Subject : Summary of 1988 Assessment of Shakopee In an effort to equalize all taxable properties in Shakopee , the following work was done : Approximately 1100 parcels were physically viewed and reassessed as part of the 25% re-assessment for 1988. Most of the properties involved were in the southern portion of urban Shakopee. Residential lot values were also increased for properties with structures located upon them. The lot increases ranged from a few hundred to a few thousand dollars per parcel . Apartment buildings of four or more units were all re-assessed based on the income generated from them. This was done in the entire county as well as the City of Shakopee . In Shakopee , the response of the owners of apartment properties for income information was very good, with a response from 4-plex owners of 72Y. and larger apartment owners of 6W. As of today, I have no apartment owners scheduled to appear at the Board of Review. In all , 1700+ notices of valuation increases were sent out . As of this date , I have received calls or letters from approximately 30 property owners, and of those , four have informed me that they wish to attend the Board of Review. The others have been contacted and their questions have been answered to their satisfaction or their property has been rechecked and their value adjusted if new information was found. BACKGROUND: In 1985 the Minnesota Real Estate Journal published their first issue. Coincidentally, the first market focus for the publication was on the City of Shakopee. Shown in attachment #1 is a letter from Miss Mary Carlson, Publisher of the Minnesota Real Estate Journal inquiring whether or not the City of Shakopee is interested in proceeding with a second market focus publication on our community. Note that I have also enclosed a copy of the Market Focus that was done on our community in 1985. Shown in attachment #2 is a list of the responsibilities that the City would be responsible for in assisting with the development of the market focus section. Also shown in attachment #2 is a look at past market focus cities. Staff believes that an updated market focus would not only be valuable for potential developers but also for City staff in gathering pertinent information that can be kept on file. Timing for a new market focus is also very good in that we are beginning the process of updating our Comprehensive Plan. This should be of interest to potential developers. In the last three years we have also made significant progress in the expansion of our residential inventory, advancement on major highway projects and downtown redevelopment. On May 4th, staff presented this issue to the Community Development Commission and they have recommended that the City Council endorse and support participation in completing an updated market focus on our community. S � MEMO TO: John Anderson, City Administrator FROM: Dave Hutton, City Engineer SUBJECT: Upper Valley Drainage Project - Status Update DATE: May 6 , 1988 INTRODUCTION: Attached is a letter addressed to the City Council & staff from our consultant, Orr-Schelen-Mayeron & Associates, Inc. regarding the Upper Valley Drainage Project. BACKGROUND: Several weeks ago it was brought to our consultants attention that the Department of Natural Resources (DNR) and Minnesota Pollution Control Agency (MPCA) had some concerns regarding our Upper Valley Drainage Project discharging into the Mill Pond , which they designated as a trout stream based on a 1981 trout survey. Since that time , staff along with our consultant have met numerous times with the various agencies to try and alleviate their concerns and possibly avoid going thru the formal permit process . Our major thrust was to try and get the pond declassified such that it would not be classed as a trout stream. It appears that this will not be possible and that we will be required to go thru the formal permits. I would like to provide a little background information on why this has come about the way it has: 1 . The DNR has jurisdiction on (a) any project that involves construction in a protected water and also (b) discharges into trout stream. Our consultant checked with DNR at the beginning of the project ( verbally) regarding condition above and was informed that no permit was needed . Nobody had considered the possibility of the pond being a "trout stream" and therefore did not pursue this matter with the DNR. 2. The PCA has jurisdiction on discharges directly into the Minnesota River (mainly wastewater discharges) and therefore they were not contacted regarding a permit at the beginning of the project. Apparently, they also have jurisdiction on discharges into "trout streams". � b As a result of our most recent meeting with the DNR and PCA, it appears that the City will be required to obtain all the necessary permits, which consists of the following: • DNR permit to discharge into a trout stream • PCA permit to discharge into a trout stream • An environment assessment worksheet (EAW) will be required. • Any modifications to our discharge that results in construction with the protected waters will require an Army Corps of Engineers permit, also. The net summary of obtaining these permits will result in an added cost of the project to the City of from $250 ,000 - $750,000 depending on the modifications required by the permits and a delay of 6 months to 1 year to obtain the permits. The attached memo from OSM summarizes the specific concerns and recommended alternatives for modifying our discharge proposal into the Mill Pond. In addition, it appears that one of the conditions for our permits will be for the City to develop and enforce an ordinance making it mandatory for future development to store a&U increased runoff created by their development on site and the plans for the alternatives will be available at the Council meeting. ALTERNATIVES: 1 . Delay construction of the entire project until all necessary permits have been obtained. 2. Construct the project in phases . If we construct that portion of the project from the Upper Valley to 4th Avenue, no permits are required and we can continue to work on getting our discharge permits for next year's construction, to complete the project. 3. Construct the entire project but "plug" the end of the discharge pipe such that no water enters the "trout stream" until the appropriate permits are obtained. As I understand it, the permits are only required for discharging the water, not for constructing the project. There may be some legal risk involved with this alternative. In addition, the City would then be committed to modify the ponds to enhance the trout stream no matter what the costs are. 4. Authorize Orr-Schelen-Mayeron to proceed with completing the trout study and environmental assessment worksheet as well making formal application for permits. In addition, OSM should be authorized to proceed with designing alternatives to mitigate the effect of the project on the trout stream and preparing detailed cost estimates of each. 5. Take a "hard-nosed" stance on whether the various agencies are exceeding their jurisdiction and obtain legal advice on the issue. This would involve hiring an attorney who specializes in working with these agencies to review all the facts and provide the Council with recommended action. 6. Do nothing and construct the project as designed without obtaining the permits. This would probably result in litigation to resolve all concerns and an injunction being issued to halt the project. RECOMMENDATIONS AND SUMMARY: Due to the existing and planned development occurring in the Upper Valley area, the City must provide an outlet for their storm water systems or the City could be held liable for any damages caused by a large storm event. Therefore, we must begin construction this year. If we construct part of the system down as far as 4th Avenue, no permits are needed. (This is Alternative No . 2) . Due to the gravel soil conditions and size of our drainage ditch, no outlot will be necessary at 4th Avenue until additional development occurs. We could thereby use the drainage ditch as a so-called holding pond until we resolve all DNR & PCA concerns, although it would not hold too much water at this time. We could then obtain all necessary permits over the next year and finish the construction in 1989. Our consultant has recommended we proceed in this manner and staff agrees. Staff also recommends Alternative 4 , that Orr-Schelen-Mayeron be authorized to complete all necessary studies and make formal application to all agencies for permits and also prepare detailed plans and cost estimates for all alternative solutions. They indicated this area was identified as suitable for trout habitat based on a survey completed in 1981. Due to this concern, the MDNR and MPCA have indicated to us that permits from their agency's will be required for this project. They have also advised us that preparation of an environmental assessment worksheet (EAW) will be necessary in order to fully address the potential impacts of this project. In order to obtain permits from these agencies for the project as proposed, their representatives are presently indicating that additional improvements and/or management considerations would need to be incorporated into the project that would address the following: 1. Separation of the trout stream waters from the storm water discharge. The trout stream waters principally originate from three springs located on the westerly bank of the pond immediately south of the State Trunk Highway 101 crossing. (See attached map for further information). 2. Development of a storm water management plan in the upstream watershed that addresses water quality and quantity concerns related to the storm- water discharge. It was originally planned to address these concerns when the surface water management plan for the watershed was completed. One specific concern deals with providing ponding areas in Shakopee for water that is discharged to the storm sewer system so that treatment of this stormwater could occur prior to discharge into the Minnesota River. 3. Project design considerations that will provide assurance that the trout population would not be destroyed during construction, and that the downstream wetland area will not be subject to severe sedimentation as a result of this additional storm water being discharged at this location. �b Page Two May 5, 1988 It must also be noted that in order to separate the trout stream waters from the storm water discharge, work would need to be completed in areas that are under the jurisdiction of the Corps of Engineers. As a result a permit would also need to be obtained from this agency. Based on our discussions with the MPCA and DNR, three improvements have been developed that have the potential to address the agencies concerns and are attached. Because, specific design requirements for the separation of trout water some storm water have not yet been negotiated with the permitting agencies, it is possible that all three improvements may not be needed. However, it is likely that if the trout habitat designation remains, the improvement outlined in altervative one would be required at a minimum. Depending on the negotiated settlement between the agencies and the City, the other two improvements may also be required to fully mitigate the impacts as perceived by these agencies. The cost to construct alternative one is approximately $250,000, the cost to con- struct alternative two is an additional $250,000, and the cost for construction of a sedimentation basin if necessary has been estimated at $225,000. As a result, it is our opinion that the City's financial exposure to the demands of the previously mentioned agencies ranges from a minimum of $250,000 to an estimated high end exposure of $725,000. In addition to these improvements, the agencies have indicated it may be necessary for the City to agree to the development and enforcement of a policy that may require incorporation of rate control and treatment for storm water discharged from areas in the subwatershed prior to entering the outfall storm sewer. After reviewing the above matters with our staff and the staff at the city, we recommend that the following actions be taken in dealing with the previously discussed developments: 1. Complete a study to document and challenge the value of the habitat for trout that exists in this area today. Such a study should seriously question the designation of pond 3 as trout habitat. It is our opinion that pond 3 has little if no habitat that is suitable for trout during most times of the year. Furthermore it is our position that the discharge of stormwater into this area may actually improve the suitability of the pond 3 area for trout habitat. 2. Obtain assurance from the Minnesota Department of Transportation that they will provide financial cost share assistance for a modified project which they have indicated is possible. 3. Make application for permits from the agencies as well as complete the environmental assessment worksheet. In these proposed applications, it is recommended that the mitigation outlined in alternative one be proposed and documentation included justifying why this mitigation is adequate. Additional improvements may need to be added as necessary but should not be proposed at this time. Page Three May 5, 1988 4. If preliminary feedback provides an indication that some combination of the previously outlined plans for mitigation will address the agencies concerns, begin construction of the project in the upstream reaches where no permit is required. The project should be broken out into two phases. Phase one should contain project work beginning at the south end of the project and working northerly to 4th Avenue. Work north of 4th Avenue would be constructed as part of Phase 2 and would be undertaken once permits are received. It is anticipated that the commencement of Phase 2 work could not occur until the 1989 construction season.
