INTRODUCTION
The bids for the Municipal Swimming Pond Improvement Project were opened on October 12,
1999. The purpose of this item is to consider awarding a contract for the project to the apparent
low bidder. Attached is Resolution No. 5232 for City Council's consideration. The project's
construction costs were budgeted at$872,500..00 plus 5%contingency of$43,500.00. Therefore,
the total estimated cost of the project was $916,000.00.
BACKGROUND
The bids for this project were opened this morning at 10 a.m. in the Council Chambers of City
Hall. The following is a summary of the bids received:

recommends awarding the contract for this project to the low bidder Pool Construction Company
of 201 W. Travelers Trail, Burnsville, Minnesota.
ALTERNATIVES
1. Award the contract to the low bidder Pool Construction Company and adopt Resolution No.
5232.
2. Award the contract to Olympic Pools and adopt Resolution No. 5232
3. Award the contract to Wanzek Construction and adopt Resolution No. 5232.
4. Table this item for additional information.l
5. Reject all bids and re-bid the project at a later date.
RECOMMENDATION
Alternative#1
Staff recommends awarding the contract to Pool Construction Company of 201 W. Travelers
Trail, Burnsville, Minnesota 55337. Staff also recommends Alternates 2 (A. Sand or B. Pea Rock)
and 3. (Stainless Steel Inlet Loop)be included with this project. The unit price of liner repairs is
$10 per square foot.
Staff recommends waiving the building permits fees for this project.

WHEREAS: pursuant to an advertisement for bids for the Municipal Swimming Pond
Improvement project, bids were received, opened and tabulated according to law, and the
following bids were received complying with the advertisement:
Olympic Pools of Shakopee, MN $840,000.00
Wanzak Construction of Fargo, ND $828,000.00
Pool Construction Company of Burnsville, MN $756,610.00
AND WHEREAS, it appears that Pool Construction Company of 201 West Travelers
Trail, Burnsville, Minnesota 55337 is the lowest responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
The appropriate City Officials are hereby authorized and directed to enter into an contract
with Pool Construction Company of 201 West Travelers Trail, Burnsville, Minnesota
55337 in the name of the City of Shakopee for the Municipal Pond improvements
according to the plans and specifications therefore approved by the City Council and on
file in the office of the City Clerk, including alternates two and three.
The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been successfully executed.

SUBJECT: Community Center Sign Award
DATE: October 8, 1999
INTRODUCTION:
At its meeting on October 12th,the City Council will be asked to accept the quote of
Menke Wood Products for construction of the Community Center sign.
BACKGROUND:
In May,the City Council discussed the need to construct an exterior identification sign at
the Community Center utilizing tax increment monies. According to the State law in
effect at that time,the sign had to either be constructed, or under contract by July 1st in
order to utilize Tax Increment Funds, which remained following construction of the
Community Center.
Subsequently,the Legislature changed the usage date to January 1, 2000. Councilor Link
provided staff with plan drawings, and staff proceeded to obtain quotes.
However,the quotes were not easy to come by. A total of 13 companies were contacted
over several months; only one responded with interest. That was Menke Wood Products,
who submitted a bid of$6,900.
BUDGET IMPACT:
The work must either be completed, or be under contract by January 1, 2000, in order to
utilize tax increment monies. Sufficient monies remain in the Community Center account
for the $6,900.
RECOMMENDATION:
We recommend that the Council accept the bid of Menke Wood Products, and direct that
they proceed with construction of the sign.
ACTION REQUIRED:
If the Council concurs, it should,by motion, accept the bid of Menke Wood Products for
$6,900, for the construction of the Community Center exterior identification sign.

SUBJECT: Draft Planned Residential District Regulations
DATE: October 7, 1999
INTRODUCTION/DISCUSSION:
As discussed at the last joint meeting, staff has prepared a draft set of regulations for the
proposed planned or mixed use residential areas on the draft land use map. The proposed
structure of these regulations is as follows:
• 1-and 2-family dwellings would be permitted,as would other typically permitted
uses such as parks and public buildings;
• Medium density,multiple family residential,neighborhood commercial, and mixed
use projects could be allowed after"site plan approval",which requires review by
both the Commission and the Council;
• Design standards for the listed uses are proposed to be the same as the standards
for each of the districts(e.g. medium density,neighborhood commercial).
Staff is seeking reaction to the general approach and the specifics of the draft ordinance.
If there is general concurrence on proceeding, staff will schedule it for hearing before the
Commission at its November 4th meeting.
Also provided for general information is a memo that lays out the relationship of text
amendments passed or underway to the priority strategies identified in April of this year.
REQUESTED ACTION:
Provide staff with any additional direction regarding the draft district regulations.

SUBJECT: Text Amendments on October 7, 1999 Planning Commission Agenda
DATE: October 7, 1999
INTRODUCTION/DISCUSSION:
After the first two joint meetings after the imposition of the moratorium was imposed,the
following action strategies were identified:
• Develop better transitions to and from single-family districts
• Physical buffering
• Commercial districts
• Subdivision ordinance and criteria
• More PUD control
• Disclosure Statements
• Signs
• Mixed use zoning
• Open Space
The amendments on this evening's agenda have been developed in direct response to these
strategies. Following is how I see them slotting in;
• Develop better transitions to and from single-family districts
The proposed definitions in Sec. 11.02, as well as the addition of single fami41
dwellings as a permitted use in a number of districts is intended to clarify uses,
and allowflexibilityfor scattered housing types
• Physical buffering
The proposed amendment to Sec. 11.60 directly addresses this concern.
• Commercial districts
The two new proposed districts are specifically intended to provide better
transitions to and from classes of commercial uses.
• Subdivision ordinance and criteria
The subdivision ordinance has, of course, been passed The criteria should be
scheduled for consideration by the Council in November.
• More PUD control
Amendment of the various zones to clarify PUDs as permitted uses directly addresses
this strategy.
• Disclosure Statements
The conversion to a site plan approval process addresses concerns about the notice.
• Signs
This item needs to be completed
• Mixed use zoning
The draft district regulations that will be reviewed next Tuesday are a direct response
to this strategy, and should be before the Commission in November.
• Open Space
In addition to the above, related amendments will be before the Commission(probably in
November on the following topics;
• Tree preservation and replacement,
• Additional screening provisions,
• Infrastructure review for PUD, CUP and plat approval

SEC. XX.XX. Planned Residential District
Subd. 1. Purpose. The purpose of the Planned Residential District(PRD)is to provide
areas for the mixed-use development; including single-family detached, medium-density,
and high-density residential, as well as compatible neighborhood commercial and service
uses. By allowing mixed-use development,the PRD provides a mechanism for providing
a range of housing types and easy accessibility to services either within a single
development or area of the City of Shakopee.
Subd.2. Permitted Uses. Within the Planned Residential District,the following shall
be permitted uses.
A. single family detached dwellings;
B. two(2)family dwellings;
C. public recreation;
E. utility services;
F. day care facilities servicing twelve(12)or fewer persons;
H. public buildings.
G. adult day care centers subject to the following conditions:
The adult day care centers shall:
1. serve 12 or fewer persons;
2. provide proof of an adequate water and sewer system if not served by
municipal utilities;
3. have outdoor leisure/recreation areas located and designed to minimize
visual and
noise impacts on adjacent areas;
4. the total indoor space available for use by participants must equal at least
40 square feet for each day care participant and each day care staff
member present at the center. When a center is located in a
multifunctional organization,the center may share a common space with
the multifunctional organization if the required space available for use by
participants is maintained while the center is operating. In determining the
square footage of usable indoor space available, a center must not count:
a) hallways, stairways, closets, offices, restrooms, and utility and
storage areas;
b) more than 25 percent of the space occupied by the furniture or
equipment
used by participants or staff; or

c) in a multifunctional organization, any space occupied by persons
associated with the multifunctional organization while participants
are using common space; and
i) comply with all other State licensing requirements.
Subd.3. Uses Permitted with Site Plan Review. Within the Planned Residential
District, the following uses of structures or land may be allowed after site plan review
and approval:
A. medium density residential development as allowed under City Code Sec.
11.32,Medium Density Residential Zone, and according to the design
standards contained therein;
B. multiple family residential development as allowed under City Code Sec.
11.34 and according to the design standards contained therein;
C. neighborhood commercial development as allowed under City Code Sec.
XX.XX and according to the design standards contained therein;
D. clinics;
E. nursing homes;
F. churches and other places of worship;
G. public or private schools
H. relocated structures;
I. structures over two and one-half(2 '/s) stories or thirty-five(35) feet in
height;
J. relocated structures;
K. developments containing more than one principal structure per lot;
L. developments containing more than one permitted use and/or use permitted
with site plan approval;
M. other uses similar to those permitted in this subdivision, as determined by the
Board of Adjustment and Appeals.
Subd. 4. Permitted Accessory Uses. Within the Planned Residential District the
following uses shall be permitted accessory uses:
DRAFT
A. Any incidental repair or processing necessary to conduct a permitted principal
use;
B. parking and loading spaces;
C. temporary construction buildings;
D. decorative landscape features;
E. other accessory uses customarily appurtenant to a permitted or conditional
use, as determined by the Zoning Administrator.
Subd. 5. Design Standards.
Except as otherwise provided above, design standards in the Planned Residential District
shall be as found in City Code Sec. 11.28, Urban Residential Zone(R-1B)
