Shakopee City Council August 2, 2017 FROM: Darin Nelson, Finance Director TO: Mayor and Council Members Subject: Transfer of$2,319,076 from the Amazon TIF District #17 Fund to the Capital Improvement Fund, Sanitary Sewer Fund and Storm Drainage Fund to reimburse respective funds for the 4th Avenue reconstruction project. Policy/Action Requested: Approve the interfund transfer of$2,319,076 from the Amazon TIF District #17 to Capital Improvement Fund, Sanitary Sewer Fund and Storm Drainage Fund in the amounts of $1,892,029.08, $294,337.59 and $132,709.33, respectively. Recommendation: Approve the motion as requested. Discussion: The 4th Avenue reconstruction project #15-7 was spurred by the Amazon development which was accounted for in the Capital Improvement Fund. The increment generated by the district over the next nine years beginning in 2017 will cover a majority of the project costs. The project costs to date are $2,371,867 with additional retainage of approximately $40,000 remaining. The city's increment available through the TIF district is limited to $2,319,076. The approximately $93,000 of expenditures beyond the increment cap are funded with available fund balance within the Capital Improvement Fund. Rather than reimburse the funds each year via annual increment payments, it is cleaner to reimburse the funds incurring the project costs via one lump-sum transfer from the Amazon TIF #17 Fund. The annual increment payments will then remain in the Amazon TIF #17 fund to replenish the fund's negative cash balance. This project incurred sanitary sewer and storm drainage costs of$294,337.59 and $132,709.33, respectively. The transfer from the Amazon TIF #17 Fund will reimbursement these funds in full with the remaining available increments funds of$1,892,029.08 being Page 3 of 85 transferred to the Capital Improvement Fund. Recommendation: Approve the temporary on-sale liquor license. Discussion: The VFW has applied for a temporary liquor license for the River Dalley Festival being held in Huber Park on September 16, 2017. The VFW will be serving on Saturday from I I am to 7 pm. Participants at the festival will be carded and be given a wristband to purchase alcohol. Hensen, City Clerk TO: Mayor and Council Members Subject: Fee Schedule Update Policy/Action Requested: Adopt ordinance 967 amending the city's adopted 2017 fee schedule. Recommendation: Approve the above motion. Discussion: On January 3, 2017 the council repealed section 115.01 - 115.15 regulating motion picture theaters. The fee for a movie theater permit needs to be removed from the fee schedule. As the Community Center project has come to completion. Some fees needed to be updated. Many patrons will be coming to the community center to use the playground only. Staff intended to have a lower fee that would be for the playground only and not include all of the other amenities the general daily fee includes. When the 2017 fees were set the youth daily fee and the playground fee were set the same. The amendment is to establish the lower playground only fee, then the daily fee. In addition we are changing the youth fee for non-resident to be the same as the youth fee for a resident as it has been prior to 2017. Verifying the residency of a youth is very difficult and not all youth need a parent present to utilize the Community Center. We are also adjusting the ages of a youth to be consistent in all areas of the Community Center. This ordinance has been posted on the city's website since July 21, 2017. Posting on the website is complete in compliance with MN Statute 415.19. This statute was adopted during the most recent legislative session and requires notification of proposed ordinances 10 days in advance of their consideration on the city's website. Hensen, City Clerk TO: Mayor and Council Members Subject: Pullman Club has requested to use a section of the public parking lot in front of their business for upcoming events and suspend city code 114.11 allowing consumption of alcohol ' parking lot. Policy/Action Requested: Approve the suspension of city code 114.11 Consumption and possession of alcoholic beverages on street, public property, private parking lots to which the public has access, and other private property for August 11, 19 and October 7, 2017 for the Pullman Club, on condition that all documents and permits are completed. Recommendation: Approve the above motion. Discussion: The Pullman Club has submitted a request to use a section of the public parking lot in front of their business for a few events. A map is attached for you review. Along with the request they are asking the council to suspend city code 114.11 Consumption and possession of alcoholic beverages on street, public property, private parking lots to which the public has access, and other private property during these events. No glass containers will be used. All alcohol will be purchased within the Pullman Club and participants going outside will have wristbands. Pullman staff will be monitoring events from the tented area during all times and activities. Shakopee City Council August 2, 2017 FROM: Nate Burkett, Assistant City Administrator TO: Mayor and Council Members Subject: Declare movable property in the 129 Holmes City Hall building as surplus. Policy/Action Requested: Declare property remaining in the 129 Holmes Street City Hall building as of August 7, 2017 as surplus and order appropriate sale or disposal. Recommendation: Approve policy/action as requested. Discussion: There will be a wide range of filing cabinets, desk and cubicle systems, chairs, miscellaneous office furniture, and miscellaneous office items remaining in the City Hall and Engineering building following our move to city hall. Staff will take appropriate action to sell, donate or dispose of all items. There are several paintings that were painted by Shakopee residents upon the opening of the 129 Holmes building. These paintings will be offered back to the individual who painted them or to the next of kin. Budget Impact: Minimal revenue. Page 22 of 85 *4.B.1. Shakopee City Council August 2, 2017 FROM: Steve Lillehaug, City Engineer/Public Works Director TO: Mayor and Council Members Subject: Approval of a Construction Cooperative Agreement with Scott County for CSAH 15 & CSAH 16 Improvements associated with the Windermere Development. Policy/Action Requested: Authorize the Mayor and City Administrator to enter into a Construction Cooperative Agreement with Scott County for county highway improvements associated with the Windermere Development. Recommendation: Staff recommends approval of an agreement in order to construct the county highway improvements needed to serve the Windermere Development. The Construction Cooperative Agreement defines the cost sharing and project deliverables between the city and the county. A separate developer's agreement will define the cost sharing and project deliverables between the city and the developer. Approval of this agreement is necessary for the development of the area west of CSAH 15 and south of TH 169 to move forward. Discussion• Staff has negotiated with the developer and the county to develop the cost sharing agreement. The main items of the agreement include cost sharing, maintenance of trees in county right-of-way, and other project responsibilities. Attached are the agreement and cost estimate with proposed cost splits as prepared by WSB and Associates who is providing the design of the county roads. The county and developer are in agreement with the cost splits as defined within the terms of the agreement. Budget Impact: The city's cost share for the improvements and other associated costs as defined within the Page 23 of 85 agreement will be funded by the Capital Improvement fund (CIF) and the Storm Drainage fund. ATTACEIlVIENTS: ❑ DRAFT CR 15&16 Agreement Page 24 of 85 County Project No. CP 16-27 City of Shakopee County of Scott CONSTRUCTION COOPERATIVE AGREEMENT THIS AGREEMENT, made and entered into this day of , 20171 by and between the County of Scott, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "County" and the City of Shakopee, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "City". RECITALS: A. The County and the City seek to make the following improvements at the CH 16/CH 15 intersection: 1. County Highway (CH) 16: Extend new roadway 1,800 ft west of CH 15; 4 lane roadway east of proposed Windermere Way with left and right turn lanes tapering to a 2 lane roadway west of Windermere Way; curb and gutter with raised center median; Trail on the north side and sidewalk on the south side. 2. County Highway (CH) 15: Adding left turn lanes on northbound and southbound CH 15 at CH 16 intersection; adding right turn lane on southbound CH 15 to westbound CH 16; adding trail along the west side of CH 15 between CH 16 and TH 169 ramp connections; adding the west leg of Windermere Way at (CH) 15. B. The above described Project lies within the corporate limits of the City. C. D.R. Horton ("Developer") shall enter into a separate agreement with the City to define the Developer's project deliverables that will include the Developer's cost participation and construction responsibilities. It shall be the City's sole responsibility to ensure the garuantee of the Developer's deliverables as outlined hereinafter. D. The City and Developer have prepared an estimate of quantities and unit prices of material and labor for the above described Project and an estimate of the total cost for contract work in the sum of two million six hundred sixty-two thousand five hundred thirty-five dollars and twenty cents ($2,662,535.20). The County shall pay for the mill and overlay on CH 15 with the Developer paying for everything else, including the turn lanes, trail, and drainage. On CH 16, the County shall pay for additional roadway width outside a standard 37 ft wide city collector street, the additional pavement section required for a County standard 10 ton roadway, the median cost between CH 15 and Page 25 of A County Project No. CP 16-27 City of Shakopee County of Scott Windermere Way and the City/Developer shall pay for everything else. This includes paying for full median costs west of Windermere Way, trail and sidewalk, lighting, and drainage. A copy of said estimate and cost participation figures (marked Exhibit "B") are attached hereto and made a part hereof. E. It is contemplated that said improvement work shall be carried out by the parties under the provisions of Minn .Stat. Sec. 162.17, subd. 1. NOW, THEREFORE, IT IS HEREBY AGREED: 1. The Developer received bids for this work and are entering into a contract with the successful bidder at the unit prices specified in the bid of such bidder, according to law in such case provided for counties. The contract will include the plans and specifications prepared by the City/Developer or its agents, which plans and specifications are by this reference made a part hereof. 2. The County shall have overall authority to inspect the construction of the contract work for the Project. The construction staking and materials testing services will be provided by the City and Developer. The County shall have ultimate authority in initiating and determining change orders, supplemental agreements and final quantities. The City Engineer shall cooperate with the County Engineer and his staff at their request to the extent necessary, but shall have no other responsibility for the supervision of the work other than the City's utility work which is included in the project. 3. The City shall reimburse the Developer for the City's share of the construction cost of the contract work for said Project by the total final contract construction cost being apportioned between the parties using the proportionate shares set forth in the Est. Qty. columns of the estimated cost summary and cost participation figures, hereby attached and incorporated as Exhibit "B". It is further agreed that all estimated costs referred to in this agreement are only estimates and that the unit prices set forth in the contract and the final quantities as measured by the County Engineer shall govern in computing the total final contract construction cost for apportioning the cost of the Project according to the provisions of this paragraph. 4. The Developer shall pay 100% of the Roadway Design and Construction Plan and Specifications preparation. 5. The Developer shall provide and dedicate the required right of way and easements and transfer to the County. 6. The City and Developer are proposing trees along the proposed CH 16. The City shall be responsible for all maintenance of the trees and shall accept full responsibility for all aspects of the tree Page 26 of 82 County Project No. CP 16-27 City of Shakopee County of Scott plantings including repairing the roadway and curb if the root systems create issues, trimming/removing if there are future sight line issues or if the County determines it has become an issue in any way, removing for future road widening. 7. The County shall, based on the contract price, make payment to the City 100% of the County's share of the construction costs as partial payment within thirty (30) days after award of contract or execution of this Agreement, whichever is later. The City will prepare and forward an invoice to the County for the County share. The final amount of the County's share of construction costs of the Project shall be determined upon completion of the Project and any amount remaining due to the City shall be reflected in the City's final, itemized, statement of the Project costs submitted to the County. In the event the initial payment exceeds the County's share of these final costs, such overpayment shall be returned to the County by the City. 8. The County Engineer shall prepare monthly progress reports as provided in the specifications. A copy of these reports shall be furnished to the City Engineer. 9. In the event that a dispute arises, the County and the City agree that all disputes between them arising out of or relating to this agreement may be submitted, upon agreement of both parties at that time, to mediation, with the cost being shared equally. 10. Since each party is a political subdivision of the State of Minnesota, each party shall maintain general liability and automobile liability coverage protecting itself, its officers, agents, employees and duly authorized volunteers against any usual and customary public liability claims to the limits prescribed under Minn. Stat. Sec. 466.04 and Workers' Compensation in accordance with the Minnesota statutory requirements. 11. All records kept by the City and the County with respect to the Project shall be subject to examination by the representatives of each party. All data collected, created, received, maintained or disseminated for any purpose by the activities of the County or City pursuant to this Agreement shall be governed by Minnesota Statutes Chapter 13, as amended, and the Minnesota Rules implementing such Act now in force or hereafter adopted. 12. The County reserves the right not to issue any permits for a period of five (5) years after completion of the Project for any service cuts in the roadway surfacing of the County Highway included in the Project for any installation of underground utilities which would be considered as new work; service cuts shall be allowed for the maintenance and repair of any existing underground utilities. The City further agrees to provide any and all permanent or temporary right-of-way at no cost to the County on property owned by the City and needed by Scott County for the completion of the Project. 14. The City shall, at its own expense, remove and replace all City owned signs that are within the construction limits of the Project. 15. Initial pavement striping and markings shall be included as part of the Project. The County shall be responsible for all subsequent pavement striping and markings on its county right-of-way as required after the initial work and shall be responsible for one hundred percent (100%) of the subsequent related costs. The City shall be responsible for all subsequent striping and markings on its city right-of-way, including pedestrian markings across the City's roadways, as required after the initial work and shall be responsible for one hundred percent (100%) of the subsequent related costs. 16. The City shall provide and/or perpetuate an adequate electrical power supply to the street lights installed as part of this Project and upon completion of said new street lights installations shall provide and/or continue to provide necessary electrical power for its operations at the sole cost and expense of the City. 17. The City shall be responsible for the maintenance and replacement of the aforementioned street lights including the luminaire and all its components at the sole cost and expense of the City. 18. Upon completion of the Project, the City, at its expense, shall maintain all sanitary and storm sewer appurtenances. 19. Neither the County, its officers, agents or employees, either in their individual or official capacity, shall be responsible or liable in any manner to the City for any claim, demand, action or cause of action of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of the described maintenance, restoration, repair or replacement work by the City, or arising out of the negligence of any contractor under any contract let by the City for the performance of said work; and the City agrees to defend, save and keep said County, its officers, agents and employees harmless from all claims, demands, actions or causes of action arising out of negligent performance by the City, its officers, agents or employees. 20. It is further agreed that each party to this Agreement shall not be responsible or liable to the other or to any other person or entity for any claims, damages, actions, or causes of actions of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of any work or part hereof by the other as provided herein; and each party further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising in connection with or by virtue of performance of its own work as provided herein. 22. It is further agreed that any and all employees of the City and all other persons engaged by the City in the performance of any work or services required or provided herein to be performed by the City shall not be considered employees, agents or independent contractors of the County, and that any and all claims that may or might arise under the Worker's Compensation Act or the Unemployment Compensation Act of the State of Minnesota on behalf of said City employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said City employees while so engaged shall be the sole responsibility of the City and shall not be the obligation or responsibility of the County. Sec. 16C.05, subd. 5, the books, records, documents, and accounting procedures and practices of the County and City pursuant to this Agreement shall be subject to examination by the County, City and the State Auditor. The retention period shall be automatically extended during the course of any administrative or judicial action involving the County or the City regarding matters to which the records are relevant. The laws of the State of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the parties and performance under it. The appropriate venue and jurisdiction for any litigation hereunder shall be those courts located with the County of Scott, State of Minnesota. Litigation, however, in the federal courts involving the parties shall be in the appropriate federal court within the State of Minnesota. 26. In the event any provision of this Agreement shall be held invalid and unenforceable, the remaining provisions shall be valid and binding upon the parties unless such invalidity or non-enforceability would cause the Agreement to fail its purpose. One or more waivers by either party of any provision, term, condition or covenant shall not be construed by the other party as a waiver of a subsequent breach of the same by the other party. 27. Recommendation: Staff recommends accepting the quote and approving the project. Discussion: Through the city's routine sanitary sewer televising program, staff identified a crushed section of sewer pipe located adjacent to County Road 83 approximately 200-ft south of Dalley Industrial Boulevard. It is prudent to perform an immediate repair to this collapsed section of pipe due to the restriction of flow and potential for sewer backup that could occur. The proposed repair includes open excavation of the sewer pipe, removing the approximate 6-ft. section of collapsed pipe and installing a new manhole. A new manhole in this location will provide an adequate repair and will also provide an additional permanent access point to a long segment of existing sanitary sewer. Policy/Action Requested: Adopt Resolution Number 7917 authorizing the appropriate city officials to enter into a contract for sale. Recommendation: Adopt Resolution Number 7917 authorizing the appropriate city officials to enter into a contract for sale with the Shakopee Mdewakanton Sioux Community (SMSC). Discussion• The city acquired these properties through a tax sale agreement for approximately $22,000. Council approved the sale in May 2017 to Topaz Investments and Doggie Doos for the development of a facility to serve the handicapped and a new location for Doggie Doos. Both received Conditional Use Permits for the property. As part of the public notice process, the Shakopee Mdewakanton Sioux Community (SMSC) raised concerns that the site maybe part of a larger burial area. The City engaged Bolton & Menk to complete an archeological review of the area and this property in particular. After initial investigation, Bolton & Menk found that the property had been identified as the potential location of a larger burial area. After preliminary discussions with the State Archeologist, Bolton & Menk suggested that site development could be problematic because of the high probability that archeological resources would be discovered during the development process. The SMSC also discussed its concerns that this area has the high probability of archeological resources. City staff and SMSC have worked together to come up with a solution to protect the resources on this property since it has been identified as part of the historic location of the Page 48 of 85 Mdewakanton Dakota TM* ta Otunwe (Village on the Prairie). Utility easements that have not been recorded will be brought forward for recordation prior to final sale. The SMSC will also likely ask for abandonment of other unnecessary easements. The SMSC plans to reseed the parcel with native grasses and have the property return to a more natural appearance. The facility for handicapped individuals and Doggie Doos have applied for a CUP for the city-owned property at 69/169 and staff will bring forward a preliminary plat once the new road alignment has been finalized. Budget Impact• $100,000 will be placed into the property acquisition fund. Discussion: Shakopee River Dalley Festival will take place on Saturday, September 16, 2017 at Huber Park from I I a.m. - 7 p.m. Summary of Organization Hosting: The Shakopee River Valley Festival is a Shakopee based 501 c3 nonprofit. The board consists of three members: President Joy Newgard, Treasurer Roger Menden (Menden Accounting) and Secretary Showshana Anderson-Boyce. Overview: The Sept. 16 event is the first of what this group would like to become an annual community event for Shakopee. Understanding the importance of both financial management and logistical planning for such events, the group has opted to remain relatively small in the first year. This helps to recruit adequate volunteers, get ideas from the community, build partnerships and gain a comprehensive working knowledge base for such an event. Event Details (see attachment): Food vendors in parking lot locations, interactive community outreach waste recycling education trailer and beer sales at the park shelter. Police support will be contracted at the recommendation of the PD, which is currently 2 officers for 3 hours in duration. If possible, stripe/line spaces on grass area on the north side of Bluff Avenue Parking Signage: 2 free standing `parking' signs to direct parking along Bluff Avenue Emergency Gate: city to unlock gate to allow for passage in advance of event Restroom Supplies: city to ensure additional supplies available (soap, toilet paper) Staff Input: PD: Has a signed contract for police service. No Issues at this time with their setup based on the expected attendance. City Hall: The food trucks have already registered for the event. The VFW temporary liquor license is going to council for approval on August 2. There are no other concerns from the Clerk's office. Public Works: Public works can provide service as requested. Parks and Rec: The River Dalley Festival has a completed Huber Park rental agreement on file and has paid a $500 rental fee (8 hr block) to utilize Huber Park. A $100damage deposit is also on file. A certificate of insurance naming the city has been submitted. Staff continue to communicate with organizers. No dept. concerns at this time. Budget Impact: There is no budget impact at this time. The festival is paying all the necessary fees that a regular park rental or event is required to pay.
