Michael Leek, Community Development Director SUBJECT: Appeal of the Denial of Variances for Perry Dental Office MEETING DATE: August 7, 1997 INTRODUCTION: At it's August 5th meeting, the City Council directed staff to prepare a resolution supporting the appeal of Perry Dental Office of the Board of Adjustments and Appeals denial of setback and parking variances. The draft resolution containing specific findings is attached for the Council's consideration. ALTERNATIVES: 1. Approve Resolution No. 4718 as presented, approving Perry Dental Office's appeal and granting an 8 foot rear yard setback variance, a 5 foot parking setback variance and a 2 space variance from the parking requirements. 2. Approve Resolution No. 4718 with revised findings. ACTION REQUESTED: Offer and approve a motion relative to Resolution No. 4718. Res.4718, 1997 1 P RESOLUTION NO. 4718 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING PERRY DENTAL OFFICE'S APPEAL OF THE BOARD OF ADJUSTMENTS AND APPEALS DENIAL OF REQUESTED VARIANCES, AND APPROVING; 1) AN 8 FOOT VARIANCE TO THE REQUIRED 30 FOOT REAR YARD SETBACK TO PERMIT A REAR YARD SETBACK OF 22 FEET, 2) A 5 FOOT VARIANCE TO THE REQUIRED 5 FOOT PARKING SETBACK TO ALLOW A 0 FOOT SETBACK, AND 3)A 2 PARKING SPACE VARIANCE TO THE REQUIRED 40 PARKING SPACES TO ALLOW 38 PARKING SPACES. WHEREAS, Wallace Perry, Owner, filed an application dated June 27, 1997, for a variance under the provisions of Chapter 11, Land Use Regulation (Zoning), of the City of Shakopee City Code, Section 11.36, Subd. 5.C. for an 8 foot variance from the 30 foot rear yard setback in the Highway Business (B-1)Zone; and WHEREAS, the subject property is presently zoned Highway Business (B-1); and WHEREAS,the property upon which the request is being made is legally described as: Lot 1, Block 1, Shakopee, according to the record plat thereof on file and of record in the Office of the County Recorder in and for Scott County, Minnesota and that part of the East Half of Spencer Street lying southerly of the westerly extension of the northerly line of Lot 1, Block !, City of Shakopee as on file and of record in the Office of the County Recorder and northerly of a line distant 43.00 feet northerly and radial of the center line of CSAH NO. 101.; and WHEREAS, notice was provided and on July 24, 1997, the Board of Adjustments and Appeals conducted a public hearing regarding this application, at which it heard from the Community Development Director and invited members of the public to comment. WHEREAS, the Board of Adjustments and Appeals denied the requested variances; WHEREAS, the applicant timely appealed the determination of the Board, and the City Council reviewed the appeal at it's meeting of August 5, 1997; and WHEREAS, the Council found the Board's findings 1.A, 1.B, 1.E, and 2 to be in error. Res.4718,1997 2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: That the Perry Dental Office's appeal of the Board's denial of the requested variances is upheld based on the following findings with respect to City Code Section 11.89, Subd. 2, "Criteria for Granting Variances;" Finding I.A. The property cannot be put to a reasonable use if the addition was forced to comply with building setbacks, number of parking spaces required, and parking setbacks. The subject property and surrounding area were developed prior to the current ordinance requirements, and in a fashion similar to the Downtown District(to which it is adjacent), which resulted in small lots and setbacks. The size of the subject property and similar lots preclude reasonable use of the property for the applicant's dental practice, or other similar,permitted uses, without expansion. The size of the project as proposed represents the smallest expansion that would accommodate the applicant's dental practice. Finding I.B. The plight of the landowner is due to circumstances unique to the property. Use of the property is constrained by the proximity of County Road 69, utility and trail easements, as well as the placement of the existing building on the lot. The existing building was developed prior to the current zoning requirements, and it's location limits expansion options on the site. Finding 1.E The problems extend beyond economic considerations, in that the configuration of the subject property and existing building limit the applicant's ability to expand and make reasonable use of the property. Specific limitations include the proximity of trail and utility easements to the existing building. Finding 2 The variance as requested would be in keeping with the spirit and intent of Chapter 11. The project as proposed by the applicant maximizes the property's compliance with the setbacks and standards of the B-1 (Highway Business) district to the extent feasible. The property would provide 38 of the required 40 parking spaces and would maintain a substantial, 22 foot rear yard setback. BE IT FURTHER RESOLVED, that the requested variances are hereby granted subject to the following conditions; Res.4718, 1997 3 1. That the owner repair and/or replace any portion of the trail that is damaged during construction. 2. That the owner comply with any special fire protection and flood proofing which may be required if necessary. 3. That the owner obtain any permits necessary from the Minnesota Department of Transportation or Scott County for work within the rights-of- way. 4. That the ground floor elevation must be at or above 723 feet. This figure should be indicated at the time of building permit application. The other two scheduled are also Thursdays, August 21st and 28th. • In May,the City Council decided that these would begin at 4:30 PM. However, on August 7th, the Council Chambers are scheduled for a public meeting to discuss changes to the Comprehensive Plan. This will begin at 6:00 PM. Therefore, after discussions with the Mayor, we are moving the start of the August 7th meeting to 4:00 PM. The issues to be discussed are shown on the attached agenda. We will have draft copies of the August 7th discussion items available for distribution at the August 5th City Council meeting. Please advise if you have any questions. We will not be televising this, unless otherwise directed. Background Enclosed for Council review is the first round of General Fund revenue projections, the Police Division and the Engineering, Street, Shop and Park Maintenance divisions budget proposals . Also included is the original version budget booklet for the Police Division for greater detail and explanation. Council has not yet reviewed the 5 year Equipment List and the Equipment Fund budgets . Changes in the equipment list may impact the operating budget in 1998 . The file pockets may make it easier for Council to keep the budget material together and bring the folder back to future budget discussions. Action Discuss and give staff direction. There has to be a process fbr this action to be considered valid. The grievance has to be heard by the Shakopee Community Access Advisory Commission and then the Shakopee Cable Access Corporation. I'm sure you can appreciate the value of due process since your campaign revolved Around open communication. The corporation by-laws, as amended,also support this process. The overview of our communication which you presented to the City Council was not totally accurate. The efforts that you made to meet with me gave rile no indication as to the purpose of the requested meeting, I was simply issued a mandatory du ective by Mr. McNeill to attend. Ts this how you routinely schedule your meetings with staff and commissioners?: Both requests also came rapidly on the heels of my overhearing the public broadcast of a private conversation between Councilman Sweeney,Councilman Zorn and Mark McNeill in which they were plotting how to"blind side" me at the cable mooting scheduled for that evening. Shortly after having viewed this conversation,I received a call from Councilman Zo211 thanking me for support in an effbrt of his and acting surprised and unknowledgeable about the upcoming meeting which 1 knew he was planning to attend. Based on these thcts, I feel I had every reason to be apprehensive about meeting with anyone representing the City at that point. I feel that these activities were not representative of toast building or problem solving but rather were underhanded and devious on the part of Mr. Sweeney,Mr. Zorn and Mr. McNeil. I have to believe that}jou were knowledgeable and were condoning these methods of problem resolution. I would have been more than happy to meet with you upon your first request had you shared with me the information that you later gave me In your response letter. Upon receipt of this response letter I Indicated to you in writing my desire and willingness to meet and discuss with you the Issues that you made reference to I believe your hands were far from tied in dealing with this situation. My understanding is that there is a process for airing a grievance which I have as en option. You initiated a public charge of"non perfbrmance" against me. I feel this charge has no merit and is discriminatory. I have brought many vital issues forward during my tenure. Mr Sweeney has served on the City Council for a number of terms, The financial concerns and TRS non- compliance was not new issue. These problems had been escalating since 1988. Where was Mr. Sweeney then? Early in my tenure I ran across Mr. Sweeney working out in his yard and stopped to visit with him. I brought up my concerns about the vague account`,ing methods and _ J _ _ __ _ .. i.� 1 v . . .. lack of accountability for public funds. At this time Mr. Sweeney began taking an active interest in the Commission/Board which resulted in the liaison position which he now holds although never making public reports regarding sctivitics/conccrns of the Commission. His only"report" after months of service was that ono of my non-performance. How irdnic!II My disagreements with the Studio Coordinator have tbcused mainly on programming and conflict of interest issues regarding private business versus public domain. As a result, programming schedules are now appearing in the Shakopee Valley News. We are now taping the local school board meetings on a regular basis and I have been working diligently on developing better communication with the school district. (I might add that I recently had a conversation with an official from the school district who happens to be a former city council member who stated that the district had given up on trying to work with Cable Access since it was so obviously a private business run from a public fhcllity). There is more diversity in the programming schedule....more than just Shakopee High School Videos which were the predominant program theme at the beginning of my tenure, and the studio is now open on Saturday mornings to Accommodate the public....And all of this constitutes, in your opinion,non-performance. You servo eS an elected official....I do nut. There is a procedure that is not tiling followed;either through lack of knowledge or by choice to ignore thinking the accused might not know any better.
