COMMITTEE OF THE WHOLE FEBRUARY 13, 1996
Mayor Henderson called the meeting to order at 5:00 P.M. with Councilmembers DuBois,
Zorn, Sweeney, and Link present. Also present: Dennis R. Kraft, City Administrator;
Barry Stock, Assistant City Administrator;Karen Marty, City Attorney; Judith S. Cox,
City Clerk;Bruce Loney, Public Works Director/City Engineer;Mark Huge, Fire Chief; as
well as a number of firemen.
Sweeney/Link moved to approve the minutes of January 23, 1996. Motion carried
unanimously.
Mr. Stock stated that the 1995 and 1996 budgets contain funding to acquire property for a
new fire station. He explained that staff has been working with the Fire Department Siting
Committee on identifying possible sites. He stated that direction is needed from the
Council regarding: acquiring a site, obtaining appraisals, and determining a referendum
date.
Mr. Stock identified four sites that were considered by the Siting Committee and
explained the good and bad points about each. The four sites included: 1)East of
Calvary United Methodist Church on Vierling Drive, 2) a 14.5 acre site S. of Vierling
Inn alongCR-16, and 4) adjacent to
of CR-16, 3)West of Canterbury
Drive and West J
the Thrift Shop at the SE corner of CR-16 and CR-83.
Mr. Stock also explained that the City owns property that could possible be traded for the
3rd site Wit were in conjunction with an economic development project.
Considerable discussion ensued on sites 2 and 3. Mr. Huge stated that the Committee
prefers the 2nd site of the four sites considered because of the many possibilities that it has
to offer.
Sweeney/DuBois moved to direct staff to obtain appraisal information on Site#2 for a
second fire station (S of Vierling Drive and W of CR-16) and to obtain additional
information on costs and the complexity involved in pursuing Site#3 (West of Canterbury
Inn along CR-16) as a swap for land owned by the City. Motion carried unanimously.
Discussion ensued on a date for a referendum for a second fire station.
Sweeney/Zorn moved to direct staff to plan to prepare for a referendum for a second fire
station for the November 5, 1996 election. Motion carried unanimously.

Discussion ensued on the use of an architect or a construction manager to get a cost
estimate for constructing a fire station. No decision was made.
Sweeney/Zorn moved to adjourn. Motion carried unanimously. The meeting was
adjourned at 6:08 P.M.

RE: Information on Recruitment Process for City Administrator Position
DATE: February 23, 1996
Attached please find information that should be reviewed and approved by the City Council as a
part of the process for finding a new city administrator. The information attached is meant as a
guide to City Council discussion and the City Council should feel free to make any changes they
deem desirable in the information.
As I stated previously the City Council can either hire an executive search firm to carry out this
process, they can conduct the process themselves with or without the help of qualified citizens, or
they can conduct a hybrid process whereby a consultant structures the process and works with a
City Council appointed committee. If the City Council wants me to contact a couple of executive
search firms I will do so at Council direction.
It is also necessary that the City Council attempt to formulate a starting salary range. I have
included a draft position announcement, information on the City Administrator qualifications as
well as a brief profile of the community. I have also included information on where the position
could be advertised, depending upon whether the City Council wants to do a state wide search or
a national search. Once that determination is made we will determine when the next deadlines are
for filing the position vacancy announcement.
CITY ADMINISTRATOR QUALIFICATIONS:
Position Qualifications:
Education: Bachelors Degree in public or business Administration, urban planning or related
field, (Master's Degree preferred).
Experience: Desire 10 or more years increasingly responsible experience in local governments
with at least 5 years experience as a local governmental administrator/manger or
assistant.
* Knowledge of municipal budget process
* Knowledge of the planning land development process
* Ability to manage activities&personnel in following areas:
engineering
finance
public works
police
planning
economic development
*Knowledge/experience in dealing with the Minnesota property tax system and the
Metropolitan Councils' regulatory structure highly desirable.
* The successfully incumbent for this position will possess both vision and energy, and will
be responsible for guiding growth activities as well as redevelopment activities in the city's
central business district. An ability and willingness to work with other local governmental
entities desirable. Must be able to work independently. The position also requires an
ability to make decisions in a timely and efficient manner.
* The ability to work with appointed boards and commissions and ad hoc citizen groups is
also an essential requirements of this position.
COMMUNITY PROFILE:
Shakopee is a growing third ring suburb in the Twin-Cities Metropolitan area. It is anticipated
that the community will experience an accelerated rate of growth in the immediate future. The
community has a substantial commercial/industrial base and an increasing amount of residential
subdivision activity. The city is an entertainment mecca of the upper Midwest.
The city currently has approximately 70 full time employees and an additional 53 part time
employees. Development activities in the city are controlled, in part, by the Metropolitan Council;
a seven county planning and regulatory agency created by the Minnesota Legislature. The 1996
General Fund budget is approximately $ 5.6 million and the all funds budget is $ 23 million.
Issues confronting the community during the next decade include providing for and
accommodating growth in a regulatory system which places numerous constraints on growth
activities. It is anticipated that the community will be experiencing constraints on additional
revenue generation, while also being confronted with a demand for additional governmental
services.
Shakopee is the home of Valley Fair Amusement Park and also of Canterbury Park, the only pari-
mutuel horse racing facility in Minnesota. Mystic Lake Casino, one of the most profitable Native
American-owned casino's in the United States is located in close proximity to the city's Southern
boundary.
ADVERTISEMENT OF POSITION:
If the City Council decides to conduct a state wide search for the position I would recommend
that the position be advertised in the Minneapolis Star Tribune, the St Paul Pioneer Press and the
League of Minnesota Cities Publication. If the City Council decides to conduct a regional or
national search for this position in addition to the above publications I would also suggest that the
position be advertised in the International City Management Association bulletin.
These different publications have different deadline dates so that once a decision is made as to a
schedule for trying to fill the position we will determine when these dates are and once the job
advertisement has been put into final form procedures can be taken to facilitate this process.
Much of the day to day work activity of sending out position profiles and responding to
publication deadlines can be handled by Administrative Secretary Toni Warhol.

RE: Notice of Dismissal Order from the Bureau of Mediation Services (BMS)
DATE: February 22, 1996
Today I received a Notice of Dismissal Order from the BMS. The order specifically relates to the
Shakopee Management Association Group. The findings and orders indicate that the petition that
was submitted in late December has been withdrawn and therefore the petition has been
dismissed. As a result of this action the entire maintenance of status quo order has been
dismissed.
The discussion Mayor Henderson and I had with the Council earlier this week related to trying to
get the status quo order limited to the eight people who were in the designated management unit,
however with the withdrawal of the petition no City employee is impacted by the status quo
order.
Please contact me if you have questions relative to this latest action and I will attempt to answer
them.

Pursuant to Minnesota Statute §112.42 and the Scott County policy on Citizen Appointments to Scott
County Advisory Boards and Committees (Resolution No. 89030 adopted April 11, 1989), the Board of
Commissioners of Scott County is requesting your nominations for the appointment of a manager to
the Lower Minnesota River Watershed District Board of Managers.
The term of James Kephart will expire on March 22, 1996, and has expressed his interest in serving
another term.
In accordance with Minnesota Statute §112.42, no person shall be appointed who is not a voting
resident of the watershed district, and none shall be a public officer of the County, State or Federal
government, except that a soil and water conservation district supervisor may be appointed as a
manager.
The Board of Commissioners requests that you submit your recommendations for this appointment as
soon as possible. Please contact your County Commissioner or submit your recommendation to this
office.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, DESIGNATING THE
ACTING CITY ADMINISTRATOR.
WHEREAS, from time to time the City Administrator is
unavailable to perform his duties; and
WHEREAS, presently the Assistant City Administrator is
designated as Acting City Administrator; and
WHEREAS, the City Council desires to establish a list of
employees who may act as Acting City Administrator.

without prior written notice to the Council when all Council members are present at the meeting
or consent thereto in writing. Any such consent shall be filed with the City Clerk prior to the
beginning of the meeting. Any special meeting attended by all Council members shall be a valid
meeting for the transaction of any business that may come before the meeting. Meetings of the
Council which are adjourned from time-to-time shall not be subject to the foregoing notice
requirements; nor shall special meetings which, in the judgment of the Council, require immediate
consideration to meet an emergency require such notice, but may be called by telephone
communication or any other expeditious means. Notice to the public and to news media shall be
given as required by statute.
Subd. 2. Emergency Meetings. In determining what constitutes an emergency, the Council
should be guided by considerations of whether the situation calls for immediate action involving
the protection of the public peace, health or safety. Action by the,Council finding facts supporting
the emergency shall be noted in the minutes of the emergency meeting before remedial action is
taken thereon.
Subd. 3. Posted Notice. In addition to any other notice required by this Section, the City Clerk
shall endeavor to post a notice of all meetings in the City Hall where other notices are posted.

SEC. 2.04. COUNCIL PROCEDURE AT REGULAR MEETINGS.
The City Administrator shall prepare the following items: (1) an agenda for the forthcoming
meeting; (2), a compiled list of all claims; and, (3)a copy of all minutes to be considered. Roberts'
Rules of Order(Newly Revised) shall govern all Council meetings as to procedural matters not set
forth in the Statute or City Code. The order of business at regular meetings shall be as set forth
in the agenda. Matters not on the agenda, or not in the order specified, shall not be considered
except (1) with the consent of four-fifths of a quorum of the Council members present, or (2)
scheduled public hearings or bid lettings at the time stated in the notice, or(3)emergency matters.

SEC. 2.05. CITY ADMINISTRATOR.
Subd. 1. Position Established. The position of City Administrator is hereby established.
Subd. 2. Position Re-Defined. The existing position of City Administrator is hereby affirmed.
The City Administrator shall perform the duties hereinafter prescribed, which shall not include the
duties prescribed by law for City Clerks.
. Subd. 3. Appointment and Removal. The City Administrator shall be appointed by the Council
for an indefinite term. The City Administrator shall not be removed except by affirmative action
taken by the Council twice at two regular meetings held within sixty (60) days. The action taken
at the first such meeting shall be an expression of intent to vote thereon at the second such
regular meeting not to be held sooner than ten (10) days thereafter. If, at any time after the City
Administrator has completed six (6) months of continuous service, the Council takes such action,
the City Administrator may within thirty (30) days after written notice of removal, request a public
hearing which the Council must grant and which must be started within thirty (30) days after the
request.

§ 2.05
Subd. 4. Qualifications. The City Administrator shall be selected solely on the basis of
executive and administrative qualifications with special reference both to experience, formal
education, as well as knowledge of accepted practices pertaining to the duties of the office.
Subd. 5. Duties. The City Administrator shall be the Chief Administrative Officer of the City and
shall be responsible to the Council for the proper administration of all affairs of the City and to that
end shall be empowered and required to:
A. Repealed.
B. Supervise the administration of all Departments, offices and divisions of the City
except as otherwise provided by law and carry out any other responsibilities
placed under the City Administrator's jurisdiction by this Section or by subsequent
Council action.
C. Interview and screen all prospective City employees as permitted by law and shall
make recommendations to the Council before the Council makes any
appointment; suspend employees as necessary; make recommendations for
terminating employees and may suspend any employee until the next Council
meeting when the Council shall affirm, modify, or reject the recommendation for
termination.
D. Develop and issue all administrative rules, regulations and procedures necessary
to insure the proper functioning of all Departments and offices under the City
Administrator's jurisdiction as permitted by law and Council approval.
E. Prepare and submit an annual budget to the Council and keep the Council
advised of the financial condition of the City and make such recommendations as
the City Administrator may from time to time determine desirable and necessary.
F. Attend and participate in discussions at all meetings of the Council and other
. official bodies as directed by the Council. The City Administrator shall also
represent the City at all official or semi-official functions as may be directed by the
Council and not in conflict with the prerogatives of the Mayor. The City
Administrator shall be entitled to notice of all regular and special meetings of the
Council.
G. See that all laws and provisions of the City Code are duly enforced.
H. Purchase or enter into contracts for previously budgeted items when the amount
thereof does not exceed $5,000.00, and purchase or enter into contracts for
previously budgeted services, when the annual amount of such contract does not
exceed $5,000.00. For items and services in excess of $5,000.00, the City
Administrator shall receive estimates, quotations, proposals, or sealed bids, as
appropriate, and present them to the Council for official action.
I. Recommend from time to time the adoption of such measures as the City
Administrator may deem necessary or expedient for the health, safety and welfare
of the community or for the improvement of the administration.

J. Perform such other duties as may be required by the Council and consistent with
Minnesota Statutes and the City Code.
Subd. 6. Suspensions, Terminations and Appeals. Notice of termination or suspension must
be in writing and shall specify the grounds thereof and must be served forthwith upon the
suspended employee and filed with the Council. Any Department Head or employee so
suspended or terminated may request a hearing before the Council by serving ten (10) days'
written demand on the Council for such hearing and also by serving such notice on the City
Administrator. The Council shall hear such appeal within fourteen (14) days after the service of
the notice and shall render its decision within seven (7) days after the hearing is closed.
Subd. 7. Bond Required. Repealed.
Subd. 8. Compensation. The City Administrator shall receive such compensation as shall be

SEC. 2.06. EXECUTION OF CONTRACTS AND CITY SEAL
All contracts to which the City is a party, in addition to being signed by the Mayor, City
Administrator, and City Clerk, shall be sealed with the City Seal. Said Seal shall be kept in the
custody of the City Clerk and affixed by the City Clerk. The official City Seal shall be a circular
disc having engraved thereon"CITY OF SHAKOPEE" and such other words, figures or emblems
as the Council may adopt. (Ord. 51, January 1, 1981; Ord. 337, July 23, 1992)
SEC.2.07. RIGHT TO ADMINISTRATIVE APPEAL.
If any person shall be aggrieved by any administrative decision of the City Administrator, or any
Board or Commission not having within its structure an appellate procedure, such aggrieved
person is entitled to a full hearing before the Council upon serving a written request therefor upon
the Mayor and City Administrator at least ten(10)days prior to any regular Council meeting. Such
request shall contain a general statement setting forth the administrative decision to be challenged
by the appellant. At such hearing the appellant may present any evidence the appellant deems
pertinent to the appeal, but the City shall not be required to keep a verbatim record of the
proceedings. The Mayor, or other officer presiding at the hearing, may, in the interest of justice
or to comply with time requirements and on the Mayor's own motion or the motion of the appellant,
the City Administrator, or a member of the Council, adjourn the hearing to a more convenient time
or place, but such time or place shall be fixed and determined before adjournment so as to avoid
the necessity for formal notice of reconvening. (Ord. 1, April 1, 1978; Ord. 337, July 23, 1992)
SEC. 2.08. RULES OF PROCEDURE FOR APPEALS AND OTHER HEARINGS.
The Council may adopt by resolution certain written rules of procedure to be followed in all
administrative appeals and other hearings to be held before the Council or other bodies authorized
to hold hearings and determine questions therein presented. Such rules of procedure shall be
effective thirty (30) days after adoption and shall be for the purpose of establishing and
maintaining order and decorum in the proceedings. (Ord. 1, April 1, 1978)
