Kraft Acting City Administrtor - XEHO TO: Dennis Kraft, Acting City Administrator FROM: Dave Hutton, City Engineer--T----,,-, .Z/ SUBJECT: Downtown Streetscape Project No. 1987-2 DATE: June 15 , 1989 INTRODUCTION: An assessment public hearing for the Downtown Streetscape Project No . 1987-2 , has been scheduled for June 19 , 1989 • Attached is Resolution No. 3071 , which adopts the assessments for this project for Council consideration. BACKGROUND: The Downtown Streetscape Project was constructed in two phases. Phase I was constructed in 1987 and Phase II was constructed in 1988 . In March , 1987 the City Council adopted the assessment policies that were to be used on this project. Using those policies and a cost estimate for the project , a preliminary assessment cost was calculated. Staff has now taken the actual construction costs and using the same assessment policies and formulas that were adopted in 1987 , calculated the actual assessments for each parcel . Staff will give a presentation on the assessment calculations at the public hearing . Staff will first summarize the project costs , then go through the funding breakdown and finally summarize the assessment policies and calculations. Proiect Costs The total project costs to date are $2 ,220 ,430 .70 . The project is essentially 99% complete. All remaining costs are non- assessable so there will be no need to revise the assessment calculations. The project had been estimated at $2 ,808 ,944. The actual contract for this project was $2 ,237 ,326 .75. As you can see the final project costs are below the original engineer ' s estimate and also under the contract amount. The total project costs can be broken down as follows: Phase I Construction Costs = $1 ,052 ,918.65 Phase II Construction Costs = $1 .167 .512 .05 Total Construction Costs $2,220,430.70 In addition to the actual construction costs , there were administrative costs totalling $457 ,280 .72 or about 20% of the construction costs . These administrative costs include engineering, legal fees, easements, testing and inspection, bond interest and other miscellaneous expenses . The total expenditures to date is $2 ,677 ,711 .42. The construction costs can further be broken down as follows: Storm Sewer $283 ,470.18 Sanitary Sewer 204,511 .43 Watermain 46 ,713 .40 Street, Curb & Gutter, Sidewalk 812,910.69 Streetscape 379 ,719.46 Street Lighting 345 , 108.12 Change Orders 147 .997 .42 TOTAL CONSTRUCTION COSTS $2,220,430.70 Funding Summary The various funding sources and amounts for the total project costs can be broken down as follows : Holmes Street Basin $ 160,240 .50 (Storm Sewer Utility Fund) Sanitary Sewer Fund 190 ,101 .35 S.P. U.C. Cost 115 ,546 .39■ Project Fund (T. I.F. ) 963,323 .54 Assessable Amount (Street, 791 .218.92 Curb & Gutter, Sidewalk and service connections) TOTAL $2,220,430.70 a The total SPUC cost has not yet been approved by SPUC. The administrative costs will be spread out over the various funding sources based on the percentage of total construction costs. Special Assessment Policies The assessment policies that were adopted by Council in March, 1987 are summarized in Attachment No. 7 . The two main policies that need to be mentioned are: 1 . Only 25% of the street rehabilitation costs will be assessed. This only includes street, curb and gutter, and sidewalks . No other portions of the project ( i . e . streetscape items) will be assessed . 2. The 70% front foot/30% square foot formula shall be used to calculate the individual parcel assessments. Assessment Calculations The total assessable amount as listed on the funding summary is $791 ,218 .92. Of this amount $16 ,293 .93 is for individual service connections that will be assessed directly to those properties. This leaves an amount of $774 ,924 .99 for all pavement, sidewalk and curb & gutter. Of that amount , there are several deductions that are non- assessable as follows: 1 . Parking Lots $14, 136 .75 2 . Alley by NW Bell $ 2,000 .00 3 • Scott Street Patch By Railroad Tracks $ 8.798.90 $24,935 .55 Deducting that amount leaves a total construction cost for the street portion at $749 ,989 .44. Using a straight ratio of total administrative costs versus total construction costs and comparing that to the total street construction costs , it was determined that the total administrative costs attributable to the streets portion was $153 ,288. 19. Therefore, the total project costs for the street portion is as follows: Construction Costs $749 ,989 .44 Administration Costs $153 .288.19 Total Project Costs $903,277 .63 Of this amount only 25% is assessable 25% x $903 ,277 .63 = $225 .819 .00 This is the total amount to be assessed for this project. This amount was then spread out over all properties in the project area on a 70% front foot/30% square foot ratio. In addition to that amount , individual service connections that needed to be replaced were assessed directly to those properties. There were several other adjustments that need to be mentioned at this time. 1 . Those properties on 2nd Avenue on the south side between Fuller and Atwood Street received a credit for curb and gutter and sidewalk that was not replaced during this project , per Council directive at the beginning of the project. 2 . All residential properties received a 7 .9% credit for oversizing of the commercial streets. 3. All properties received a 0 .8% credit for oversizing of the curb & gutter and sidewalk due to the streetscape concept (nodes, wider walks, etc. ) 4 . Properties along 3rd Avenue received a $112 credit for sidewalks , since the sidewalks were not replaced as part of this project. All of the above credits and adjustments were adopted by the City Council at the beginning of the project. The grand total that is assessed for this project including service connections and all credits listed above is $235 ,272 .00 or approximately 8 .7% of the total project costs to date. At the beginning of the project, the total assessment was estimated at $287 ,400 .00 . Attached is Resolution No . 3071 , A Resolution Adopting Assessments for the Downtown Streetscape Project Phase I Parts 1 and 2, Project No. 1987-2 for Council consideration. A complete assessment roll listing the assessment for each individual parcel is attached to the resolution. It should also be mentioned that the assessments for all properties currently being used for residential will be deferred until such time as those parcels convert to commercial use. 1 . Adopt the proposed assessments by Resolution No. 3071 . 2 . Deny Resolution No. 3071 . 3 . Continue the public hearing in order to make adjustments to the proposed assessments based on public testimony received. RECOMMENDATION: Staff recommends Alternative No. 1 , to adopt the proposed assessments as listed in Resolution No. 3071 . ACTION REQUESTED: Offer Resolution No. 3071 , A Resolution Adopting Assessments for Downtown Streetscape, Phase I Parts 1 and 2 , Project No. 1987-2 and move its adoption. The assessment district should include all parcels bounded by Atwood (both sides of the street) on the West, the North side of Third Avenue on the South, Sommerville on the East including the West side of Spencer abutting First Ave. on the East and the alley alignment between First Avenue and Levee Drive on the North. In addition, it includes parcels on the West side of Atwood that have front footage on said street. 2. The assessment policy shall use the shortest distance along a street as the front footage. 3. Each parcel shall receive a separate assessment. 4. city use and other parcels owned by non-profit entities will be considered as commercial for assessment purposes (consistent with other city assessment practices) . 5. Street Rehabilitation assessments on single family and two family residential properties within the assessment district shall be deferred with no interest until property is converted to commercial use. These assessments shall be paid for initially from tax-increment proceeds or other funds until the conversion use occurs. 6. Any city parking lot shall not be assessed but the cost for those areas shall be paid for from tax-increment proceeds. 7. The 70% FF/30% square foot formula shall be utilized for assessment purposes. 8. 25% of street rehabilitation project cost will be assessable to the property owners. 9. The entire streetscape portion of the project cost shall be paid for from tax-increment proceeds. I am a retired senior citizen, age 86, on a small fixed income from Social Security and cannot afford to pay any type of bill in this amount. Parts 1 and 2 Project No. 1987-2 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shakopee met and heard and passed upon all objections to the proposed assessments of: Downtown Streetscape Project Phase I, Parts 1 and 2 Includes the following streets: 2nd Avenue, from Sommerville to Atwood Atwood Street, from 1st Avenue to 3rd Avenue Fuller Street, from 1st Avenue to 3rd Avenue Holmes Street, from 1st Avenue to 3rd Avenue Lewis Street, from 1st Avenue to 3rd Avenue Sommerville Street, from 1st Avenue to 3rd Avenue By street lighting, sidewalk, curb and gutter , pavement, sanitary sewers, watermain, storm sewers, and miscellaneous streetscape items and appurtenances within those project limits. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1 . That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2 . Such assessments shall be payable in equal annual installments extending over a period of ten (10) years, the first installment to be payable on or before the first Monday in January , 1990 , and shall bear interest at the rate of 7 .75 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31 , 1990 , and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3 . The owner of any property so assessed may , at any time prior to certification of the assessment to the County Auditor, may pay the whole of the assessment on such property , with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30 ) days from the adoption of this resolution ; he may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and he may pay the remaining principal balance of the assessment to the City Treasurer. A. The Clerk shall file the assessment rolls pertaining to this assessment in his office and shall certify annually to the County Auditor on or before October 10th of each year the total amount of installments and interest which are to become due in the following year on the assessment on each parcel of land included in the assessment roll. BE IT FURTHER RESOLVED: 1 . That such proposed assessments together with any amendments for all those properties currently in use as residential properties, shall be deferred without interest until such time as those properties are converted to commercial uses. The said deferred residential properties are marked "deferred" on the aforementioned proposed assessment, a copy of which is attached hereto and made a part hereof. 2. The deferred assessments will be subject to the same conditions and interest rate as listed above in this resolution except that the first installment is payable on the first Monday in January of the year following the date the deferred assessments cease. 3 . The assessment will be deferred a maximum of 10 years or until the properties are converted to commercial use , whichever comes first.
