Wise, City Planner RE: Overhead Transmission Lines DATE: October 23, 1989 INTRODUCTION• At a special meeting on October 19, 1989, the Planning Commission passed a motion recommending to the City Council that approval be given to the Shakopee Public Utilities Commission for construction of an overhead electrical line between the Blue Lake Sub-station and Canterbury Industrial Park. BACKGROUND- At their meeting on October 17, 1989, the City Council received a request from Shakopee Public Utilities Commission to construct an overhead electrical line between the NSP Sub-station and Canterbury Industrial Park. According to City Code, electrical lines must be located underground unless an exemption is granted in accordance with City Code Section 4.35, Subd. 2. After discussing the request of the Shakopee Public Utilities Commission, it was determined that the City Council could not act on the request until the Planning Commission had met and forwarded a recommendation regarding this item to the City Council. The City Council directed the Planning Commission to hold a special meeting to review this item and forward a recommendation to the City Council as soon as possible. For additional background on this item, please refer to the information enclosed in the packet for the October 17, 1989 City Council meeting (agenda item 410d. ) The Shakopee Planning Commission held a special meeting on October 19, 1989, and took action on this item. PLANNING COMMISSION RECOMMENDATION: At their special meeting on October 19, 1989, the Planning Commission passed a motion recommending to the City Council that Shakopee Public Utilities Commission be granted an exemption from the requirement for underground utility lines for the electrical line connecting the NSP Sub-station to the Canterbury Industrial Park. The Planning Commission finds that the exemption is warranted on the basis of Criteria #1 contained in City Code Section 4.35, Subd. 2B, in that the underground placement of the electrical line would place an undue financial burden on the utility company. ACTION REOUESTED• Offer and pass a motion granting to Shakopee Public Utilities Commission permission to construct an Overhead electrical line between the NSP Sub-station and Canterbury Industrial Park; and finding that the construction of this utility line complies with City Code Section 4.35, Subd. 2B, Criteria #1.
