HomeMy WebLinkAbout11/22/1983 OFFICIAL PROCEEDINGS OF THE CITY COUNCIL SPECIAL SESSION SHAKOPEE, MINNESOTA NOVEMBER 22, 1983 Mayor Reinke called the special meeting to order at 5:05 p.m. with Cncl. Vierling, Colligan and Wampach present. Cncl. Leroux arrived late and Cncl. Lebens was absent. Also present were John Anderson, City Admr. , H. R. Spurrier, City Engr. , and Judith S. Cox, City Clerk. The City Admr. explained the proposed revisions to the Environmental Assessment Worksheet prepared by Barton-Aschman for the Shakopee Racetrack site, which revisions are being recommended by the Minnesota Pollution Control Agency. Vierling/Wampach moved to approve the revisions to the Environmental Assessment Worksheet for the Shakopee Racetrack site as presented. Motion carried unanimously. (A complete copy of the Environmental Assessment Worksheet, as revised, is on file in the office of the City Clerk. ) Colligan/Vierling moved to approve a proposal by Barton-Aschman Associates, Inc. to conduct the scoping process for the Shakopee Racetrack Environmental Impact Statement, at a cost not to exceed $25,000, and authorize proper City officials to execute same. Boll Call: Ayes; Vierling, Colligan, Wampach, Reinke Noes; None Absent; Leroux and Lebens Motion carried The City Admr. reported that the Scott County Auditor's office has been ordered by the State of Minnesota to increase the real property values for 1983 for certain properties in Scott County including the City of Shakopee. Cncl. Leroux arrived and took his seat at 5:19 p.m. After discussion staff was directed to contact other governing jurisdictions within the county to join us in requesting the Scott County Board to file a law suit against the State because their order provides for no appeal process for the county or a community. The City Admr. explained that staff had asked Zylstra United to delay some restora- tion work until spring, such as seeding, sodding, and street resotration. Dis- cussion followed. Consensus of Councilmembers present was to concur with staff and permit the sod- ding, seeding and street restoration of the cable system to be delayed until spring and that any penalties will be determined at a later meeting. Colligan/Vierling moved to adjourn at 5:37 p.m. Motion carried unanimously. Judith S. As discussed in our telephone conversation of November 22, 1983, we propose to provide services to the city necessary to review the scoping document (dated November 1983) with the Minnesota Pollution Control Agency, the Minnesota Environmental Quality Board, and other agencies as may be required. We would also be available to attend a public meeting to review the scoping document and respond to questions. Following the various meetings and discussions, we propose to consolidate and review the issues in a decision report to the City Council. This report does not have to be issued as a public document but would be retained for public inspection in city files. Its major function, based on discussions with Gregg Downing of the Environmental Quality Board, is to explain why specific issues will or will not be examined in the Environ- mental Impact Statement. In preparing it, we will rely upon the EQB's Guide to the Rules as the primary guideline. Barton-Aschman will prepare and present this report for acceptance by the Shakopee City Council. We will also make corrections or additions as directed by the Council or its representatives. Upon acceptance of the report and the Council's scoping decision, Barton-Aschman will prepare an EIS Preparation Notice with a brief summary of the scoping decision. We estimate the work described above can be for a cost not to exceed $25,000. The cost for these services will be based on our standard hourly rates for staff personnel plus reimbursement at cost for travel, communication, reproduction and miscellaneous expenses. Monthly billings for costs incurred during the period will be payable within 30 days of invoice date. A charge of one percent (1%) per month will be added to all past due accounts. It is anticipated that the scoping decision will be made no later than January 25, 1984. This would allow up to 15 days from the close of the comment period. If you feel the terms outlined in this letter accurately reflect your needs, we would appreciate your concurrence by signing and returning a copy for our files. To assist the Responsible Gov't Unit in defining and narrowing the issues to be addressed, a 30 day public scoping period will occur. Persons interested in the scope of this EIS should participate in this scoping process. An EAW has been prepared as an aid in scoping and is now available for review. A public meeting will be held (see notice below). Project Title: Shakopee Racetrack Location: Shakopee Responsible Gov't Unit: City of Shakopee Description: The proposed project is to develop a track, grandstand/clubhouse and • associated facilities for horse racing on 390 acres in the Valley Industrial Park, Shakopee, Minnesota. Based on preliminary plans, the total development includes 878,000 square feet of building area including stables. Final plans may result in as much as 1,000,000 square feet of development on the site. The grandstand/ clubhouse is being designed to accommodate a peak capacity of 25,000 patrons. Average daily attendance is estimated at 7,500 to 12,000 with a daily Normal weeklypeak anticipated to be 16,000 persons. The site is presently agricultural land which is planned and zoned for industrial development. If the track site is approved by the Minnesota Racing Commission, construction would begin in 1984 with completion expected in 1985. We had been drafting the EAW for your approval. That EAW will now be used as the scoping document for the EIS. In order to stay on schedule with the Racing Commission' s timetable, we need to have the City Council approve the EAW on Tuesday night, November 15, 1983 . The approval only starts the procedure going and does not constitute any final approval by the City. I enclose for your review a memo outlining the procedural deadlines we need to meet with the City 's assistance. The developer of the racetrack will be responsible to pay for all expenses incurred by the City in this process and will pay the consultants either directly or through the City, whichever you prefer. I hope that you will find this procedure to be acceptable and that you will consider approving the EAW, directing staff to work with the developer and take the steps necessary to meet the deadlines, and call for a public hearing for Tuesday night , December 20, 1983. — — November 10, 1983 Page 2 Copies of the EAP will be delivered to you and City staff on Friday or by mail on Saturday (since Friday is a federal holiday) .
