Mayor Laurent called the meeting to order at 6:40 P.M. with Councilmembers Brekke, Sweeney,
and Lynch present. Councilor Beard left after the Committee of the Whole meeting. Also
present: Mayor-elect Henderson, and Councilors-elect DuBois and Link;Dennis R. Kraft, City
Administrator;Karen Marty, City Attorney; Judith S. Cox, City Clerk;Paul Bilotta, Planning
Director;Bruce Loney, Public Works Director/City Engineer; Dave Nummer, Staff Engineer; and
Gregg Voxland, Finance Director.
Sweeney/Lynch moved to direct staff to publish the public hearing notice for 17th Avenue and
Sarazin Street proposed public improvements in the November 24, 1995 edition of the Shakopee
Valley News. Motion carried unanimously.
Sweeney/Brekke offered Resolution No. 4338, A Resolution Amending Resolution No. 4324, A
Resolution Canvassing Returns For The Regular Municipal Election And The Special Election,
By Certifying The Results Of A Recount, and moved its adoption.
reviewed the recount official's results of the recount for each of the five precincts.
The City Clerk
The recount is identical to what it was on the day of the election(1541 votes for Jeff Henderson
for mayor and 1539 votes for Michael Beard for mayor).
Councilor Brekke advised that he has withdrawn his request for a recount in light of the results of
the recount for the mayoral race.
Motion carried unanimously.
Mayor Laurent recessed the meeting at 6:47 P.M. for an executive session to discuss matters
permitted under attorney-client privilege.
Mayor Laurent re-convened the meeting at 7:10 P.M. and stated that no action was taken during
the executive session.
Mayor Laurent adjourned the meeting to Tuesday,November 21, 1995 at 7:00 P.M. The meeting
adjourned at 7:10 P.M.

INTRODUCTION:
Attached is Resolution No. 4358, which adopts the assessments as amended for the above
referenced project.
BACKGROUND:
The Downtown Streetscape Project No. 1993-12 had an assessment hearing on November
21, 1995 with the assessments being adopted by City Council by Resolution No. 4342.
One of the property owners, Mr. Hennen of Parcel No. 27-001188-0, questioned the
assessment for his corner lot at the meeting. The corner lot assessment was done in the
same manner as in previous streetscape projects, however in reviewing the assessment
calculations of the area for this parcel, staff has discovered an error. The previous area
assessment for this parcel was on the adopted assessment roll at $144.08 with the
corrected area being reduced by $35.66. The correct area assessment for this parcel is
$108.42.
Staff has prepared Resolution No. 4358,which corrects this assessment and adopts a new
roll as amended by City Council which can then be certified to the Scott County Auditor
for certification on the taxes by November 30, 1995.
ALTERNATIVES:
1. Adopt Resolution No. 4358.
2. Deny Resolution No. 4358.
3. Table Resolution No. 4358.
RECOMMENDATION:
Staff recommends Alternative No. 1., as this would correct an inadvertent mistake on the
assessments to the property owned by Mr. Hennen.
ACTION REQUESTED:
Offer Resolution No. 4358, A Resolution Amending Resolution No. 4342, Adopting
Assessments for Downtown Streetscape - Phase II, Project No. 1993-12 and move its
adoption.

Adopting Assessments
For Downtown Streetscape - Phase II
Project No. 1993-12
WHEREAS, pursuant to proper notice duly given as required by law, the City Council of
the City of Shakopee met and heard and passed upon all objections to the proposed assessments of:
Street reconstruction on 1st Avenue, from Holmes Street to Sommerville Street. All
those properties lying within Blocks 3,4, 23 and 24, Original Shakopee Plat, Section
11, Township 115, Range 23, Scott County,Minnesota.
AND WHEREAS, an error has been discovered in calculating the assessment to one
particular property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE,MINNESOTA:
1. That such proposed assessment together with any amendments thereof, a copy of which
is attached hereto and made a part hereof, is hereby accepted and shall constitute the special
assessment against the lands named herein and each tract therein included is hereby found to be
benefited by the proposed improvements in the amount of the assessments levied against it.
2. Such assessments shall be payable in equal annual installments extending over a period
of ten years, the first installment to be payable on or before the first Monday in January, 1996, and
shall bear interest at the rate of 8.0 percent per annum from the date of the adoption of this
assessment resolution. To the first installment shall be added the interest on the entire assessment
from the date of this resolution until December 31, 1996 and to each subsequent installment when
due shall be added the interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner
may thereafter pay to the County Treasurer the installment and interest in process of collection on
the current tax list, and may pay the remaining principal balance of the assessment to the City
Treasurer.
4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and
shall certify annually to the County Auditor on or before November 30th of each year the total
amount of installments and interest on assessments on each parcel of land which are to become due
in the following year.

RE: Ice Arena Open Skating Time
DATE: November 29, 1995
INTRODUCTION:
The Ice Arena portion of the Community Rec Center facility is scheduled for
completion this Friday. However, the remainder of the facility will not be open to the
general public until January 15th. Staff is seeking City Council direction with respect to
open skating time between now and January 15th.
BACKGROUND:
Since the majority of the Community Rec Center facility is still under construction
and access to the Ice Arena facility is limited, staff is recommending that the open skating
time between now and the scheduled opening date for the entire facility be canceled with
the exception of afternoon open skating hours between December 26th through 29th. On
Monday,November 27th, staff presented this concept to the Shakopee Park&Recreation
Advisory Board for their consideration. The Shakopee Park&Recreation Advisory
Board is recommending that the hours originally scheduled for open skating between now
and January 15th be sold. The Board felt that we should hold off on regular open skating
hours until such time that the entire facility is ready for the general public to access. The
Board is also recommending to City Council that open skating hours during the Christmas
Break be billed as a "sneak preview" and that access to open skating be made available at
no charge to the general public.
Staff will have no problem selling the open skating hours that are available. This
will provide added revenue to help offset facility operating costs and improve the overall
budget outcome.
ALTERNATIVES:
1. Direct the appropriate City officials to sell open skating hours between now and
the official grand opening date and that open skating during Christmas break be
made available as a "sneak preview"with no admission charge.
2. Do not sell the open skating time between now and the official facility grand
opening date and do not offer a "sneak preview"week with no admission charge
during Christmas break.
3. Table action pending further information from staff
STAFF RECOMMENDATION:
Staff recommends Alternative#1.
ACTION REQUESTED:
Direct the appropriate City officials to sell open skating hours between now and
the official grand opening date and that open skating during Christmas break be made
available as a "sneak preview"with no admission charge.

kindness . We just wanted you to know what an outstanding
Officer we think he is . It is comforting to know that there
