RESOLUTION 7824 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AUTHORIZING THE CITY TO SUBMIT A NATIONAL ENDOWMENT FOR THE HUMANITIES (NEH) PUBLIC HUMANITIES PROJECTS GRANT APPLICATION WHEREAS, the City of Shakopee supports the grant application made to the NEH Public Humanities Projects, and WHEREAS, on April 19, 2011, City Council approved Resolution 7092, allowing a city own parcel to become an extension of Memorial Park and be used as an educational opportunity for the citizens and visitors of Shakopee, and WHEREAS, the property is that part of the East Half of the Northeast Quarter of Section 6, Township 115 North, Range 22 West, Scott County, Minnesota, described as follows: Beginning at a point on the northerly right of way line of the Chicago and North Western Transportation Company (formerly Chicago, St. Paul, Minneapolis, and Omaha Railway Company), which point is 48 rods due West from the east line of said Section 6; thence run due North 28 rods; thence run westerly parallel with said northerly right of way line about 32 rods to the west line of Government Lot 6 of said Section 6; thence south along said west government lot line 10 rods 3.5 feet; thence easterly parallel with said northerly right of way line 6 rods 7.5 feet; thence southerly 17 rods 13 feet to a point on said northerly right of way line, distant 8 rods easterly of the west line of said East Half of the Northeast Quarter; thence easterly about 24 rods along said northerly right of way line to the point of beginning; and WHEREAS, said city parcel has been named History Park, and WHEREAS, such a grant, in partnership with the Shakopee Heritage Society, will be used to convert History Park into an interpretive and historical wayfinding system, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that if the City of Shakopee is awarded a grant by the NEH, the City of Shakopee agrees to accept the grant award. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The Council will consider the 2017Street Reconstruction Project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement for the 2017StreetReconstruction of $2,582,000.00. st 2. INTRODUCTION On November 15, 2016, the City Council adopted Resolution 7784, which ordered the preparation of a preliminary engineering report to analyze the reconstruction of the following streets: th Shakopee Avenue from CSAH 17 to 11 Avenue nd Dakota Street from Highway 101 to 2 Avenue This project is included in the City’s Proposed 2017 Capital Improvement Program. 2. SCOPE This report will determine the feasibility and cost effectiveness of reconstructing the above-mentioned streets. All existing infrastructure elements (street, utilities, etc.) within the project area were evaluated as part of this report. The report will provide a description of the proposed improvements, an itemized cost estimate, a cost apportionment and a preliminary assessment roll. 3. BACKGROUND Based on the limited asbuilt information the City has for the proposed project area, it appears the majority of the improvements along Shakopee Avenue were constructed between 1959 and 1974. Dakota Street was built in 1976. Improvements to the streets in the project area have since been limited to patching and seal coating. The existing pavements in a majority of the project area are deteriorated to the point where they require more than normal maintenance. There are many transverse and longitudinal cracks, areas of patching, crown problems and curb and gutter deficiencies. Residents along Shakopee Avenue are also experiencing problems with the sanitary sewer services. 4. EXISTING CONDITIONS The existing conditions are identified in Drawings 1 through 5 in the Appendix. th Shakopee Avenue is 45-feet wide from CSAH 17 to 10 Avenue and 43-feet wide thth from 10 Avenue to 11 Avenue. The sanitary sewer in the project area is 8-inch VCP constructed between 1959 and 1974 and was lined in 2009. The watermain consists of 12-inch CIP and 6-inch CIP in the project area. The storm sewer on Shakopee Avenue is RCP and was constructed between 1959 and 1974. Preliminary Engineering Report 2017 Street Reconstruction City of Shakopee, MN City Project No: 2017-1 nd Dakota Street is 41-feet wide. Dakota Street lacks curb and gutter from 2 Avenue to 120-feet north. Dakota Street has no sanitary sewer or watermain and there is RCP storm sewer and catch basins at Highway 101 for drainage. There is no sidewalk or bituminous trail along Shakopee Avenue or Dakota Street. 5. PROPOSED IMPROVEMENTS The proposed project area is identified in Drawing 6 in the Appendix. The proposed improvements are as follows: 5.1 Street Shakopee Avenue is proposed to be reconstructed at a width of 37-feet to nd match street width standards. Dakota Street from Highway 101 to 2 Avenue is in the business zone and is proposed to be reconstructed to its current width of 41-feet. All streets in the project area are proposed to be reconstructed to a 7-ton design. For the most part, existing grades and drainage patterns will need to be maintained. Narrowing the streets will allow for some minor grade adjustments. Reducing the street width has the following benefits: 1)Reduced hard surface 2)Reduction in runoff 3)Increased green space 4)Lower maintenance cost 5)Reduction in construction cost 6)Reduced speeds through a residential neighborhood 7)Allows for flexibility to adjust street grades to fix drainage problems 8)Less impact to existing boulevard trees A 37-foot roadway allows for parking on both sides of the street. It is not proposed to add sidewalk to the project area. The Natural Resources Coordinator will prepare a tree replacement plan for the area using Tree Replacement Funds. The total estimated cost for the street improvements is $1,280,000. Preliminary Engineering Report 2017 Street Reconstruction City of Shakopee, MN City Project No: 2017-1 5.2Storm Sewer The proposed storm sewer improvements are identified in Drawings 7 and 8 in the Appendix. The proposed storm sewer improvements consist of replacing mainline storm sewer, structures and leads in the project area. The total estimated project cost for the proposed storm sewer improvements is $338,000. 5.3Watermain The proposed watermain improvements are identified in Drawings 9 and 10 in the Appendix. The proposed watermain improvements consist of replacing the existing watermain and water services within the project area. The total estimated project cost for the proposed watermain improvements is $554,000. 5.4Sanitary Sewer The proposed sanitary sewer improvements are identified in Drawings 11 and 12 in the Appendix. The proposed sanitary sewer improvements consist of replacing the sanitary sewer main line and services within the project area. The sanitary sewer lines will be replaced with 8-inch PVC pipe. Services will be replaced with 4-inch or 6-inch PVC pipe from the main line to approximately 10 feet inside of the Right of Way. The total estimated project cost for the sanitary sewer improvements is $410,000. 5.5Easements It is not anticipated that easement acquisition will be required for this project. SPECIAL ASSESSMENTS 6.1 Street 30% of the project costs for the street improvements are proposed to be assessed on a per lot basis to benefiting properties. Corner lots that only have improvements made to one street will be considered a half lot. A corner lot is defined as a lot of record with two sides adjacent to existing City streets. Non single family residential uses will be assessed .5 units per unit. Non residential uses along Dakota Street will be assessed the number of equivalent residential lots resulting from dividing the properties front footage by 60-feet, similar to lot sizes in the adjacent neighborhoods. Non residential uses along Shakopee Avenue will be assessed the number of equivalent residential lots resulting from dividing the properties front footage by 85-feet, similar to lot sizes in the adjacent neighborhoods. The remaining 70% of the project cost for the proposed street improvements will be funded by the Capital Improvement Fund. The estimated assessment rate for the proposed street improvements is $6,144.00 per lot. A preliminary assessment roll is included in the Appendix. 6.2 Storm Sewer The General Storm Sewer Fund will fund 100% of the storm sewer improvements. 6.3 Watermain Shakopee Public Utilities will fund 100% of the watermain improvements. 6.4 Sanitary Sewer The Sanitary Sewer Enterprise Fund will fund 100% of the sanitary sewer improvements. ESTIMATED COSTS An itemized cost estimate is included in the Appendix. The following costs were prepared using 2016 construction costs and are subject to change, depending on the final design of the project, bids received, and actual work performed. We have done a site visit as well as completed survey of the damaged spillway. Outlined below please find the work plan associated with completing the project. Task 1 Project Management. This task consists of corresponding with city staff and coordinating and overseeing the design to ensure the project meets quality, timing, and budget requirements. This task also includes a meeting with Three Rivers Park staff if required. Estimate 21 hours @ $163hr = $3,423 Task 2 Review the Existing Storm Water Hydrologic Model for the Area. This task consists of reviewing the existing Storm Water HydroCAD model for the Mill Pond Subwatershed, as well as review of as-builts of the pond, outlet, and surrounding roadways. This review may also include the following: Review Parameters Used to Estimate Peak Discharges This Task includes reviewing the general parameters used to establish the individual subwatershed discharges and determine if the model needs to be adjusted to accommodate changes in land use, etc. The current model uses TP-40 methodology, however, our design will include modeling for Atlas 14 methodology or use of the approved JPA rate. This will need to be determined at project kick-off. Parameters reviewed typically include: acreage, land use, design rainfall event, impervious surface coverage, anticipated discharge rates, anticipated runoff volumes, etc. This task will include collection/ review of background data used for the design of the overflow spillway. Data may include existing and future land use mapping, aerial photography, City parcel records, GIS shapefiles, existing zoning and land use regulations, etc. A peak 100-YR discharge design rate will be determined through this effort. As you noted, the grant agreement does require that the grantee create a comprehensive plan that: Conforms to metropolitan system plans (Section 2.01(e)), is consistent with the adopted policies of the Council (Section 2.01(f)), and is compatible with the plans of adjacent and affected jurisdictions. The language used in the grant agreement mirrors the language in statute regarding comprehensive planning in metropolitan communities. Minn. Stat. 473.175, subd. 1directs the Metropolitan Council to review local comprehensive plans to determine “their compatibility with each other and conformity with metropolitan system plans.” In addition, the Council is directed to “comment on the apparent consistency of the comprehensive plans with adopted plans of the council.” In addition, Minn. The terms require that the grantee’s include a housing element that is consistent with the Council’s policies. Stat. 473.859, subd. 2(c) plans and programs for providing adequate housing opportunities to meet existing and project local and regional housing needs, including but not limited to the use of official controls and land use planning to promote the availability of land for the development of low and moderate income housing.” The Council has other housing-related programs and initiatives which are outside of the planning process and in which the City may choose to participate or not, such as the Livable Communities Act grant programs. (a)Notwithstanding the December31, 2019“EndDate” identified on Page 1 of this Agreement, the Grantee must review and updateitscomprehensive plan as re- quired by Minnesota Statutes section 473.864, subdivision 2, by December 31, 2018. Consultationwith Council and Adjacent Review. (b)The Grantee must submit its draft plan update to adjacent governmental unitsfor a 6-month adjacent review periodas required by Minnesota Statutes section 473.858, subdivision 2prior tosubmitting the planupdateto the Council for review.Prior to submitting its draft plan to adjacent units, the Grantee must consult with the Met- ropolitan Council Sector Representative for its district at least twice to update the Council on plan progress and potential policy conflicts. Consultation with Watershed Management Organizations. (c)The Grantee must ensure local surface water management planning requirements of Minnesota Statutes sections 473.859, subdivision 2 and 103B.235 are metby the December 31, 2018,deadline. Completeness; Plan Content. (d)Thecomprehensive plan submitted by the Grantee must be “com- plete” as described in the Council’s Local Planning Handbook, which is available onlineat metro- council.org/handbook.aspx, and must comply with the plan content requirements of Minnesota Stat- utes section 473.859 and other applicable law.If the plan is not complete as described in the Local Planning Handbook, the plan must be made complete within three (3) months of the incompleteness determination, or as otherwise mutually agreed to by the Council and the Grantee. Conformance to Metropolitan System Plans and Policy (e)The comprehensive plan submitted by the Granteemust conform to metropolitan system plansof the Council.The comprehensive -2- plan is deemed to comply with this condition if the Council concludes after its review that the plan is not likely to have a substantial impact on or contain a substantial departure from metro- politan system plans and allows the plan to go into effect without a plan modification. Consistency and Compatibility. (f)The comprehensive plan update submitted by the Grantee must be consistent with the adopted policies of the Council, including housing policy. In addition, the comprehensive plan must also be compatible with the plans of adjacent and affected jurisdictions. 2.02Disbursement Schedule. The Council will disburse fifty percent (50%) of the Grant Amount to the Grantee within thirty (30) days after final executionof this Agreement. The Council will dis- burse the remaining fifty percent (50%) of the Grant Amount after: (a)the Grantee has submitted, as appropriate, either (i)the entire current comprehensive plan and the certification required under Minnesota Statutessection 473.864, subdivision 2(a); or (ii)submitted the entire updated comprehensive plan and amendment or amendments to its comprehensiveplan necessitated by its review to the Council for review; and (b)the Council has reviewed and acted upon the Grantee’s submission; and (c)the Grantee has complied with the terms and conditions stated in Paragraph 2.01. 2.03Authorized Use of Funds. The grant funds provided to the Granteeunder this Agreement shall be used only for the purposes and eligible activities described in the Grantee’s work plan and budget as approved by the Council. A copy of the Grantee’s approved work plan and budget is attached to and incorporated into this Agreement as Attachment A. Eligible activities include, but are not limited to, staff pay, consultant and professionalservices, printing,and publishing. Grantfunds may not be used for per diem payments to appointed or elected board or commission members. Grantfunds also may not be used to purchase or acquire equipment or other tangible, nonexpendable personal property, or for activities inconsistent with the Council’s Comprehensive Development Guide, the Metropolitan Land Planning Act, Minnesota’s Critical Areas Act,or otherapplicable state laws. The Granteeagrees to promptly remit to the Council any unspent grantfunds and any grantfundsthat are not used for the authorized purposes specified in this paragraph. III. REPORTING, ACCOUNTING,AND AUDIT REQUIREMENTS 3.01Progress Reports. The Granteewill provide to the Grantee’s assigned Sector Representativea written midpoint progress report and a written final progress report describing the status of the work plan activities described in Attachment A. These reports ensure the grant funds are appropriately expended as described in the work plan and budget. The reports shall be subject to the following content and schedule requirements. Midpoint Progress Report (a). At approximately the midpoint of the Grantee’s work plan activities, the Granteemust submit to the Council a written midpoint progress report which includes: a sum- mary of the work plan activities completed;a summary of work plan activities to be accomplished during the remaining months of the work planwith associated anticipated completion dates; and a summary of unanticipated issues and opportunities that affect the work plan,time schedule for project completion, or budget. The midpoint progress report also must include a summary of pro- ject costs and sources of funds for those expenditures, and a list of itemized expendituresof funds receivedfrom the Council and matchingfundsby category in the budget. Final Progress Report (b). Upon completion of the work plan activities described in AttachmentA, the Granteemust submit to the Council a written final progress report which includes: a summary -3- of the work plan activities completed since the submission of the midpoint progress report; a summary of project outcomes, total project costs and sources of funds for those expendituresin- cluding both this grant,city funds, and other sources of funds; and a list of itemized expenditures of the grant funds. 3.02Accounting and Records. The Granteeagrees to establish and maintain accurate and complete accounts, financial records,and supporting documents relating to the receipt and expenditure of the grant funds. Notwithstanding the expiration and termination provisions of Paragraphs4.01 and 4.02, such accounts and records shall be kept and maintained by the Granteefor a period of six (6) years following the completion of the work plan activities described in Attachment A. If any litigation, claim or audit is started before the expiration of the three-year period, the records shall be retained until all litigation, claims,or audit findings involving the records have been resolved or until the end of the regular six-year period, whichever is later. 3.03Audits. The books, records, documents,and accounting procedures and practices of the Grantee that are relevant to this Agreement are subject to examination by the Council and either the Legislative Auditor or the State Auditor, as appropriate, for a minimum of six (6) yearsfollowing the completion of the work plan activities described in Attachment A. 3.04Authorized Agent. The Council’s authorized agent for purposes of administering this Agree- ment is the individual identified on page 1 of this Agreement, or another designated Council em- ployee. GRANTAGREEMENT TERM 4.01Term and End Date. This Agreement is effective upon executionof the Agreement by the Council. Unless terminated pursuant to Paragraph 4.02 or extended by written agreement pursuant to Paragraph 4.03, this Agreement will expire on the “End Date” identified at Page 1 of this Agreement. The term of this Agreement maybe extended by written agreement of the Council, but only in conjunc- tion with an extension authorized under Minnesota Statutes section 473.864, subdivision 2. 4.02Termination. This Agreement may be terminated by the Council for cause at any time upon fourteen (14) calendar days’ written notice to the Grantee. Cause shall mean a material breach of this Agreement and any amendments of this Agreement. Termination of this Agreement does not alter the Council’s authority to recover funds on the basis of a later audit or other review, and does not alter the Grantee’s obligation to return any funds due to the Council as a result of later audits or corrections. If the Council determines the Granteehas failed to comply with the terms and conditionsof this Agreement, the Council may take any action to protect its interests and may require the Granteeto return all or part of the funds. 4.03Amendment. The Council and the Granteemay amend this Agreement by written mutual con- sent. Amendments, changes,or modifications to the Grantee’s approved work plan and budget shall be effective only on the execution of written amendments signed by authorized representatives of the Council and the Grantee. -4- V. GENERAL PROVISIONS 5.01Conflict of Interest. The members, officers,and employees of the Granteeshall comply with all applicable federal and state statutory and regulatory conflict of interest laws and provisions. 5.02Liability. To the fullest extent permitted by law, the Granteeshall defend, indemnify and hold harmless the Council and its members, employees and agents from and against all claims, damages, losses and expenses, including but not limited to attorneys’ fees, arising out of or resulting from the conduct or implementation of the funded work plan activities. This obligation shall not be construed to negate, abridge,or otherwise reduce any other right or obligation of indemnity which otherwise would exist between the Council and the Grantee. The provisions of this paragraph shall survive the expiration or termination of this Agreement. This indemnification shall not be construed as a waiver on the part of either the Granteeor the Council of any immunities or limits on liability provided by Minnesota Statutes Chapter 466, or other applicable state or federal law. 5.03Compliance with Law. The Granteeagrees to conduct the work plan activities in compliance with all applicable provisions of federal, state,and local laws. 5.04Acknowledgment. The Granteeshall appropriately acknowledge the funding assistance pro- vided by the Council in promotional materials, reports, publications,and notices relating to the project activities funded under this Agreement. 5.05Warranty of Legal Capacity. The individual signing this Agreement on behalf of the Grantee represents and warrants that the individual is duly authorized to execute this Agreement and that this Agreement constitutes the Grantee’s valid, binding,and enforceable agreements.
