Kraft City Administrator MEMO TO: Dennis Kraft, City Administrator FROM: Dave Hutton, Public Works Director SUBJECT: 2nd Avenue, Project No. 1991-3 DATE: November 5, 1992 INTRODUCTION: Attached is Resolution No. 3703, a resolution adopting the special assessments for 2nd Avenue, Project No. 1991-3 . BACKGROUND: The 2nd Avenue Project is completed and all final project costs have been identified. The railroad crossings at Market Street and Minnesota Street are still unfinished, but any costs associated with these crossings will not be assessed. The assessments must be certified to Scott County by November 30, 1992 . The final project costs are as follows: Construction Costs $1, 098, 845.43 Engineering/Administrative Costs 271, 664 .93 Total Project Costs $1,370,510.36 Plus Railroad Crossing Costs 156 , 608. 55 Grand Total Project Costs $1,527,118.91 The railroad crossing costs will be funded completely by State Aid Funds and TIF Reserve Funds. For discussion purposes on the assessment calculations, the total project costs of $1, 370, 510. 36 will be used. The assessments for this project are extremely complicated. Therefore, staff has provided Council with a number of attachments for additional information. The City Council should review all this information as thoroughly as possible prior to the November 10th public hearing. Staff will give a presentation on the assessment calculations at the public hearing. The following summarizes the assessments on each portion of this project. 1 Street Assessments - 2nd Avenue The final amount that will be assessed from 2nd Avenue itself is $209 , 092 . 42 . This was calculated on a front foot basis for all properties abutting 2nd Avenue. That portion of 2nd Avenue that had existing pavement was assessed at 25%, with an assessment rate of $14 . 83 per front foot. That portion of 2nd Avenue that was a gravel street or non-existent street was assessed at 100%, with an assessment rate of $59 . 32 per front foot. All streets that were constructed wider than 36 feet were reduced in cost to reflect the street oversizing. The final assessed costs are approximately 16% higher than what was estimated in the feasibility report due to bid prices being slightly higher than estimated. Street Assessment - North/South Streets The final amount that will be assessed for the north-south streets is $228, 060. 97 . Again, reconstructed streets were assessed at 25% and new streets were assessed at 100%. In accordance with the City Council Special Assessment Policy, all north-south streets were assessed on a zonal basis, using an assessed area of 1/2 block on each side of the north-south streets. All lots within the zonal areas were assessed equally on a per lot basis. The 100% assessment rate is $2 ,735. 23 per lot (or about $45. 59 per front foot on a typical City lot) and the 25% assessment rate is $711.96 per lot. During the project, the block of Fillmore Street between 2nd Avenue and 3rd Avenue was added to the project due to the installation of watermain and sewer, resulting in the need to reconstruct this block. The north 1/2 of the block was completely reconstructed and therefore a 25% zonal assessment was added to the properties in the blocks abutting this street. The south 1/2 of this block was not completely reconstructed but was basically overlayed with new pavement after the watermain was installed. Since Shakopee Public Utilities Commission (SPUC) requested to put the watermain in this segment, they are paying these street costs 100%. The final assessed costs are approximately 30% higher than estimated due to the addition of that one block of Fillmore and higher bid prices. The final assessment rate was approximately 20% higher than estimated. Sanitary Sewer Costs The total sanitary sewer mainline costs are $271, 438 . 65. Of this amount, $98, 820. 39 will be assessed. Replacement sewers are not being assessed, but all new sewer mains will be assessed 100% to all benefitted properties on a per lot basis. All non assessed 2 I costs will be funded by the Sanitary Sewer Fund. The assessment rate for the sanitary sewer mains is $2 , 797 . 07 per lot. This is approximately 18% lower than the estimated costs in the feasibility report. Watermain Costs The total watermain costs for this project are $339,243 . 36. Of this amount, $120, 325. 65 will be assessed. The remaining costs will be funded by SPUC, or the City. All new watermain is assessed 100% to the abutting properties on a per lot basis, while all replacement watermain is non-assessed. The final assessment rate for watermain is $3 , 807 . 65 per lot. This is approximately 48% higher than estimated. Sewer and Water Services All properties that received new sewer and water services were assessed directly for those costs. Any defective service lines or improper service lines such as shared services (not allowed by building codes) were corrected and replaced as part of this project. The service lines were replaced from the mains to the property lines, which are the property owner' s responsibility. The total amount of service line assessments is $24, 163 . 00. The feasibility report did not estimate service line replacements because it is impossible to determine the number of defective services that need replacing until they are excavated. At the original public hearing, staff stated several times that the estimated assessments did not include any service line replacement costs. Trunk Watermain Costs In addition to service line costs, all properties that received new water services and previously did not have water services are subject to a trunk water charge per current SPUC policy. The trunk water charges are $600. 00 per acre or about $. 014 per square foot. For a typical City lot (60 ft. x 142 ft. ) the trunk water charges are approximately $117 . 35 per lot. Other Discussion Items 1. Special Assessment Credits There are a number of situations where the current City policy on special assessments needed to be modified. In those situations, an assessment credit was given to reflect those changes. The following summarizes those credits: 3 a. South 1/2 of the Block 2 (John McGovern' s property) . Because the railroad still owns property between the 2nd Avenue right-of-way and Mr. McGovern's property (from an old spur line) , the City Attorney has ruled that this property cannot be assessed for 2nd Avenue since it does not abut the street and has no direct access to 2nd Avenue. Therefore, a credit of $17,795. 10 was given to this property to eliminate the proposed street assessment and this amount will be part of the City wide costs for this project, rather than absorbed by the remaining assessed properties. b. SPUC Watermain Credits It is the SPUC policy that all properties that have existing water service will not be assessed for new watermain, even if the service was deficient or if it was on a shared service or a long service line, even if mainline watermain was not along the frontage of the property. In those cases, SPUC will be paying for those watermain assessments for any new watermain crossing those properties. c. Block 29 (East of Naumkeag) Because this block is not the same as a typical City block and also since the improvements made to this block were slightly different, the standard assessment policies were needed to be modified for this block. The front foot street costs for 2nd Avenue were the same as the rest of the project. The zonal costs were slightly different because the 1/2 block of Shawmut Street was not constructed to normal street widths, but was built narrower to match in with the alley. In addition, there are not as many lots available to share in the zonal street assessment as in a normal block (Note: Only 1 lot on the east side of Shawmut) . This segment of Shawmut Street and the alley were treated like an alley assessment rather than a street assessment. Lots 6 and 7 of this block were originally proposed to be assessed as 2 lots, but based on information provided by the Planning Department, Lot 6 is an unbuildable lot as it currently exists. Therefore, the assessments for this lot were reduced by eliminating the sewer and water assessment, but this lot still received a street assessment. 4 The City Council may wish to consider adjusting the per lot sewer assessment for Lots 7 and 8 of Block 29 and Lot 10 of Block 34 (east side of Shawmut Street) because these lots could not be served by the gravity sewer in 2nd Avenue, resulting in the need to construct a forcemain. For these properties to utilize this forcemain, a private grinder pump will need to be installed at the property owner's expense, which is above and beyond what a normal City lot with gravity sewer would need. Therefore, the sewer improvement received by these lots will actually cost more than the other properties once the pumps are installed in order to utilize the sewer system. For this reason, the Council may wish to reduce the proposed sewer assessment of $2 ,797 . 07 per lot for these lots. d. Benefit Appraisals The City Council authorized benefit appraisals for 5 properties on this project. A summary of the benefit appraisals are included in the attachments. In these cases if the proposed assessment exceeded the amount of the benefit appraisal, the assessment was reduced accordingly. Only 1 property had an adjustment to their assessment. The other 4 properties were assessed in line with the benefit appraisals. 2 . Special Assessments Versus Property Valuation. Staff has obtained a listing of all current property valuations (before improvements) for each parcel on this project. In the attachments is a listing of all property's valuations, the amount proposed to be assessed and the percent of valuation the assessment represents. This information is provided to Council for information purposes. 3 . Special Assessment Relief At the original public hearing ordering this project, the City Council requested that staff investigate alternatives for providing special assessment relief for this project. In the attachments is a copy of the staff memo outlining the possible options for special assessment relief. After reviewing these options, the Council elected not to adopt any of these options for this project at that time. 4 . Assessment Appeals Staff has already received a number of written letters notifying the City of an intent to appeal their assessments. By law, anyone who wishes to appeal must file a written notice 5 prior to or on the day of the public hearing. In the attachments are copies of all the appeal letters received by staff prior to the time this memo was mailed to Council. After the public hearing, the persons who filed the intent to appeal have 30 days to officially initiate the legal appeal process. SUMMARY: Since the original assessment notices were sent out, staff has continued to refine and adjust the proposed assessments based on discussions with SPUC (watermain portion) , the City Attorney, other City staff, property owners and additional file research. Therefore, the assessments listed in the attached assessment roll may be different than the amount listed in the notices received by the property owner. Only 1 property resulted in an increased assessment, due to the omission of the watermain assessment from the initial notice. Upon the conclusion of the public testimony, attached is Resolution No. 3703 which adopts the assessments for this project. If Council continues the public hearing, it should be continued to a date prior to November 30th, in order to certify the assessments to the County. DEH/pmp MEM3703 6 RESOLUTION NO. 3703 A Resolution Adopting Assessments For 2nd Avenue, Between Sommerville Street And Naumkeag Street And Various Abutting Cross Streets Project No. 1991-3 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shakopee met and heard and passed upon all objections to the proposed assessments of: 2nd Avenue, between Sommerville Street and Naumkeag Street and various abutting cross streets by complete reconstruction (pavement, curb & gutter, storm sewer, sanitary sewer and watermain) . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2 . Such assessments shall be payable in equal annual installments extending over a period of ten years, the first installment to be payable on or before the first Monday in January, 1993 , and shall bear interest at the rate of 7.75 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 1993 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year. These alternatives were discussed at the beginning of the 2nd Avenue Project, but the City Council elected not to adopt any of these options for this project. TO: Dennis R. Kraft, City Administrator FROM: Gregg Voxland, Finance Director RE: Special Assessment Relief DATE: September 11, 1990 Introduction Council has requested input from staff regarding a way to provide special assessment relief to low income property owners. Background Council levies special assessments against benefitted properties to pay for improvement projects. The assessments are levied according to the policy that Council adopted 8/1/78. Assessments are normally spread over a ten year period on the property tax statements or the owner may pay the balance at any time. The interest rate on the assessment is based on the interest rate of the bonds used to finance the project. Council is concerned about the financial burden on low income property owners for assessments in conjunction with the improvement of Second Ave. Spencer to Naumkeg. Some options and issues are; 1. Extend the term of the assessments to 15 or 20 years. While this option lowers the annual payments, it increases the total cost to the owner by paying interest for more years and at a higher rate based on a normal yield curve of higher rates for longer terms. This also increases the cost to the City because records have to be active and maintained for a longer term. Having shorter term bonds (10 years) is a positive factor in Moody's view when rating bonds, leading to a better rating and lower interest rate. 2. Lowering the interest rate. Council addressed this issue several years ago and set the policy to have the interest rate on special assessments at one and one half percent over the interest rate on the bonds used to finance the project. If there are no bonds issued and the CIF or other funds are used, eight percent is set as the rate on assessments. Eight percent is the statutory maximum in this instance. The one and one half percent is used to help cover delinquencies and the statutorily required five percent over levy. As I recall, the City used to set the rate at two percent over the bond rate and Springsted recommended two percent. Lowering the interest rate below the 1.5% reduces that cushion and may increase the need for City support in debt service. Lowering the rate below the bond rate is subsidizing the project the same as not assessing the whole cost of the project. 3. Do not assess the full cost. This appears to require an exemption from or a revision of the assessment policy. Alternatively, Council may want to discuss considering this to be a gravel street that is reconstructed rather than construction of a new street which would then result in a 25% assessment instead of 100% assessment. This may have serious policy implication and Council may want to review the assessment policy in its entirity. 4. Defer special assessments. Any deferment of assessments causes problems with tracking, splits, collection etc. Taxpayers would have to pay for the bonds in the mean time and the current would enjoy the benefit without having to pay for it. 5. Political/social issues that are involved include; 1. Does any potential change apply only to Second Ave or to all property owners for various projects? 2. Except for the senior discount on garbage rates (theoretically there is less use of the service) , the City has generally stayed out of "social welfare" issues or benefits based on income or family status. Recommendation Generally staff would recommend the status quo. If there is a change to be made the recommendation would be to extend the term of the assessments on a project by project basis. Council should discuss the issues involved and give direction to staff for which options they wish to pursue. ATTACHMENT NO. 10 Attached are all letters from property owners received by City staff by November 6, 1992 notifying the City of their intent to appeal their assessments. Under Minnesota Law, the amount of the assessment cannot exceed the benefit to my property. based on your levy, I would have to be able to market each lot at $27, 035.93 or $54, 071.94 for both lots. and, you have to prove that the before value of each lot was at least $13 , 517 . 97. You also have to prove the value of each lot after the second avenue project was completed was $27, 035. 93 in order to support your assessment. I tried to sell the vacant lot I own in 1990 and 1991 before the second avenue project and the best offer I had was $8 , 000. 00 . You need to remember, these parcels front on Second Avenue, with railroad track frontage and are only 60 ' in width. I can buy a much larger lot in a more prestigious area (Hauers Addition, the Meadows and a few more) of our community for a lot less then $27, 035.93 . In addition, FHA will not insure a mortgage for dwellings located closer then 100 ' of the railroad tracks. My dwelling is less the 100 ' from the railroad tracks. If a house was built on the vacant lot with a 30 ' setback, it would also be less then 100' from the tracks. This also presents considerable market resistance to the property I have. Prairie St . ) To Whom it may concern: I believe that the proposed assessment to the above stated property is unreasonable and I feel is higher than the amount to which the property has increased due to this assessment . The following information has been supplied to me by the City of Shakopee and is from which I will try to justify my reasoning. 1 . In early March of 1991 , I was informed of the proposed estimated assessment of $7 , 156. 06 to my property. In late October of 1992, I was informed that the proposed assessment for the completion of this project would be $9 , 123 . 61 which results in an amount $1967 . 55 higher than expected . This completed assessment is approximately 27% higher than the proposed estimate . 2. In early March of 1991 , I was informed that the proposed estimate on these improvements would cost the City of Shakopee $999, 500 . 00. As stated by the City of Shakopee in late October of 1992, the actual cost of these improvements was $673 , 604. 59 . This completed assessment has cost the City of Shakopee $325 ,895 . 41 less than the estimate for the project . This is approximately 32% less than the estimate . 3 . Why is the City of Shakopee paying 32% less than anticipated and why am I paying 27% more than anticipated? I feel that if the project cost the City of Shakopee 32% less than the estimate , that 32% reduction should be reflected in my assessment as well . This would reduce the assessment to $4 , 866. 00 as opposed to $7 , 156 . 00 . 4. The appraised value of the property for tax purposes in 1992 was $46, 200. This appraisal was made by the Scott County assessor . Given the current assessment of $9 , 123 . 00 , this increases the appraised value for tax purposes to $55 , 323 . 00. This assessment is 20% of the original appraised value . I find it hard to believe that these improvements will increase the value of the property by 20%. 5 . In the original estimate , the City of Shakopee provided a detailed breakdown of each aspect of the assessment . ie : Front Foot , Zonal , Sewer , Water , etc. At the current state , no details or explanations have been disclosed as to how the final assessment figures were determined. This leads me to question the amount of the proposed final assessment even further . I am submitting this information to the City of Shakopee as a formal consideration as to whether the proposed final assessment amount is reasonable to the stated property. Ladbroke Racing Canterbury, Inc. (Ladbroke) has currently not received the approval of the Minnesota Racing Commission (MRC) to continue simulcasting operations at Canterbury Downs beyond December 31, 1992. The lack of this approval has forced Ladbroke to issue notices to its remaining employees at Canterbury Downs under the Workers Adjustment and Retraining Notification Act (WARNA) , of which you were previously notified. The November 18, 1992 meeting of the MRC is realistically the last chance for the .*_RC to grant Ladbroke the needed approvals and thus avoid the shutdown of operations at Canterbury Downs . The major impediment to receiving this approval is the lack of an agreement with the horsemen regarding a live race meet at Canterbury in 1993 . This is a very complex issue and one which will be quite difficult to settle prior to November 18, 1992 . However, we feel, and we hope you share our feelings, that there are a large number of parties beyond the horsemen, who are affected by the MRC' s action. These parties include the employees of the racetrack who will be terminated if there are no ongoing operations; the taxpayers of the City, County and State who will not receive the benefit of the admission or pari-mutuel taxes currently being paid by Canterbury; our fan base which will be forced to find alternative sources of entertainment, and the City of Shakopee who has repeatedly shown their desire to avoid a closing of the facility. We would like to make it clear that Ladbroke does not intend to stop live racing at the track indefinitely; however, in our opinion, it may be best for all concerned that there be no racing during 1993 . Instead, simulcasting would continue to build a purse fund estimated at approximately $2 million, to allow a meet to be held in 1994 with adequate purses to attract a quality group of horsemen.
