SPECIAL ASSESSMENT HANDOUT

At the conclusion of a project, a second public hearing will be held at which
time the City Council will officially adopt the special assessments. At this
hearing, the property owners have the right to appeal the assessment.
Special assessments may be paid in one of two ways.
The assessments may be paid in full (or partially) within 30 days from the date
the assessments were adopted without interest. The Finance Department will
mail a notice of the final assessed amount after the Council adopts the
assessment.
The second option is to place the assessments on the property taxes and spread
the payments out over 10 years, with interest. This will be done automatically
for the balance of the assessments not paid within 30 days. At any time over
the 10 years, the balance due may be paid in full.
Senior citizens may defer the assessments if certain criteria are met. The City
Clerk may be contacted to inquire about the senior citizen deferment.

INTRODUCTION:
A public hearing has been scheduled for March 30, 1993 to consider the 1993 Street
Reconstruction Program.
BACKGROUND:
The City Council of Shakopee has ordered the preparation of feasibility reports for the following
street improvements:
1. Atwood Street, 4th Avenue to 5th Avenue
2. Fillmore Street, 1st Avenue to 4th Avenue
3. Naumkeag Street, 2nd Avenue to 4th Avenue
4. 4th Avenue, Fillmore Street to Naumkeag Street
5. 8th Avenue, Atwood Street to Spencer Street
6. Spencer Street, 1st Avenue to Shakopee Avenue
The proposed improvements consist of complete street reconstruction for these segments of City
streets. Staff has compiled a single feasibility report addressing the costs and proposed
assessments for these projects.
The feasibility report was completed and submitted to the City Council on March 2, 1993 and
subsequently a public hearing was scheduled for March 30, 1993.
Staff has prepared the attached packet of information on each street project and will be
conducting six separate public hearings. Each packet contains a project fact sheet, cost estimate,
estimated assessment roll and appropriate Resolution. At the conclusion of each public hearing,
the City Council should either:
a) Order the project by adopting the appropriate Resolution.
b) Deny the Resolution.
c) Table the Resolution for additional information.
Also attached is a memo from the Finance Director outlining the funding sources for each project
and impacts on the various budgets and a memo from the Shakopee Public Utility Manager on
the recommended watermain improvements.

Attached is the schedule we discussed.
The 1993 cash basis budget for the Sanitary Sewer Fund shows $205,000 for
reconstruction projects. The attached schedule totals $222,400 is costs funded
by the Sanitary Sewer Fund. Also in the sewer fund cash budget is $100,000 for
the VIP Interceptor and $500,000 for the Rahr diversion.
Similarly, the Storm Drainage Utility fund has $205,000 in the cash budget
for reconstruction. The attached schedule shows only $23,600 being utilized.
The $1.1 - 1.2 million for the next phase of the upper valley drainage channel
is already funded by a previous TIF bond sale and the cash is in a capital
projects fund.
Assuming that all projects on the schedule are funded by using bonds as
shown instead of the CIF, the resulting bond issue would be about $1.6 - 1.7
million and the resulting tax levy about $25,000. If Valley Park & 11th would
not go ahead, it would hardly be worth issuing bonds for the rest of the projects
as opposed to using the CIF.
For the reconstruction projects alone, assuming that bonds are used instead
of the CIF, the tax levy would be around $13,000 for 10 years.
Please note that the 8th Ave project is funded out of the CIF because the
assessment is not a high enough percentage of the cost to make the project
eligible for GO improvement bonds. This is a permanent draw down of CIF cash in
the amount of $140,000 and a temporary use of $28,000 which is replenished when
the assessments are collected.
One factor to consider is that we have historically assessed the applicable
cost of a project to the benefitted property with out the 5% over levy required
by statute. The effect is having a small tax levy for a project that 100%
assessed. I will request the City Attorney to review the statutes and perhaps
Council will want to include an additional 5% in the assessed project cost to
eliminate the over levy.

A Resolution Ordering An Improvement And
The Preparation Of Plans And Specifications For
Spencer Street, 1st Avenue To Shakopee Avenue
Project No. 1993-7
WHEREAS, Resolution No. 3753, adopted on March 2, 1993, fixed a date for Council
hearing on the proposed improvement of Spencer Street between 1st Avenue and Shakopee
Avenue by complete street reconstruction; and
WHEREAS, ten days published notice of the hearing through two weekly publications
of the required notice was given and the hearing was held on the 30th day of March, 1993, at
which all persons desiring to be heard were given an opportunity to be heard.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the improvement is ordered as hereinafter described:
Complete street reconstruction of Spencer Street between 1st Avenue and
Shakopee Avenue, including all pavement, curb & gutter, sidewalks, storm sewer,
utilities and all other necessary appurtenances.
2. David E. Hutton, Public Works Director is hereby designated as the engineer for
this improvement, and shall prepare plans and specifications for the making of such improvement.
Adopted in session of the City Council of the City of Shakopee, Minnesota,
held this day of , 1993.

Pavement Condition - Poor, severely deteriorated. Deficient in structure, condition,
drainage and cross slope.

WHEREAS, Resolution No. 3753, adopted on March 2, 1993, fixed a date for Council
hearing on the proposed improvement of 4th Avenue, between Fillmore Street and Naumkeag
Street by complete street reconstruction; and
WHEREAS, ten days published notice of the hearing through two weekly publications
of the required notice was given and the hearing was held on the 30th day of March, 1993, at
which all persons desiring to be heard were given an opportunity to be heard.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the improvement is ordered as hereinafter described:

WHEREAS, Resolution No. 3753, adopted on March 2, 1993, fixed a date for Council
hearing on the proposed improvement of Fillmore Street, between 1st Avenue and 4th Avenue
by complete street reconstruction; and
WHEREAS, ten days published notice of the hearing through two weekly publications
of the required notice was given and the hearing was held on the 30th day of March, 1993, at
which all persons desiring to be heard were given an opportunity to be heard.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the improvement is ordered as hereinafter described:

SUBJECT: 1993 Street Reconstruction Program
DATE: March 30, 1993
Staff would like to utilize one of the City's consultants to design the street reconstruction
program. The reasons for this are:
o Due to the public hearing being held so late, staff is concerned about getting the
design done quickly and out for bids for this year. A consultant can throw more
employees and time at this design than can City staff.
o Inspection workloads will not permit City staff to work on this design after
May 1.
o Currently, City staff is already designing 3 projects and would not be able to start
on this design immediately.
Staff has obtained proposals from 2 of the 3 consultants working for the City to do the design
work. The proposals are as follows:
Orr-Schelen-Mayeron & Assoc. (OSM) $65,700 (Design Only)
Strgar-Roscoe-Fausch, Inc. (SRF) $83,100 (Design Only)
Since the City went to the 3 consultant's system one year ago, SRF has not done any design work
for the City. The idea at that time was to rotate consultants, rather than go with a "low bid"
system.
The estimated cost of the project is $1.0 million, so a proposed fee of 6 1/2% (OSM) is in line
with accepted fee schedules established by the ASCE for projects of this magnitude.
The City Council should discuss the concept of rotating consultants for each project or taking the
low bid from the pool of consultants for each project.
Because the design needs to be started immediately, staff is requesting authorization to hire a
consultant.

SUBJECT: Spring Load Restrictions
DATE: March 30, 1993
Each spring, Mn/DOT puts on load limit restrictions on their State highways south of the line
around Hinckly to prevent deterioration of the highways due to the frost thawing. Scott County
follows suit and notifies the City when the spring load restrictions go on. Attached is the letter
from Scott County indicating that the load restrictions for this year went into effect on March 15,
1993 and are expected to last until May.
The City of Shakopee has certain streets that are very susceptible to spring frost damage due to
the underlying soil conditions and high water table. Whenever the City is notified of load limits
by the County, the City places similar restrictions on certain City streets. Other streets that may
be restricted include unfinished streets (i.e. lacking the wear course) which do not have the
structural strength that the completed street needs.

During the restricted periods, the enforcement of the load limits is either by denial of a request
to use restricted streets or by complaints or visual observance of violators. In most cases, there
are other options available for hauling heavy equipment such as larger trailers with more axles
or alternate routes into the sites.
The City Code (Section 7.12) authorizes the City Engineer to post any necessary streets and it
is unlawful to operate a vehicle in excess of the posted limits.
Based on the current condition of the City streets, staff currently concurs with the load limits
imposed by the State. It would be extremely difficult to monitor individual City streets to
determine which day each street or subdivision should be restrictive and would require daily
inspections. Using different standards for different streets could also be interpreted as arbitrary
and capricious.

such places , and to place a motor vehicle with essential parts
(as defined in Minnesota Statutes) removed, except such vehicles
as are temporarily disabled for a period not in excess of twelve
(12) hours .
Subd. 4. Signs and Other Structures . It is unlawful
for any person to place or maintain a sign or other structure in
the traveled or untraveled portion of any street or other public
property without first having obtained a written permit from the
City. In a district zoned for commercial special permission al-
lowing an applicant to erect and maintain signs overhanging the
street may be granted upon such terms and conditions as may be
set forth in the zoning or construction provisions of the City
Code .
Subd. 5 . Continuing Violation. Each day that any per-
son continues in violation of this Section shall be a separate
offense , and punishable as such.
SEC. 7 .09. CURB AND GUTTER, STREET AND SIDEWALK PAINTING OR
COLORING. It is unlawful for any person to paint, letter or
color any street, sidewalk or curb and gutter for advertising
purposes , or to paint or color any street, sidewalk or curb and
gutter for any purpose , except as the same may be done by City
employees acting within the course or scope of their employment.
Provided, however, that this provision shall- not apply to uni-
formly coloring concrete or other surfacing, or uniformly painted
house numbers , as such coloring may be approved by the City Ad-
ministrator.
SEC. 7.10. CURB SET-BACK.
Subd. 1 . Permit Required. It is a misdemeanor for any
person to hereafter remove , or cause to be removed, any curb from
its position abutting upon the roadway to another position with-
out first making application to the City and obtaining a permit
therefor, approved by the Council.
Subd. 2 . Agreement Required. No such permit shall be
issued until the applicant, and abutting landowner if other than
applicant, shall enter into a written agreement with the City
agreeing to pay all costs of constructing and maintaining such
set-back area in at least as good condition as the abutting road-
way, and further agreeing to demolish and remove such set-back
and reconstruct the area as was at the expense of the landowner,
his heirs or assigns if the area ever, in the Council 's opinion
becomes a public hazard. Such agreement shall be recorded in the
office of the County Recorder and shall run with the adjoining
land.
Subd. 3. Sign-Posting. ANGLE PARKING ONLY signs shall
be purchased from the City and erected and maintained at the ex-
pense of the adjoining landowner in all such set-back areas now
in use or hereafter constructed. It is unlawful for any person
