SUBJECT: Workshop on Dial A Ride Services
MEETING DATE: July 28, 1998
INTRODUCTION:
At its regular meeting of July 21, 1998 the Council requested a work session to discuss 1)
Shakopee Services interest in providing child-only dial a ride or normal dial a ride service, and
2)response to recent complaints regarding dial a ride service. Shakopee Services is
interested in submitting a proposal, and has indicated they will try to put together a
tentative proposal for the table on Tuesday evening. George Bentley will be at the
meeting to discuss the complaints and actions that have been or will be taken to address
them.

Introduction
Council is requested to approve of the renewal of property and
liability insurance coverage from the League of Minnesota Cities.
Background
Attached is a list of property/liability insurance premiums for
the renewal of the present coverage with the League of Minnesota
Cities insurance Trust (LMCIT) . The policy period is August 1,
1998 to July 31, 1999 .
Basic Policy
The policies proposed are basically the same as current coverage.
There are included several enhancements that benefit the city such
as replacement cost coverage for buildings and equipment, blanket
coverage for equipment costing under $25, 000 etc. . The premiums
are slightly larger than last year but more items and value are
covered. Please see attachment A. The total deposit premium has
increased from $193, 817 to $206, 531 covering the City, SPUC and
EDA. The primary reasons for the increase are an unfavorable loss
experience (partly Ryan and Knutson lawsuits) , increased
expenditure basis and rate changes. Attachment B also shows the
dividend history and the loss history for recent years.
The LMCIT has been an exceptional value to the city over the last
12 years (through 1996) as evidenced by the following figures;

All of the coverages are from the League of Minnesota Cities
Insurance Trust.
The policies of course are not prepared, but there is more detail
available on the proposals for any Council member that desires it.

Umbrella Policy
Council did not budget for an umbrella liability policy nor
has there been a recent request for or discussion of getting
another umbrella policy. The city has not had an umbrella
policy for about 11 years. The League reports that about 25%
of the cities insured have an umbrella policy. There is some
exposure that may not be not covered by immunity,
particularly in the area of federal legislation such as civil
rights and discrimination.
LMCIT has increased coverage to match the immunity limits
increased by the Legislature. Limits went from $600, 000 to
$750, 000 on 1/1/98 .
Council must decide whether or not to waive the statutory tort
limits. Attachment C explains the two options. Waiving the
limits is recommended to be consistent with prior years coverage
and to provide more available coverage to single claimants. The
city' s agent also recommended the waiver.
The budget contains $161, 120 for insurance (not counting
employee group or work comp. insurance) and deductibles across
all funds, excluding SPUC. SPUC shares in the cost of the
insurance but their share for this year has not been calculated
yet, last year it was $64,430 .
Action Requested
1 . ) Move to accept the property/liability insurance renewals from
the League of Minnesota Cities Insurance Trust with a deposit
premium of $206, 531.
2 . ) Move to waive the statutory tort limits.

LMCIT LIABILITY COVERAGE-WAIVER FORM
Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide
whether or not to waive the statutory tort liability limits to the extent of the coverage purchased. The
decision to waive or not to waive the statutory limits has the following effects: _ •s
• If the city does not waive the statutory tort limits, an individual claimant would be able to recover no
more than$300,000 on any claim to which the statutory tort limits apply. The total which-all claimants
would be able to recover for a single occurrence to which the statutory tort limits apply would_belimited
to $750,000. These statutory tort limits would apply regardless of whether or not the city purchases the
optional excess liability coverage.
• If the city waives the statutory tort limits and does not purchase excess liability coverage,a single
claimant could potentially recover up to$750,000 on a single occurrence. The total which all claimants
would be able to recover for a single occurrence to which the statutory tort limits apply would also be
limited to $750,000,regardless of the number of claimants.
• If the city waives the statutory tort limits and purchases excess liability coverage,a single claimant
could potentially recover an amount up to the limit of the coverage purchased. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to the amount of coverage purchased,regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.
This decision must be made by the city council. Cities purchasing coverage must complete and return
this form to LMCIT before the effective date of the coverage. For further information, contact LMCIT.
You may also wish to discuss these issues with your city attorney.
The City of accepts liability coverage limits of$ from the League of
Minnesota Cities Insurance Trust(LMCIT).

SUBJECT: Authorization of Street Cut for Shakopee Public Utilities
on 6th Avenue & Spencer Street

INTRODUCTION:
Attached is a letter from Pete Malamen of HDR Engineering, the consultant working for
Shakopee Public Utilities Commission (SPUC), is requesting a curb cut for a new
conduit installation on Spencer Street by 6th Avenue. This agenda item is for Council
authorization for this street cut off of Spencer Street,which is less than five years old.
BACKGROUND:
In the 1993 Street Reconstruction Project, Spencer Street, from 4th Avenue to Shakopee
Avenue was reconstructed as part of this project. The City adopted a policy in 1986
which required City Council authorization for any street cut permit on streets that have
pavements that are five years old or less. This conduit installation was not foreseen in
1993-1994 and cutting the street pavement is necessary to properly install the conduit
under an existing U.S. West's conduit. This work is scheduled to begin shortly if Council
authorizes the street permit and is necessary to keep the 1998 Reconstruction Project on
schedule.
ALTERNATIVES:
1. Authorize staff to execute the street cut permit for Shakopee Public Utilities on
Spencer Street by 6th Avenue.
2. Do not approve the street cut permit at this time.
3. Table for additional information.

RECOMMENDATION:
Staff recommends Alternative No. 1.

Make a motion authorizing staff to execute a permit for work in the public right-of-way
on Spencer Street by 6th Av.enue to Shakopee Public Utilities Commission.

Re: Spencer Street Crossing
Dear Bruce:
HDR Engineering has been retained by SPUC to design a tie between Feeders#8 and#9
out of the Shakopee Substation. The tie is needed to shift load from Feeder#8 to Feeder
#9. This is being done due to the increase in electrical load on Feeder#8. The proposed
design includes four blocks of underground conduit, to be installed in conjunction with
the 6�'Ave. Reconstruction Project. In general the conduit is going to be placed under the
sidewalk and streets from Fuller to Spencer. In order for the tie to connect to an existing
overhead feeder circuit, it must cross Spencer St.
HDR proposes to open cut a 4' wide strip across Spencer St, as shown in the attached
drawing, in order to bury that portion of the feeder. We investigated the possibility of'
directionally boring the conduits under Spencer and determined it was not feasible, due to
the existing water main, sewers and telephone duct bank under the street. Because a need
for this tie could not be foreseen when Spencer was resurfaced in 1994, no provisions for
an underground crossing were made. Therefore,we are requesting to open cut Spencer
Street at 6th Ave. at this time.
An alternate route, employing an overhead crossing of Spencer St,has been examined.
This route would involve installing underground south along Sommerville St. from 6th
Ave. for '/2 a block, and east to Spencer through an alley. The existing overhead crossing
over Spencer Street would be then rebuilt. As outlined below,the alternate route is more
expensive:

Let me begin by thanking you for the honor of considering Shakopee Services, Inc.
as a contractor for Dial-A-Ride services. May I also commend you for addressing the
needs of the Dial-A-Ride users, as well as the best interests of the entire community.
As a school bus contractor in ISD 720 for over 30 years, we see Dial-A-Ride
services as a viable diversification of our business, however, we are not prepared to offer a
proposal at this time. We would ask to be notified when the current contract expires and
would appreciate your consideration for a bid submitted at that time.

Issue: Complaints seem to be increasing
Initial Approach: Establish a more precise complaint reporting system
• Effective 7/28/98 each complaint will be listed on a customer report form
• Responses directed to be more proactive
• Follow-ups to the complaint will be identified on the form
• Monthly meetings will be held with Laidlaw to review/discuss complaints and responses
Issue: Number of vehicles not adequate during peak hours
Initial Approach: Add third vehicle from 7:00 a.m. to 9:00 a.m., and from 3:00 p.m. to 6:00 p.m.
• Laidlaw will have to hire additional driver(s)
• Need for peak hour vehicles will increase once school begins in September
• Goal is to add vehicle before 9/1/98
Issue: Trip denials seem to be increasing
Initial Approach: Add additional peak hour vehicle
• Most trip denials tend to be during peak hours
• There are more standing orders during peak hours, so fewer demand seats available
• Current denial rate is about 3%; SMTC denial rate is about 8%
• Future: Review standing orders policy, work to increase demand seats
Issue: Buses not waiting a reasonable time during the pick-up before departing if no one comes out to
board the vehicle.
Initial Approach: Drivers to be immediately instructed to wait at least three minutes for pick-ups
• Charging two fares if driver has to come back for pickup is suspended for now
• Future: Review policy on pickup window
