated in the grant agreement, and BE IT FURTHER RESOLVED that the applicant has read the Conflict of Interest Policy contained in the Local Trail Connections Grant Manual and certifies it will report any actual, potential, perceived, or organizational conflicts of interest upon discovery to the state related to the application or grant award. Shakopee City Council March 5, 2019 FROM: Ryan Halverson, Assistant City Engineer TO: Mayor and Council Members Subject: No Parking Restriction for 12th Avenue and for Vierling Drive. Policy/Action Requested: Approve Resolution R2019-024, restricting parking on 12th Avenue from Vierling Drive to County State Aid Highway 83, and on Vierling Drive from Eagle Creek Boulevard to 12th Avenue. Recommendation: Adopt Resolution R2019-024. Discussion: The design for the reconstruction of 12th Avenue and construction of a roundabout at the intersection of 12th Avenue/Shenandoah Drive/Vierling Drive is underway as part of the Capital Improvement Plan project CIF-19-004. These existing collector roadways are designated by the city as part of the Municipal State Aid system. As part of the state rules for state aid roadways, certain travel lane and parking lane width requirements must be adhered to. The existing segments on 12th Avenue from Vierling Drive to County State Aid Highway 83 and on Vierling Drive from Eagle Creek Boulevard to 12th Avenue (see attached map) do not accommodate parking as do the proposed configurations of the roadways. Accordingly, the roadways must be designated and signed with "no parking" zones. A resolution from the city stating as such is required by the Minnesota Department of Transportation for State Aid plan approval confirming the state's design criteria are met. Budget Impact: None. Discussion: On February 19, 2019, a public improvement hearing was held and Resolution R2019-017 was approved by City Council ordering the 2019 Street & Utility Reconstruction Project. Discussion: The city's Capital Improvement Plan (CIP) contains the 2019 Sewer Service Lateral Pipe Rehabilitation Project SAN19-003 and 2019 Cured -In -Place Sewer Lining Project SAN19- 006. On January 22, 2019, the City Council adopted Resolution R2019-010 approving the plans and specifications, and authorizing bidding of the project. In accordance with Minnesota Statute Section 471.347 Uniform Municipal Contracting Law, bids were solicited and opened on February 14, 2019. Four (4) bids were received and Musson Bros Inc., from Brookfield, Wisconsin, is the low bidder in the amount of $607,338.25 (see the attached resolution for the bid tabulation summary). The costs are consistent with past project costs and are under the CIP construction cost estimate for the project which was $620,000. Musson Bros, Inc., has the capacity and experience for the project and is deemed a responsible bidder. They are prepared to begin work in the spring with an anticipated substantial completion in November 2019. Budget Impact: The CIP identifies a total project budget of $700,000 for the 2019 Sewer Service Lateral Pipe Rehabilitation Project, and $80,000 for the 2019 CIPP Sewer Lining Projects for a combined total estimated project cost of $780,000. Shakopee City Council March 5, 2019 FROM: Kyle Sobota, Senior Planner TO: Mayor and Council Members Subject: Text Amendment to City Code Section 130.04, to Create A Beekeeping Ordinance Policy/Action Requested: Adopt Ordinance No. 02019-002, an ordinance amending City Code Section 130.04. Recommendation: Adopt ordinance, as proposed. Discussion: The City of Shakopee has been contacted by several residents interested in keeping bees on urban residential lots. Like backyard chickens, there is recent interest in local food sources, small scale agriculture, and the important role of bees in the pollination of plants and providing honey and other useful products. Currently, beekeeping is only permitted in the Agricultural Preservation and Rural Residential Zoning districts, which are typically 2.50 acre lots and larger. At this time there are no specific requirements related to beekeeping in the zoning ordinance for setbacks and limits on number of colonies. Planning staff are not aware of any complaints regarding the keeping of bees in the Agricultural Preservation or Rural Residential zoning districts. Planning staff researched multiple city ordinances when considering a draft ordinance for Shakopee. Many cities in the Twin Cities permit beekeeping in all zoning districts. Ordinances reviewed include: Bloomington, Brooklyn Park, Chanhassen, Edina, Minneapolis, Saint Paul, and Savage. Staff also consulted a model ordinance drafted by the Minnesota Hobby Beekeepers Association. The proposed ordinance for Shakopee is under the animal regulations (Section 130.04). The amendment includes definitions that pertain to beekeeping. Many of the ordinances reviewed use the same or similar definitions and impose limits on hive setback and Page 33 of 69 number of colonies permitted based on lot size. Main definitions of note for purposes of this report are below: Colony: An aggregate of honey bees consisting principally of workers, but having, when perfect, one queen and at times drones, brood, combs, and honey. Hive: The receptacle inhabited by a colony. Flyway Barrier: A solid fence, wall, or dense vegetation at least 6' in height that continues parallel to the apiary site lot line at least 10' in each direction from the colony, that requires bees to fly over, rather than through the barrier. Depending on the barrier type and construction, or location, additional permitting (building) may be required prior to installation. Bees prefer to travel directly to the plants they pollinate, so a flyway barrier is used to encourage bees to either travel upward over the barrier, or travel a different direction away from the barrier. Honeybees are more docile compared to other breeds and typically only sting when they or their hive are threatened. European stock is considered docile and is a requirement in the draft ordinance. The Cities of Bloomington and Savage do not require licenses or permits for beekeeping. Planning staff contacted both the Bloomington and Savage about their experience with permitting beekeeping without requiring registration or licenses. In their experience, they have not had any issues allowing beekeeping in all zoning districts, which is why the draft ordinance does not include provisions for licensing or permits to reduce necessary paperwork and expense for both residents and staff for something that isn't controversial, provided certain conditions are met. At the January 3rd Planning Commission meeting, the Planning Commission recommended that the City Council approve the ordinance, with the addition of a registration requirement. Staff intends to draft a free one-time registration application for properties where hives are located. Budget Impact: N/A ATTACHMENTS: o Ordinance No. 0-2019-002 Page 34 of 69 Page 35 of 69 ORDINANCE NO. 02019-002 AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY CODE SECTION 130.04 TO ADD BEEKEEPING WHEREAS, the City of Shakopee has proposed an amendment to the City Code Section 130.04, Subdivision 1 to add a section related to beekeeping; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on January 3, 2019, at which time all persons present were given an opportunity to be heard; and WHEREAS, the Planning Commission has recommended to the City Council that the proposed text amendment be adopted; and WHEREAS, the City Council heard the matter at its meeting on March 5, 2019; and WHEREAS, all of the below language is added to the City Code. City Code Section 130.04, Subdivision I (Beekeeping) Purpose: Honeybees are an asset to the community and important in the pollination of plants and production of honey and other products. The purpose and intent of this section is to permit and establish requirements for keeping of honeybee colonies and equipment within the city. Definitions: 1. Apiary: The assembly of one or more colonies of bees on a single lot. 2. Beekeeper: A person who owns or has charge of one or more colonies of honeybees. 3. Colony: An aggregate of honey bees consisting principally of workers, but having, when perfect, one queen and at times drones, brood, combs, and honey. 4. Flyway Barrier: A solid fence, wall, or dense vegetation at least 6' in height that continues parallel to the apiary site lot line at least 10' in each direction from the colony, that requires bees to fly over, rather than through the barrier. Depending on the barrier type and construction, or location, additional permitting may be required prior to installation. 5. Hive: The receptacle inhabited by a colony. 6. Undeveloped property: A lot adjacent to an apiary where residential dwellings, commercial buildings, trails, sidewalks, or streets do not currently exist, or are greater than 25' from an existing hive. Location Requirements: 1. Beekeeping is permitted in all zoning districts in accordance with this code section. In the B-3, Central Business District Zone, hives must be kept on the roof of a building at least 12' in height. 2. Hives must not be located in the front yard, unless on a lot larger than 5 acres and the front yard setback of the zoning district is met. For purposes of this section, a corner lot has two front yards. Page 36 of 69 3. Every effort should be made to ensure that the water source is free of chemicals typically found in tap water. 3. Hives must not exceed 6' in total height. 4. Each beekeeper shall ensure that no wax comb or other material that might encourage robbing by other bees is left exposed outdoors. Such materials must be stored in sealed insect -proof containers or placed within a building. All Beekeepers must register active hive sites with the Zoning Administrator. Beekeepers must register existing hives within 60 days of the publishing of this ordinance. 2. Sale of honey or related bee products: Retail sales in residential zones must only be from hives on that property and comply with City Code on Home Occupations, which may require a Home Occupation Permit. All on -site signage must meet City Code requirements. 3. If an undeveloped property adjacent to a colony is developed, the colony locations must comply with all sections of this code within 90 days of the development. 4. Hive bodies must be maintained in good condition, including maintenance of paint, and when not in use must be removed within 14 days if they are no longer occupied. Hives on a building roof top must comply with the same screening requirements for rooftop mechanical equipment in the Zoning Code. 5. A Beekeeper that removes a hive or swarm from an unwanted area may exceed the maximum colony quantity requirements for up to 30 days, but must meet all other requirements of this section. 6. Hives shall be continuously managed to provide adequate living space for their resident honeybees in order to control swarming. 7. In any instance in which a colony exhibits unusual aggressive behavior, it shall be the duty of the beekeeper to promptly implement appropriate actions to address the behavior. Queens shall be selected from European stock bred for gentleness and non -swarming characteristics. 8. Upon prior notice of the owner of the apiary site, the Zoning Administrator or designee shall have the right to inspect any apiary for the purpose of ensuring compliance with this Section. It shall be deemed a violation of this Section for any person to resist, impede, or hinder the Zoning Administrator or designee in the performance of their duties in inspecting any apiary and apiary site.
