SUBJECT: On-Sale and Sunday On-Sale Intoxicating Liquor License Renewals for
RAM Arizona's LLC (Arizona's)

INTRODUCTION:
The City Council is being asked to consider renewing the on-sale and Sunday on-sale
intoxicating liquor licenses for RAM Arizona's LLC, doing business as Arizona's.
BACKGROUND:
Mr. Dennis Heyde has applied for the renewal of the liquor licenses for Arizona's. The property
where Arizona's is located (Canterbury Inn, 1244 Canterbury Road) is owned by Dennis and
Carol Heyde. The City Code provides that no license under Chapter 5 of the City Code shall be
granted for operation on any premises upon which taxes, assessments, or installments thereof, or
other financial claims of the City are owed by the applicant and are delinquent and unpaid.
Taxes are delinquent for 2002 ($281,737.86), 2003 ($251,777.54), and 2004 ($120,372.35). The
first one-half oftaxes for 2006 are unpaid, but not considered delinquent at this time.
The property is currently the subject of a mortgage foreclosure action, having been bought by the
bank at a sheriffs sale. Mr. Heyde has until July 19, 2006 to redeem the mortgage and continue
ownership of the property. He has advised the City Clerk that 100% of the taxes will be paid one
way or the other by him or by the bank that is foreclosing on the mortgage.
The.City Attorney has advised staff that the City Council may approve the liquor license
applications for a period less than a year, such as 31 days, in order to allow the applicant time to
pay the property taxes during that period. If the taxes are not paid by that date, the licenses will
automatically expire. If the taxes are paid, the City Clerk would issue new licenses for the
balance of the year. Alternatively, the City Council may deny the applications because of the
delinquent property taxes. The applications for the renewal of the liquor licenses are otherwise
in order.

ALTERNATIVES:
1. Deny the applications for renewal of the liquor licenses
2. Approve the applications for a 31-day period expiring on August I, 2006. If the taxes are
paid by that date, new licenses would be issued for the balance of the year. If the taxes are
not paid) the licenses would automatically expire on August 1, 2006.
RECOMMENDED ACTION:
A] If it is the desire of the City Council to renew the licenses, the City Council should
Move to approve the applications and grant on-sale and Sunday on-sale intoxicating
liquor licenses to RAM Arizona's LLC) dba/Arizona's, 1244 Canterbury Road for a 31-day
period expiring on August 1, 2006 and authorize the City Clerk to issue new licenses for the
balance of the year if the delinquent taxes are paid by August 1,2006.
B] If it is not the desire of the City Council to renew the licenses, the City Council
should adopt a motion denying the applications.
